Garcia, Chair Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway Commissioner Barbara Kirkmeyer Commissioner David E. Long Also present: Acting Clerk to the Board, Elizabeth Strong County Attorney, Bruce Barker Public Works representative, Mike Bedell The following business was transacted: I hereby certify that pursuant to a notice dated April 9, 2009, and duly published April 17, 2009, in the Greeley Tribune, a public hearing was conducted to obtain public input regarding the adoption of the County Road 49 / Imboden Road Alignment Study, which was drafted by Felsburg, Holt and Ullevig, on behalf of the Weld County Department of Public Works and Adams County, dated April 2009. Mike Bedell, Department of Public Works, stated the study is a partnership between Weld and Adams County; approximately half of the study area is in each County. Mr. Bedell stated an engineering consultant from Felsburg, Holt, and Ullevig was hired to complete the study. He explained the study is a planning effort and the intent is to conduct enough conceptual design to assess alignment alternatives in the area, for the sake of preserving right-of-way. He stated there is no public funding at this time to construct the roadway and the necessary funds may not come to fruition for many years. Mr. Bedell stated the study was initiated after a developer proposed a large development to be located west of Horse Creek Reservoir, in both Weld and Adams Counties, and staff began to consider how people will travel through the corridor in the future. He stated the purposes of the project are to establish a preferred north -south alignment to provide a smooth transition from County Road 49 to Adams County, to improve north -south connectivity, to connect two existing primary corridors that serve surrounding communities, prevent potential impacts of segmented development, to serve as a guide to County agencies to preserve right-of- way for future improvements to be constructed as needed, and to improve connectivity between jurisdictions so that future traffic demands can be accommodated. He stated there is presently no connectivity between the roads west of Horse Creek Reservoir; there is only a huge field, and travelers on County Road 49 have to jog around the area to continue heading south. Mr. Bedell stated County Road 49/ Imboden Road is the obvious choice for a north -south future arterial road, and it will travel to Highway 34, to Denver International Airport (DIA), and eventually down to 1-70. In response to Chair Garcia, Mr. Bedell stated there is no road connecting the area at this time, and the area on the map that Chair Garcia inquired about is the Box Elder Creek drainage area. Mr. Bedell stated the process began approximately ten months ago with data collection, followed by identifying, analyzing, evaluating, and scoring the alternatives, and then the consultant prepared 2009-0989 EG0060 HEARING CERTIFICATION - CR 49 / IMBODEN ROAD ALIGNMENT STUDY PAGE 2 the drafts and final reports. He stated there have been several meetings between Weld and Adams Counties, adjacent property owners, and the developer who owns the majority of the land. In response to Commissioner Kirkmeyer, Mr. Bedell stated the area the developer owns is the property beginning at 160th Avenue to County Road 4; however, he does not have a map in his presentation which depicts it. Upon Commissioner Kirkmeyer's request, Mr. Bedell provided a map from his records, which was not included in the presentation and is marked Exhibit A. Mr. Bedell stated the development is a conceptual design at this point and the intention is to cater to people into equestrian and horse programs and will contain large lots. He stated County staff discussed the scope of work and then entered into a contract with Felsburg, Holt, and Ullevig, at which time the data was collected by the consultant and the alternatives were identified and evaluated, public meetings were conducted, and ultimately the recommended alignment was selected as a result of the process. He stated the design parameters were agreed upon by Adams and Weld Counties regarding the arterial roadway and a spreadsheet was provided to the consultant to guide them while assessing the four alignment alternatives. Mr. Bedell stated all of the alternatives begin at County Roads 49 and 4 and end at Imboden Road and East 152nd Avenue, and there are pros and cons for each alternative. He stated the evaluation criteria used included Community Input, Community Impacts, Geometrics/Safety, Environmental Impacts, and Construction Costs, and each member of the study team individually compiled scores for the valuation matrix results and later compared the results. He stated the study steam consisted of himself; Janet Carter, Department of Public Works; Jeanne Shreve, Adams County Transportation Planner; Stacy Dickson, Adams County Transportation Planner; Russell Nelson, Adams County Engineer; and Jeff Dankenbring, Felsburg, Holt, and Ullevig. He stated four of the six members rated Alternative #1 the highest, and two of the members rated Alternative #4 the highest. Mr. Bedell stated Adams County staff had a meeting with the developer and presented the two highest ranking alternatives and the developer indicated their preference is Alternative #1. He stated Alternative #1 is the route which travels the closest to Horse Creek Reservoir; however, it maintains an adequate separation from the Reservoir due to concerns regarding wildlife and environmental impacts. He stated Alternative #1 begins at the intersection of County Roads 49 and 4 and then crosses the Box Elder Creek, at which point, a bridge will be need to be constructed, then the route travels south and a second smaller bridge will be necessary to cross the canal, the route continues to head south through the proposed development area, and then the route ends at Imboden Road in Adams County. Mr. Bedell explained the location at which Alternative #1 crosses Box Elder Creek was selected because it is the narrowest part of the flood plain in the area and will require the smallest bridge structure. He stated the study process took approximately ten months and it was intended to be completed in six months. He stated two open houses were conducted and over 100 people attended each of them, fliers were mailed to all of the adjacent property owners, details of the study were made available on the Public Works website, and the next step, after this hearing, is for the Board to consider adoption of the study and this typically occurs approximately two weeks following the public input hearing. Mr. Bedell stated Adams County is going through the same process and, although it is following the same path as Weld County, it is approximately one month behind and has a public input hearing scheduled for June 1, 2009. He stated Weld County will continue to coordinate with other agencies as the process continues and staff will have the study at their fingertips to guide them. In response to Commissioner Kirkmeyer, Mr. Bedell stated the County does not currently own any right-of-way south of County Road 4, on County Road 49. In response to Commissioner Kirkmeyer, Ms. Carter stated the developers indicate when there are areas they would eventually like to develop in certain ways, which is what has occurred with this 2009-0989 EG0060 HEARING CERTIFICATION - CR 49 / IMBODEN ROAD ALIGNMENT STUDY PAGE 3 developer; however, the developer has not submitted anything beyond conceptual sketches at this time; therefore, no formal plans have been submitted to the Adams or Weld County Planning Departments. Further responding to Commissioner Kirkmeyer, Ms. Carter stated the proposed development plans prompted the study; however, the developer did not contribute to financing the study. Commissioner Rademacher inquired as to how Alternative #1 is the most cost effective since it travels through the most environmentally sensitive areas and requires the construction of two bridges. Mr. Bedell stated the costs were not broken down; however, it is likely the least expensive because it is the shortest road. Ms. Carter stated all of the four proposed alignments will have approximately the same amount of environmental impacts; however, the environmental impacts will be considered in more detail, and further examination will occur, when the Counties are in the actual design process. In response to Commissioner Rademacher, Ms. Carter stated all four of the proposed routes will cross the Box Elder Creek. Chair Garcia inquired as to how the cost evaluation was figured. Ms. Carter stated one of the main things considered in evaluating the expense of constructing the routes was crossing the Box Elder Creek; different routes crossed it at different angles, the overall length of the proposed routes was a major consideration, and whether or not the purchase of right-of-way will be necessary for the routes was a factor considered in determining the cost. She stated the green and orange alignments, which are Alternatives #1 and #4, are the two shortest routes, and the pink and blue alignments, which are Alternatives #2 and #3, are very close to a wetlands area, are longer routes, and will require being constructed at an angle to cross the Box Elder Creek. Commissioner Kirkmeyer inquired as to why it is important to have County Road 49 connect to Imboden Road, since such a roadway has not been necessary up to this point and Highway 52 is used currently. Mr. Bedell stated as Highway 85 becomes more congested, the new road will provide an alternative and direct route south to DIA or 1-70 for people traveling from the City of Greeley area; whereas, presently people have to travel on County Road 49 and 1-26 and cannot travel straight south. Commissioner Kirkmeyer stated people currently can travel County Road 49, to 1-76, and then connect with the E-470 Parkway, which is a fairly direct route. Ms. Carter stated it is important to have the connection because the area is an economically developing area and it will create a connection for our communities to travel to DIA and it can act as a parallel arterial to existing roads. She stated the road will provide another connection from Weld to Adams County; however, it will not act as a highway for many years. She further stated since the subdivision has been proposed, staff wants to plan for the future to avoid potential problems. Jonathan Ziegler, surrounding property owner, stated the recommended alignment will greatly impact his family, and there were not 100 people in attendance at any of the meetings because many people did not receive the notification. Mr. Ziegler stated he attended a meeting last week with Adams County, and he does not feel the community's opinion matters regarding the road. He stated he built his house in 2006 along Imboden Road and he would not have bought property, or built there if he had known the proposed road would be constructed there. He stated there are four eagles on the west side of the lake, and other wildlife and wetlands in the area will be affected by the proposed road. He stated the proposed road will ultimately be seven lanes wide and there are several communities in the area in which people purchased homes there to be distanced from highways and noise. He stated the developer is putting in 2.5 acre lots and all of the current surrounding residents use wells; therefore, the resources are not available to support 2.5 acre lots. Mr. Ziegler stated the cost estimated for the orange, pink, and green routes is totally wrong because Adams County has a new building which does not honor the 200 -foot buffer zone on Imboden Road; therefore, another roadway will need to be constructed. He stated the proposed 2009-0989 EG0060 HEARING CERTIFICATION - CR 49 / IMBODEN ROAD ALIGNMENT STUDY PAGE 4 roadway will affect the surrounding residents and lifestyles and nobody in the community wants the roadway. He stated the Kiowa-Bennett Road has been in existence for a long time and the trucks can continue to use it. Mr. Ziegler stated the bridges and roadway will create pollution in places where people are trying to preserve nature and the road is not needed. In response to Commissioner Conway, Mr. Ziegler stated he is opposed to all four alternatives; however, expanding Watkins Road may be an acceptable alternative because it is not close to the lake, and the subdivision can utilize County Road 2, which was recently paved. Mr. Ziegler stated if there is a concern about a population density problem, then the developer should create larger lots. Further responding to Commissioner Conway, Mr. Ziegler clarified his main concerns regarding Alternative #1 are its impact on the surrounding wildlife, and the property owners along the road. Pamela Edens, surrounding property owner, stated she owns 43 acres, which is used for agriculture, and her residence sits approximately 100 feet from the road. Ms. Edens stated she calls and complains to the Weld County Department of Public Works a minimum of once a month about the dust because she has a lung disease which is worsened by dust, seven lanes of traffic will worsen her lung condition, and she moved there 16 years ago to escape pollution along the Platte River. She stated she is also concerned about how she will move her livestock when the road is constructed, and her family is not the only one which will be impacted in this way. She indicated she hopes the Board will vote to reject the study and protect the lifestyle of the area residents. She stated the notice for this hearing is the first she received by mail. In response to Commissioner Conway, she stated she was not invited to the previous public meetings; however, she attended because a neighbor called to notify her. She stated the proposed road is not necessary, 1-76 is available for traveling to the airport and Adams County, and existing roadways should be widened if needed. Roman Kolemba, surrounding property owner, stated he is representing the wildlife, and he has been studying eagles at Horse Creek for ten years. Mr. Kolemba stated it is a unique area because there are two eagles nesting along the lake and there are burrowing owls and other wildlife to the north of the lake. He indicated he has documentation from the Colorado Bird Observatory stating how long the nests have produced in the area. He stated the Endangered Species Act has removed eagles from the list; however, it is possible the eagles will be added back to the list at a later time, in which case, the route will need to be redetermined because when on the list, roads cannot be within 600 feet of the eagles. Mr. Kolemba stated the road will affect the entire habitat, not only the eagles. Cecil Neil, surrounding property owner, stated he does not want to see the road be approved, and he does not want to see rezoning occur across the street from him. Chair Garcia stated he is unaware of the zoning matter he is referring to and testimony is being accepted only regarding the road study at this time. Mr. Neil reiterated he does not want an additional road in the area and expressed he enjoys watching the eagles and deer that are presently in the area. He stated there is not enough traffic to warrant an additional road and the developer needs to consider other options. Mr. Bedell stated the Division of Wildlife was involved in the study and it is the source the Department consults in situations like these. In response to Commissioner Kirkmeyer, Ms. Carter stated the functional classification of County 2009-0989 EG0060 HEARING CERTIFICATION - CR 49 / IMBODEN ROAD ALIGNMENT STUDY PAGE 5 Road 49, between Highway 52 and the County Line, is arterial, and 140 feet of right-of-way preservation from the center line is in place, regardless of the road study. Further responding to Commissioner Kirkmeyer, Ms. Carter stated this portion of County Road 49 is considered strategic roadway. Wayne Howard, Department of Public Works, stated County Road 49 is a strategic road and in 2003 it was adopted as such; however, it was not determined how it would connect with Adams County's arterial roadway; therefore, the study has been needed since 2003, even though the potential development prompted it recently. Mr. Howard stated the adjustment needs to be determined now, otherwise, there may be no way of combining an Adams County and a Weld County road in the future. He reiterated County Road 49 is a strategic road and the right-of-way has been preserved along the road since 2003. In response to Commissioner Conway, Mr. Bedell stated Watkins Road was considered, as Mr. Ziegler suggested earlier; however, Adams County had an issue with it. Mr. Howard explained Adams County has a Transportation Plan, which identifies Imboden Road as being the major arterial, and to change that, it would have to amend the Transportation Plan, and Adams County has been preserving the Imboden Road arterial for quite some time. He stated if the study is adopted by both agencies the Adams County Transportation Plan will be amended to show the connection of Imboden Road to County Road 49. He further stated Watkins Road is not able to make the same connections further south and to 1-70. Commissioner Kirkmeyer inquired, if the study is accepted, what amount of right-of-way preservation will be required on County Road 49. Mr. Howard clarified140 feet is required, unless the Board requests less; however, the Department of Planning Services will request 70 feet on each side of the road. Further responding to Commissioner Kirkmeyer, Mr. Howard stated the distance of 140 feet is consistent with the study and the functional classification requirements. Commissioner Rademacher inquired as to why Alternative #1 was selected rather than Alternative #4, since the cost for each of them was so similar. Mr. Howard stated it was a close call; however, Alternative #1 was selected by the developer, who is the person who will be most affected by the road choice. Commissioner Kirkmeyer stated the hearing today is to accept public input; however, she inquired as to why it is important the Board accept the study, since staff can still use the study towards planning efforts. Mr. Howard stated without adoption of the study, there is nothing in place to allow the protection of the necessary rights -of -way. He stated perhaps when the development progresses there may be a mechanism in place to reserve right-of-way; however, there is the possibility the development may not move forward considering the current economy. Commissioner Kirkmeyer inquired as to if the Department of Planning Services will still have the opportunity to utilize the study findings, even if the study is not adopted by the Board. Mr. Howard stated there is one -mile of right-of-way preservation which will not be in place without the adoption of the study, and Mr. Barker will have to respond as to what abilities the planners have without the study being adopted; however, in the past, the studies have been undertaken with the assumption there would not be a way for the Board to protect the necessary right-of-way without adoption of a study and this is the sixth study conducted for this purpose. He stated since there is no Transportation Plan illustrating the alignments; the Planners refer to the Alignment Studies. Mr. Barker stated there was no study approved by the Board regarding County Road 5, and there were inconsistent recommendations given to preserve various alternatives; therefore, it was 2009-0989 EG0060 HEARING CERTIFICATION - CR 49 / IMBODEN ROAD ALIGNMENT STUDY PAGE 6 determined, as a result of the process, the Board ought to approve the study, in order to clearly identify the preferred alternative. He stated the Board may reserve right-of-way without approving the study; however, the study provides the justification for preservation of right-of-way. In response to Commissioner Kirkmeyer, Mr. Barker stated the study may be approved without approving a preferred alternative. Mr. Howard stated a risk of not identifying a preferred alternative route may be that all of the property owners may not agree on the placement of the road and if the road does not line up, it is a dysfunctional roadway. He stated the goal of the study is to maintain the area with the best alignment. Responding to Commissioner Kirkmeyer, Mr. Howard stated the developer does not own the property at this time; however, he has been given the right to market it, if he chooses to do so, and there are still many other people who will be impacted by the proposed roadway. Mr. Barker stated the practice of the Board has been to adopt the study approximately two weeks after the public hearing is conducted, which will be May 11, 2009, in this instance. Chair Garcia stated the Board will make a decision regarding the study on May 11, 2009, and the hearing today was solely for the purpose of public input. Ms. Carter stated the Adams County Planning Commission will consider the matter on May 14, 2009, and on June 1, 2009, the study will be presented for approval to the Adams County Board of Commissioners.
