SUBJECT: USR-1697, Wade & Shannon Lutz
The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
WCR 23 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
WCR 112 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 30 -
foot right-of-way north of the section line. This road is maintained by Weld County. Pursuant to the definition
of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-
way line.
Ohe County has no current traffic counts near this location for either roadway.
REQUIREMENTS:
The existing access off CR-23 shall be utilized; no new accesses are being proposed. This facility will add
about 1 -vehicle trips per day or 20 per month.
The applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it is
dedicated, private, or deeded to provide adequate access to the parcel.
A water quality feature was shown along with adequate calculations please show the drainage easements on
the final plat.
Please describe what type of surface treatment material the existing driveway and parking area have.
The right-of-way or easement into the site shall be a graded and drained road to provide an all-weather
access.
Stop blocks will be required to be installed for all employee and visitor parking where a constructed element is
not present to help prevent vehicles from rolling after being parked.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

SUBJECT: USR-1697 Wade and Shannon Lutz
DATE: April 10, 2009
Environmental Health Services has reviewed this proposal for a dog kennel to include
boarding for up to 40 dogs. The applicants are proposing a vault to contain waste water
from the kennel, a portable toilet and hand washing unit for visitors and water will be
hauled in from the Town of Wellington and stored in a cistern for use in the kennel.
Although the facility will not have any employees, there will be prospective dog owners
who come to the site and they must have access to restroom and hand washing
facilities.
It is the policy of this department to require a permanent water source, such as a
commercially permitted well for potable water. The use of a cistern for a drinking
(potable) water source for humans is prohibited unless the occupants obtain a Cistern
Usage Permit (CUP). It appears from the application that the cistern would not be used
for potable water. in which case a CUP would not be required. The applicants would
either have to re -permit their well to allow for kennel visitors or bring in bottled water for
drinking, if deemed adequate by the Board.
A vault, for sewage, is allowed if there is a temporary water source or if the use is
temporary such as, gravel mining operations, mobile offices and seasonal recreational
facilities. Otherwise an individual sewage disposal system is required. The applicants
would be required to have their existing septic system evaluated by an engineer for
kennel usage or the Board can determine if the vault is adequate for kennel usage. A
vault permit would be required and the tank must adhere to the requirements of Section
30-5-50.B of the Weld County Individual Sewage Disposal Regulations.
Portable toilets are only allowed for temporary or seasonal uses that are 6 months or
less in duration. If the well is re -permitted to allow for kennel usage, including restroom
facilities for visitors, the restroom in the residence could be utilized as long as the septic
size was adequate. If the Board determines that a portable toilet and hand washing unit
is adequate the well would not have to be re -permitted.

The waste handling plan should indicate that waste is cleaned from the kennel on a
daily basis and picked up weekly by a sanitation company. This information shall be
included in the waste handling plan.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
The following requirements are recommended to be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan (on site dust) for review and
approval. to the Environmental Health Services, Weld County Department of
Public Health & Environment (WCPHE).
2. A copy of the current Pet Animal Care Facilities Act license shall be provided to
WCDPHE.
3. The applicant shall submit a waste handiing plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
4. In the event the applicant intends to utilize the existing septic system at the
existing home for visitor and kennel sanitation needs, the septic system shall be
reviewed by a Colorado Registered Professional Engineer. The review shall
consist of observation of the system and a technical review describing the
systems ability to handle the proposed hydraulic load from the resident's
occupants and visitors. The review shah be submitted to the Environmental
Health Services Division of the Weld County Department of Public Health and
Environment. In the event the system is found to be inadequately sized or
constructed the system snail be brought into compliance with current
Regulations.
5. A copy of the r& per mitted well permit, tc allow for kennel usage, shall be
provided to the Environmental Flea to Services Division of the Weld County
Department of Public Health & Environment.

We recommend that the following requirements be incorporated into the permit as
development standards:
1 Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, odors, disease hazards, and nuisances
are minimized. Such wastes shall be removed at least weekly from the facility
and disposed by a commercial hauler.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
4. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
5. The applicant shall operate in accordance with the approved "waste handling
plan", at ail times.
6. The applicant shall comply with the Colorado Department of Agriculture (CDA),
Division of Animal Industry.
7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility' shall be operated in accordance vrth the approved "dust abatement
plan", at ail times.
8. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code..
9. Adequate t,andwashir.g and toilet faciliriees shall be provided for visitors to the
facility.
10. Sewage disposal for the facility shall be by septic system. Any septic system
located or the property n,L;st comply with all provisions of the Weld County Code,
pertainingto Individual Sewage Disposal Systems.
11.The facility shall utilize the existing private water supply. (Well Permit

12. If applicable. the applicant shall obtain a stormwater discharge permit for
development, redevelopment or construction where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
13.The operation shall comply with al! applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Upon review of my case files and computer, an active Violation (ZCV08-00404) was noted. This violation
was issued due to commercial activity in relation to a kennel for up to 40 dogs in the A (Agricultural) Zone
District without having submitted a Use by Special Review permit.
This case has was initially scheduled to be heard in front of the Board of County Commissioners through a
violation hearing on March 10, 2009 but has been removed from the docket as a USR application has
been completed and submitted to the Department of Planning Services.
This application, if approved, will correct the violation. If for any reason, this application is denied, the
Violation Case will proceed accordingly through a violation hearing and possibly district court.
