Size of Parcel: 38 +/- acres Parcel Number: 1467 25 200061 THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: 1. The submitted materials are in compliance with the application requirements of Section 23-2-370 of the Weld County Code. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 23-2-400 of the Weld County Code as follows: A. Section 23-2-400.A. -- Reasonable efforts have been made to avoid irrigated crop land or to minimize the impacts on such lands in those cases where avoidance is impractical. The proposed Use by Special Review will be located on that part of the property considered "Other" according to the U.S.D.A. Soil Conservation Map, dated 1979. Irrigated crops are not currently being grown on the parcel and the site already has an existing substation on site (USR-1392) and a turkey farm (USR-117) that is not in operation. B. Section 23-2-400.B. -- The facility will not have an undue adverse effect on existing and future development of the surrounding area as set forth in applicable Master Plans. The site is located within the three mile referral areas of the Cities of Dacono and Northglenn, the Town of Erie, Adams County and the City and County of Broomfield. No comments were received from the City of Northglenn. The Town of Erie and the City of Dacono responded to the referral, dated May 20, 2009 and May 27, 2009 respectively, stating that they find no conflicts with their interests. The City and County of Broomfield stated in the referral dated June 18, 2009 that the area is designated in their comprehensive plan as an USR-1702 Tri-State Page 3 PRELIMINARY "employment" area with an open space corridor surrounding the Big Dry Creek and Bull Canal. Office, research and development, light industrial, warehousing and some limited commercial uses should be targeted for the area. Broomfield desires to review a full copy of the environmental report to determine if the expansion is compatible with the plans for the area. The City and County of Broomfield also requests that additional information about the construction routes of the vehicles and the responsibility to repair roads damaged during the construction process be submitted for review. Broomfield also requests that the planting of appropriate trees along County Road 6 and the canal be incorporated into the plan. As a Condition of Approval the applicant will need to address the concerns of the City and County of Broomfield. The City and County of Broomfield is located approximately 500' to the west of the site. C. Section 23-2-400.C. -- The design of the proposed facility mitigates negative impacts on the surrounding area to the greatest extent feasible. The facility is located in a remote area. There are three property owners within 500' of the subject property. No comments were received from any surrounding property owners. The facility is unmanned. The surrounding property is zoned agricultural with a variety of Use by Special Reviews (USR) in the area. The facility is serviced by USR-1392 for a 115 -kV transmission line and the substation is delineated on the plat for USR-1392. The property to the north consists of a construction equipment storage area (USR-1445). The property to the south consists of a salvage yard (USR-1351) and gravel mining (USR-1341). The property to the east consists of a RV and boat storage facility (USR-1607). Currently USR-117 for a 3000 head turkey farm and NCU-75 for a mobile home which has been demolished are on record. As a Condition of Approval USR-117 and NCU-75 will need to be vacated/withdrawn. D. Section 23-2-400.D. -- The site shall be maintained in such a manner so as to control soil erosion, dust, and the growth of noxious weeds. The Conditions of Approval and Development Standards will ensure that there is no fugitive dust or erosion and will ensure the control of noxious weeds. E. Section 23-2-400.E. -- The applicant has agreed to implement any reasonable measures deemed necessary by the Planning Commission to ensure that the health, safety, and welfare of the inhabitants of Weld County will be protected and to mitigate or minimize any potential adverse impacts from the proposed facility. F. Section 23-2-400.F. - The proposed facility will be supplied by an adequate water supply which has been evaluated with reference to the impacts of the use of such supply on agricultural Uses. All reasonable steps have been taken by the applicant to minimize negative impacts on agricultural uses and lands. The site is proposed to be unmanned. Therefore no permanent water or sewer is required. Portable toilets and hand washing units are to be utilized during construction of the tower. Bottled water shall be used during construction for drinking. G. Section 23-2-400.G. -- All reasonable alternatives to the proposal have been adequately assessed and the proposed action is consistent with the best interests of the people of Weld County and represents a balanced use of resources in the affected area. The applicant is proposing to upgrade the existing 115 -kV switchyard by adding a 230 -kV switchyard to improve electric service to consumers. The communication tower provides metering, system protection, and supervisory control and data acquisition controls between the control center and various substation facilities. H. Section 23-2-400.H. -- It has been determined that the nature and location or expansion of a proposed power plant facility will not create an expansion of the USR-1702 Tri-State Page 4 PRELIMINARY demand for government services beyond the reasonable capacity of an impacted community or the county to provide such services. Where it is indicated that such an expansion of the demand for services will occur beyond the reasonable capacity to provide such services, the applicant must clearly show how such impacts will be mitigated prior to approval of the proposal by the county. This applies only in land use cases regarding power plants. I. Section 23-2-400.1. -- It has been determined that the nature and location or expansion of the facility will meet Colorado Department of Health and County air quality standards. No comments were received from the State of Colorado Department of Health. The Conditions of Approval and Development Standards will ensure that the nature and location of the facility will meet the Weld County Department of Public Health and Environment air quality standards including all State and Federal regulations. J. Section 23-2-400.J. -- Adequate electric, gas, telephone, water, sewage and other utilities exist or can be developed to service the site. The site is an unmanned facility that will require on -site visits from staff approximately once a month. Portable toilets and hand washing units are to be utilized during construction of the tower. Bottled water shall be used during construction for drinking. K. Section 23-2-400.K. -- The nature and location or expansion of the facility will not unreasonably interfere with any significant wildlife habitat and will not unreasonably affect any endangered wildlife species, unique natural resource, historic landmark or archaeological sites within the affected area. The Colorado Division of Wildlife referral dated May 26, 2009 stated that they have reviewed the request and find no conflicts with their interests. L. Section 23-2-400.L. — The application indicates that storm water drainage will be handled per environmental standards and according to the project storm water prevention plan. Conditions of Approval and Development Standards will ensure that historic runoff flows will be maintained. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. The applicant agrees to implement any reasonable measures deemed necessary by the Planning Commission to ensure that the health, safety, and welfare of the inhabitants of Weld County will be protected and to mitigate or minimize any potential adverse impacts from the proposed facility. 2. Prior to recording the plat: A. The applicant shall submit an Improvements Agreement. The applicant shall submit to the Department of Planning Services an itemized exhibit A and exhibit B for review. The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the Use by Special Review plat. Alternatively, applicant may submit evidence that all the work has been completed and approved by the Department of Planning Services and the Department of Public Works. The applicant shall address the requirements of the Weld County Department of Public Works as stated in the referrals received June 3, 2009 and June 8, 2009. Written evidence of such shall be provided to the Department of Planning Services. (Department of Planning Services) C. The applicant shall attempt to address the requirements of the City and County of Broomfield as stated in the referral received June 18, 2009. Written evidence of such shall be provided to the Department of Planning Services. (Department of Planning Services) D. The applicant shall address the requirements of the Weld County Department of Building inspection as stated in the referral received June 9, 2009. Written evidence of such shall be provided to the Department of Planning Services. (Department of Planning Services) E. Two paper copies of a Corrected Recorded Exemption (RE -4852) shall be submitted to the Department of Planning Services making Lot B one lot (not separated by the ditch) for review and approval. Once approved a mylar shall be submitted for recording with the appropriate fees. (Department of Planning Services) F. The applicant shall submit in writing the request to vacate USR-117 for a turkey farm to the Department of Planning Services. The property owner to the west shall also sign the request since USR-117 encompasses both parcels (Brookman). (Department of Planning Services) G. Upon completion of 1. and 2. above the applicant shall submit a Mylar plat along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 23-2- 260.D of the Weld County Code. The Mylar plat and additional requirements shall be submitted within thirty (30) days from the date of the Planning Commissioners resolution. The applicant shall be responsible for paying the recording fee. (Department of Planning Services) 4. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat not be recorded within the required sixty (60) days from the date the application was approved a $50.00 recording continuance charge may be added for each additional 3 month period. 5. (Department of Planning Services) USR-1702 Tri-State Page 7 PRELIMINARY SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS Tri-State Generation and Transmission USR-1702 1. The Site Specific Development Plan and a Special Review Permit for a Major Facility of a Public Utility or Public Agencies (expansion of an existing substation and 185' communication tower) in the Agricultural Zone Districts and subject to the Development Standards stated hereon. (Department of Planning Services) 2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld County Code. (Department of Planning Services) 3. The communications tower shall not exceed 185 feet in height. (Department of Planning Services) 4. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. (Department of Public Works) 5. Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code. (Department of Public Works) 6. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. (Department of Public Health and Environment) 7. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. (Department of Public Health and Environment) 9. Fugitive dust and fugitive particulate emissions shall be controlled on this site. (Department of Public Health and Environment) 10. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code., as amended. (Department of Public Health and Environment) 11. Adequate toilet facilities (portable toilets) and hand washing units shall be provided during construction of the facility. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. (Department of Public Health and Environment) 15. Building permits will be required for all new structures prior to construction. (Building Department) 16. A building permit application must be completed and two complete sets of plans including engineered foundation plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review. A geotechnical engineering report prepared by a registered State of Colorado engineer shall be required. (Department of Building Inspection) 17. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. (Building Department) 18. Demolition permits are required for the removal of any structure on site. (Department of Planning Services) 19. A letter shall be provided from the Greater Brighton Fire Protection District as to permitting requirements of the fire district shall be provided prior to issuance of building permits. (Department of Building Inspection) 20. Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the Weld County Road Impact Program. Effective August 1, 2005, Building permits issued on the subject site will be required to adhere to the fee structure of the Capital Expansion Impact Fee and the Stormwater/Drainage Impact Fee. The USR was filed in support of a 1041 application for a transmission line originally submitted in April 2009. A building permit shall be obtained prior to the construction of communication tower. 2. A plan review is required for each building for which a building permit is required. Two complete sets of plans are required when applying for each permit. The Occupancy Classification will be determined by Chapter 3 of the 2006 International Building Code. Currently the following has been adopted by Weld County 2006 International Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006 International Fuel Gas Code; and the 2008 National Electrical Code and Chapter 29 of the Weld County Code. According to the Weld County Department of Planning Services Building Inspection Division information bulletin titled "When is a Building Permit Needed?", a building permit is not required for public utility towers and poles. 2. A plan review is required for each building for which a building permit is required. Two complete sets of plans are required when applying for each permit. The Occupancy Classification will be determined by Chapter 3 of the 2006 International Building Code. Two complete sets of building permits will be provided when applying for each permit as required by Weld County. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County 2006 International Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006 International Fuel Gas Code; and the 2008 National Electrical Code and Chapter 29 of the Weld County Code. Buildings shall conform to the codes adopted by Weld County as above. Public Works Department Comments (Donald Carroll, Engineering Administrator) The Weld County Public Works Department reviewed the submitted application for critical items, including but not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood Hazard Development Permit. A detailed review of these items was not complete at this step in process. Comments made during this stage of the review process will not be all inclusive, as revised materials are submitted other concerns or issues may arise. All issues of concern and critical issues during further review must be resolved with the Public Works Department. 1. Weld County Road Classification Plan (FHU): (June 2002) WCR 6 is a collector road and requires an 80 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. 2. WCR 11 is a major arterial road, which requires a 140 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right- of-way line. The 85th percentile for this location reflects 62 miles per hour with 17% truck traffic. 4. Access: The applicant shall utilize the existing access from WCR 6. 5. Off-street parking spaces including the access drive shall be surfaced with gravel, recycled asphalt, asphalt, concrete or the equivalent and shall be graded to prevent drainage problems. 6. Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation. 7. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All other vegetation, other than grasses, need to be maintained at a maximum height of 12 inches until the area is completely developed. 8. Traffic Study: A traffic study will not be required. The applicant is indicating that there will be no people using this site other than routine maintenance and monitoring of the transmission line on a monthly basis. Monitoring of the substation and communication facility would take place approximately once per day and would be limited to two people. During the construction, the crews would consist of 4-20 people and would take approximately 6-8 months to complete. 9. Tri State will also coordinate with Weld County prior to construction to finalize transportation routes and assess design of roads to support the weight of vehicles to be used on this project. Tri State will provide tables of the construction equipment and weights from the USR application to the City and County of Broomfield. 3. The Broomfield Comprehensive Plan shows anticipated future regional trails along the Big Dry Creek and the Bull Canal. The proposal is for the construction of a substation and associated structures. As noted in your cover letter the site is located in the Boulder - Weld coalfield. The application consisted of two geotechnical/geologic hazard reports by CTL Thompson, a cover letter, and a location map. Comments concerning the proposal are listed below. Subsidence Though the site is located in a coalfield, it does not appear to have any subsidence hazards. Available mining and hazards maps did not reveal any appreciable risks. Expansive Soil and Bedrock As noted by the applicant's reports, the site is underlain by highly expansive soil and bedrock. The initial report recommends the use of deep pier foundations but leaves open the possibility of using shallow foundations. The latest report, dated February 18, 2009, removes the option of shallow foundations. The recommendations outlined in the February 2009 report are prudent and should be followed. Corrosive Soil "Risk of corrosion" pertains to potential soil -induced electrochemical or chemical action that corrodes or weakens concrete and uncoated steel. Special site examination and design may be needed if the combination of factors results in a severe hazard of corrosion. The site appears to contain such hazards. The first report recommends that special site examination and design be done. To some extent, this was done and special design considerations are outlined in the latest report. Erosion and Sediment Control As noted in geotechnical reports, the site is underlain by soil and bedrock with a very high percentage of clay and/or silt. When small soil particles become suspended in runoff, they cannot effectively be removed using sediment control practices like silt fence or detention ponds (without secondary treatment). Preventing detachment through erosion control will be less expensive and more effective than sediment control. Erosion and sediment control plans were not included with the application. If sedimentation is a concern, the county may want to require that all disturbed areas be revegetated as soon as possible and that bare soil be protected from erosion during all phases of construction. Summary There do not appear to be any geologic -related hazards that would preclude development of the site. The constraints listed above can be adequately mitigated if recommendations are followed. Background Information: The applicants are proposing to expand the Erie substation to accommodate future growth and to add one secured communications tower to a facility that currently exists and was historically permitted as a SE. The property currently has a legal description of Lot B of RE -4852. This site is known as the Brookman property. Two lines serve this facility a 230kV WAPA Line and a 115 kV TSG line. Additionally a 184 foot tall lattice mono microwave tower is slated to be constructed somewhere on the property. The current configuration is not safe as the fall zone would cross the internal road, one OH line and a second electric line. Alternative sites were strongly suggested. Health Department Discussion of water and sanitary sewer needs for the facility during construction — bottled water and port -a -lets. This is an unmanned facility.. Public Works Comments are attached via hand written notes. Planning Department The facility is fenced and gated to provide security. Staff encouraged the applicants to design the gates keeping in mind snow removal. The facility will be operated 352 days 24/7. The Henry Lake Tap requires a 1041 application for an expansion of the existing substation located within the corporate limits of Lochbuie. The short 1.5 mile transmission line will connect with the new dual 230kV WAPA Transmission line. Issues are present with the current land owner who refuses to grant an easement, stating that Tri-State will have to condemn the land in order to gain access. Staff explained the USR process - that the applicant shall submit 4 packets for a 7 day completeness review. Once the 7 day completeness review is complete the applicant will be informed of what items are still required to make the application complete. After the completed application is submitted it will be sent out for referral for 28 days.
