WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated July 21, 2004, the Board approved a request for early release of building permits for two towers to be used temporarily to determine whether the site is feasible for the placement of a wind energy facility, conditional upon a written agreement being executed between Greenlight Energy, Inc., Court Square Building, 310 Fourth Street, NE, Charlottesville, Virginia 22902, and the Board of Weld County Commissioners, specifying the form of collateral and other terms, on the following described real estate, to wit: Part of the NW1/4 of Section 3, Township 10 North, Range 58 West, and the SW1/4 of Section 31, Township 11 North, Range 59 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on August 4, 2004, the Board of County Commissioners of Weld County, Colorado, approved an Agreement concerning said wind monitoring towers and form of collateral, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Greenlight Energy, Inc., with terms and conditions being as stated in said agreement, and accepted check #8159, drawn on Greenlight Energy, Inc., Court Square Building, 310 4th Street, NE, Charlottesville, Virginia 22902, in the amount of $5,750.00, and WHEREAS, on January 18, 2005, the applicant requested the Board consider a six-month extension of time for Building Permits BCN040327 and BCN04032, with the option to request an additional six month extension to allow additional monitoring to further assess the potential for wind energy development, and WHEREAS, staff from the Weld County Departments of Public Works and Planning Services have conducted a visual inspection and recommend release of said collateral. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that check #8159, drawn on Greentight Energy, Inc., in the amount of $5,750.00 be, and hereby is, canceled and released.
