The Weld County Public Works Department has reviewed this proposal. Our comments and requirements are
as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002)
C and F Streets are collector roads and require an 80 -foot right-of-way at full build out. There is presently a
60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
25'h Ave. is a major arterial road, which requires a 140 -foot right-of-way at full build out. There is presently a
60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
•eld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
REQUIREMENTS:
Direct access from a public road will be limited to one (1) per legal parcel, except as further limited or restricted
by zoning or subdivision regulations. Additional accesses may be approved by the Department of Public
Works or the Board of County Commissioners. This policy shall apply to all new and existing accesses within
the unincorporated areas of the County. Properties within municipalities or other counties which access
County roads are subject to this policy.
A 40' radius is required on all accesses to public roads for accesses designed to accommodate truck traffic. {A
minimum effective turning radius of forty (40) feet shall be used for accesses intended to accommodate truck
traffic. (Weld County Codification Ordinance 2000-1)} Sec. 8-2-40 B. Road access design standards.
The USR area IS in a Special Flood Hazard Area (SFHA) as determined by a study from the US Army Corp of
Engineers/City of Greeley study. As per Code of Federal Regulation Title 44, Section 60.3, B.4, "Obtain,
review and reasonably utilize any base flood elevation and floodway data available from a Federal, State, or
other source, including data developed pursuant to paragraph (b)(3) of this section, as criteria for requiring that
new construction, substantial improvements, or other development in Zone A on the community's FHBM or
FIRM".
A water quality capture feature shall be constructed for all buildings, drives, and other impervious areas of the
USR.
A Flood Hazard Development Permit will be required for any development on the site. Per Code of Federal
Wegulation Title 44, Section 59.1 development is defined as "any man-made change to improved or
nimproved real estate, including but not limited to buildings or other structures, mining, dredging, filling,
a
grading, paving, excavation or drilling operations or storage of equipment or materials."

Environmental Health Services has reviewed this proposal for a lawn and tree care
business. There is an existing house on the property, which is also used as an office.
Employees utilize the house/office for drinking and restroom facilities. The City of
Greeley provides water to the site and an individual sewage disposal system (SE -
0701060) provides sewer for the site. The application states that a new residence and
shop may be built on the parcel sometime in the future. Pesticides are stored in the
existing shop building and are regulated according to the Pesticide Section of the
Colorado Department of Agriculture. According to the applicant the largest container
stored on site is 2'A gallons. All waste, from truck maintenance, is contained on site
and picked up by a waste disposal company.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).

3. As the applicant intends to utilize the existing septic system at the home, for
employee use, the septic system shall be reviewed by a Colorado Registered
Professional Engineer. The review shall consist of observation of the system and
a technical review describing the systems ability to handle the proposed
hydraulic load. The review shall be submitted to the Environmental Health
Services Division of the Weld County Department of Public Health and
Environment. In the event the system is found to be inadequately sized or
constructed the system shall be brought into compliance with current
Regulations.
4. A copy of the Commercial Applicators license, from the Colorado Department of
Agriculture, shall be provided to Environmental Health Services, Weld County
Department of Public Health & Environment.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met one month prior to construction activities:
1. The applicant shall submit evidence of a Colorado Discharge Permit System or
CDPS permit from the Colorado Department of Public Health and Environment
(CDPH&E), Water Quality Control Division, to cover stormwater discharges from
construction sites (5 CCR-1002-61) Alternately, the applicant can provide
evidence from CDPH&E that they are not subject to the CDPS requirements.
(New rule effective 3/2/2001).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. If an individual sewage disposal system is installed for the proposed shop and/or
proposed house it shall be installed according to the Weld County Individual
Sewage Disposal Regulations.
2. The septic system for the proposed shop, if the shop is utilized as part of the
business, 3is required to be designed by a Colorado Registered Professional
Engineer according to the Weld County Individual Sewage Disposal Regulations.
3. There shall be no washing of vehicles on the site unless a facility is constructed
to capture all effluent and prevent discharges in accordance with the Rules and
Regulations of the Water Quality Control Commission, and the Environmental
Protection Agency.

We recommend that the following requirements be incorporated into the permit as
development standards:
All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
-'3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
-4. The applicant shall operate in accordance with the approved "waste handling
plan".
-5 Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
6. The facility shall have sufficient equipment available to implement dust control as
required by the Weld County Department of Public Health and Environment.
`'7. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S., as amended.
"8. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility, at all times.
Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.

4.All pesticides, fertilizer, and other potentially hazardous chemicals must be
stored and handled in a safe manner in accordance with product labeling and in
a manner that minimizes the release of hazardous air pollutants (HAP's) and
volatile organic compounds (VOC's).

The subject property is located within the moderate impact area on the City of
Greeley's Areas of Ecological Significance Map. Special attention should be
given to address the impact of the development on the wildlife and vegetation of
the area. Any development within the City would need to satisfy the requirements
within chapter §18.48 Areas of Ecological Significance of the Greeley
Development Code.
The subject site is located within the City of Greeley's Long Range Expected
Growth Area (LREGA). Any development should comply with applicable policies
from the City's Building and Development Codes and Comprehensive Plan
Policies. The LREGA is the area within which the community is expected to grow
over the next 20 years and which encompasses all other growth and service
areas for the City of Greeley.
There is a 4" City of Greeley water line located along "F" Street 45' north of the
property, as well as a 6" City of Greeley water line located within "C" Street 25' to
the North-East of the property. The property currently has City of Greeley water
service.
If this use were proposed within the City of Greeley it would be required to locate
within a Commercial High Intensity (C -H), Industrial Low Intensity (I -L), or
Industrial Medium Intensity (I -M) Zone.
The adjacent property to the west was recently annexed into the City of Greeley
and was zoned Industrial Medium Intensity (I -M).

water taps will be denied. The City's policy is stated in "Guiding Principles for

GUIDING PRINCIPLES FOR OUTSIDE SERVICES
WHEREAS, development in the region of Greeley's water and/or sewage collection
system has generated and will continue to generate request for outside -the -City service; and
WHEREAS, the Greeley City Council and the Water and Sewer Board desire to
establish guiding principles for considering outside service requests; and
WHEREAS, such principles should be consistent with land use policies of the City and
County; and
WHEREAS, such principles should assure that the interests of Greeley citizens who are
the owners of the water and sewer systems, are protected and enhanced.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL AND THE
WATER AND SEWER BOARD OF THE CITY OF GREELEY, COLORADO:
1- Service agreements with other municipalities are wholesale agreements while
dgreements with individual property owners are retail. Neither type of agreement shall degrade
service for City customers or system reliability.
2. Properties requesting retail water or sewer service which are outside but adjacent to
Greeley city limits must be willing to annex prior to receiving services.
3. Properties requesting retail water or sewer service which are outside, not adjacent to
Greeley city limits, but within the city -established growth area (defined by the comprehensive
plan) must execute an agreement to annex when annexation becomes legally permissible and the
City so requests.
4. All outside retail water or sewer service agreements shall require the customer to
submit to the City all development plans for review and approval for conformance with
Greeley's development code, subdivision regulations. and comprehensive plan policies as
amended from time to time.
5. Outside wholesale customers, such as Evans and GJindsor, shall not diminish
Greeley's water rights to inside customers. No risk nor dependency upon Greeley's water rights
shall be created by an outside wholesale service agreement. Both retail and wholesale customers
shall provide adequate raw water in accordance with City policy.
6. Outside customers shall not vest in City of Greeley facilities or water rights.
7. Payments for outside service shall be in accordance with rates using cost of service
models and which present a financial benefit to Greeley citizens.
8. All outside entities must agree to follow water and sewer policies and standards
regarding line extensions, flow measurement, water usage, backflow prevention, industrial
wastewater pretreatment, and other requirements, as applicable.
9. Exceptions to this policy may be made by the City Council after receiving a
recommendation from the Water and Sewer Board and the City Manager.
10. All water or sewer line extensions or connections outside the City of Greeley shall be
in accordance with policies of the appropriate municipal and county jurisdiction and explicitly
approved by such jurisdiction(s).

Subject: USR-1651 Referral
Upon review of my case files and computer, an active Violation (VI -0400132) was noted. This violation
was issued due to commercial activity taking place on the property without having submitted a Use by
Special Review permit.
This case was presented to the Board of County Commissioners through the Violation Hearing process on
August 9, 2006 to apply for a change of zone so that he would be allowed to submit a USR for the
business after that was completed. It was referred to the County Attorney's office. Legal action was
delayed for 90 days to allow adequate time for them to submit their USR application. However, a USR
was never submitted and the case was heard in District court on January 4, 2008. The case was then
dismissed when the USR was submitted on January 8, 2008.
This application, if approved, will correct the violation. If for any reason, this application is denied, the
Violation Case will proceed accordingly through district court.

1. Building permits shall be obtained prior to the construction of any new building. Buildings may require an
engineered foundation based on a site -specific geotechnical report or an open hole inspection performed by
a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered
engineer.
2. The 2 existing pole frame buildings are currently permitted as private storage buildings and will require a
change of use permit for the new use. The office area in the existing residence will require a building permit
and will need to comply with chapter 34 of the International Building Code as well as have an accessible
entrance.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit
application.
4. Fire resistance of walls and openings, construction requirements, maximum building height and allowable
areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning
Ordinance.
5. Provide letter of approval from Union Colony Protection District prior to applying for permits.

We have reviewed the above referenced proposal for a Site Specific Development Plan and
Special Use Permit for a Lawn and Tree Care Business on a 2.38 acre parcel. Since the submitted
material does not appear to qualify as a "subdivision" as defined in Section § 30-28-101(10)(a), C.R.S.,
pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office
will only perform a cursory review of the referral information and provide comments. The comments will
not address the adequacy of the water supply plan for this development or the ability of the water supply
plan to satisfy any County regulations or requirements.
water for the house and buildings is supplied by the City of Greeley. The irrigation water for 5,500
square feet of established lawn and several trees is supplied by a well, permit no. 34280-A. Permit no.
34280-A was issued on April 4, 1989 pursuant to C.R.S. §37-92-602(3)(c), as a replacement of a well
constructed in 1968. The permitted use of the well is limited to the irrigation of not more than one acre
of home lawn and gardens. The replacement well was constructed on September 7, 1989 to a depth of
40 feet, and the sustained yield in 1989 was reported as 35 gallons per minute. Since the applicants
have maintained a single family residence on the property, and as long as the well is not used to supply
the commercial business, this office does not have an objection to the continued use of the well to
irrigate the home lawn and gardens, as long as the conditions of approval for the permit are not
exceeded.
