RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 196 - TONVILLE
FARM COMPANY.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on February 23, 1976 , the Board of County Com-
missioners of Weld County, Colorado adopted a Resolution approv-
ing Recorded Exemption No. 196 in which said Board determined
that a certain parcel of land, being the property of Tonville
Farm Company, does not come within the purview of the definition
of the terms "subdivision" and "subdivided land" , pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973, as
amended, said parcel of land being more particularly described
as follows :
That part of the South one-half, Northwest one-quarter
of Section 19, Township 1 North, Range 65 West of
the 6th Principal Meridian, Weld County, Colorado,
described as: Beginning at the Southwest corner
said South one-half Northwest one-quarter; thence
N00°28'30" E on an assured bearing along the West
line said South one-half Northwest one-quarter a
distance of 203.00 feet to the true point of beginning;
thence continuing on said West line N00°28'30"E
a distance of 1122.41 feet to the Northwest corner
said South one-half Northwest one-quarter; thence
N89°57'00"E along the North line said South one-half
Northwest one-quarter a distance of 2658.05 feet
to the Northeast corner said South one-half Northwest
one-quarter; thence S00°37'17"W along the East line
said South one-half Northwest one-quarter a distance
of 1322.57 feet to the Southeast corner South one-half
Northwest one-quarter; thence 589°53'15"W along the
South line said South one-half Northwest one-quarter
a distance of 2004.70 feet to a point 650.00 feet

329.10 feet; thence S06°00'15"W a distance of 21.90

N89°58'30"W a distance of 232.00 feet to the true
point of beginning. The West 30.00 feet thereof
lies within County Road No. 37 R.O.W.

WHEREAS, the Board of County Commissioners has been informed
by the Weld County Department of Planning Services that Tonville
Farm Company has requested that the aforementioned Recorded Ex-
emption be amended by reducing the size of Parcel A, and
WHEREAS, the Department of Planning Services recommends
that said request to amend Recorded Exemption No. 196 be approved.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove amend-
ment to Recorded Exemption No. 196 for Tonville Farm Company
be, and hereby is , approved.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 27th day of
November, A.D. , 1978.

RE: Amendment to Recorded Exemption #196
Dear Commissioners:
The attached application, plat and related items are in reference to a
request to amend Recorded Exemption #196 from the Tonville Farm Company.
The property is described as Pt . SaNW4 Section 19, T1N, R65W of the 6th
P. M. , Weld County, Colorado. This property is located 1-1/2 miles
north of the Town of Lochbuie.
The request is to amend Recorded Exemption #196 by reducing the size of
parcel A. This will be accomplished by changing the present property
lines and excepting a portion of the original parcel A that was pre-
viously approved. The parcel being excepted was originally created in
1968. The history of this property is explained in detail in a letter
dated October 30, 1978, which has been submitted by the applicant . A
copy of this letter is included in the attached materials.
Based upon the information submitted, the Department of Planning Services
Staff recommends approval of this requested amendment for the following
reasons:
1. The impact on surrounding agricultural land uses would not appear to
be any different than the original request which has already been
approved.
2. The request will promote a better agricultural use of the property
through land leveling, improving existing wells and efficient
irrigation management practices.
3. The Lochbuie Planning Commission has set forth no objections to this
request .

County Subdivision Regulations.

The Tonville Farm Co. , a general partnership, see attached affidavit,
hereby does request a partial exemption from the recorded. exemption
No. 1473-19-2-RE 196, recorded February 26, 1976 in Book 760 Reception
No. 1682113 being the Sz of NW4 of Section 19 Township 1 North, Range
65 West of the 6th P.M. , County of Weld, State of Colorado.
The Tonville Farm Co. was formed for the purpose of owning farm land
which could be improved by leveling, improving existing wells, cement
ditches and/or by management to make a non-profit farm into a profitable
farm. In our conversation with the A.S.C.S. office situated in Brighton,
Colorado it was determined that it was necessary to spend at least a
minimum of $10,000.00 for leveling plus restorage of an irrigation well
to the original decree.
We have three good tenants available to lease said land, who live in the
general area, therefore we have no need for the improvements as shown on
the survey. If the exemption is allowed it would be a great assistance to
us in selling and thereby reducing part of the cost of reclaiming said land
to make it a good irrigated farm.
The Parcel A does have its own domestic water well with pump, motor and
controls and also its own sewer system in the form of a septic system and
leach field. Parcel B will require a domestic well and septic system. These
are proposed facilities at this time as we have no immediate need for improve-
ments.
The chain of title indicates that George R. Dallam and Helen Jeanne Dallam
received a deed to approximately four acres in the SW4 of the NWT of Section
19, Township 1 North, Range 65 West of the 6th P.M., Weld County, Colorado
recorded in Book 602, Reception No. 1524296, on November 25, 1968, a copy of
which is attached. Later, George R. Dallam and Helen Jeanne Dallam received
title to the remaining portion of the SCI of the NW* by deed recorded in Book
743, Reception No. 1664962, recorded July 14, 1975, a copy of which is attached.
George R. Dallam and Helen Jeanne Dallam had an exemption recorded. No.
1463-19-2- RE 196, dated May 15, 1975. The recorded exemption does not pro-
perly show or describe the four acre parcel which was previously conveyed to
Mr. and Mrs. Dallam and does not properly describe the remaining balance on
which they later received title. Thereafter, Mr. and Mrs. Dallam, because of
failure to pay a loan to the Metropolitan State Bank, conveyed. their interest
to Metropolitan State Bank, who later conveyed their interest to the Present
Holders. The deed to the Metropolitan State Bank excepted the original four

acres which they received and on which a house has been constructed. At
the present time the recorded exemption does not properly describe the
present ownership or the four acres excepted from the present ownership.
It is the object of the Tonville Farm Co. to square up the boundary lines
of said property and restore the property to the status of a good irrigated
farm.
