Again, there is no need to pursue the SPR if the variance is not approved. I am not interested in throwing $1300.00 away. As stated numerous times before, if someone had told me about the encroachment problem with the portable storage units, I would have addressed it sooner. Maybe your not understanding, if the variance isn't allowed, Discount Plumbing will be forced to find another location to operate from. As far as the established time line, if your office or representatives of your office had truly been looking out for my welfare as you have stated numerous times, we would not be under the gun to get this accomplished. If the County wishes to proceed with the lawsuit, that is your choice. I will defend my interest as necessary. I however, am not going to spend one dime more than is necessary to accomplish what is needed. Should the variance not be approved, I will request that the zoning be reversed and the fees paid, returned. This will have proven to be nothing more than a waste of time for all parties involved. Which could have been completely avoided if someone had taken the time months ago to make me aware of the potential problems these storage cans pose. Should this happen, our property will no longer facilitate our needs as business people. We will be forced to relocate our operation. Therefore we would have no use for completing a Sight Plan Review. Once we find out from the BOA whether or not a variance is to be granted, we will react to that information accordingly. As you have stated these fees are non-refundable, it would be a waste of money to apply for the SRP if the property is no longer suitable for our needs. To recap Monday's meeting: A signed copy of the Board of County Commissioners (BOCC) resolution will be mailed to you by the Clerk to the Board once the Commissioners have signed the document. You can contact the Clerk to the Board at 970-336-7215 x 4225 with any questions. On Monday (Jan 19, 2009) I emailed a "draft" of the resolution to Mr. Hammer with all the conditions and notes to be added to the plat. This was the same draft copy of the resolution provided to you prior to the BOCC hearing on Dec. 31, 2008. If you would like another draft copy please let me know. Prior to the BOCC hearing you and I discussed the conditions of what would need to be accomplished prior to recording the plat. Mr. Hammer did submit two paper copies of the plat prior to the BOCC hearing in December and I called him right away to let him know the plat did not address the conditions outlined in the "draft" resolution. I told him at that time that before he made all the changes for me to review he should wait until after the BOCC hearing in case their were more changes. The first email I received from Mr. Hammer regarding the plat was on Jan 14, 2009 in which I responded on the same day. I have attached a copy of the email. In December Mr. Hammer and I did not establish the responsibility for who would contact whom after the BOCC hearing. After the BOCC hearing on Dec. 31, 2008 you and I had an informal discussion in the Greeley Planning office regarding the conditions prior to recording the plat. I understood you would be in contact with Mr. Hammer to let him know the outcome of the BOCC hearing. The Department of Planning Services does not normally contact the applicant's surveyor. 1 All correspondence from Mr. Glaze, Mr. Hammer and the County has been documented regarding this case and is a part of the file and is available for public review. All future correspondence will continue to be documented and forward to the County Attorney. Let me know if you have any other comments or questions. He also stated that he had just received a copy of the final resolution today. During our meeting you had told me that you had sent him a copy shortly after the Commissioner's meeting. Mr. Hammer has expressed to me that he has had a great amount of difficulty in his dealings with you. He hasindicated to me that it is common practice for most of his customers to experience some of the same difficulties that I am encountering. He also elaborated as to the fact that there always seems to be a curve ball thrown before the application process is finalized. I can only comment about the aforementioned from my own experience; this has not been a pleasurable task. It does not make sense to me as to why it wasn't pointed out to me sooner that my portable storage units was going to be,a problem. After all, the map I submitted almost a year ago clearly illustrates the size and locations of these units. If it was going to be required of me to appear before the Board of Adjustment, looks like I could have done that months ago. As stated in a previous email, I will continue to move forward with this process. I am in complete hopes that this entire nightmare is behind me by the May 1st deadline. If it is not, however I believe the responsibility of delay may fall on more than my shoulders. Michael W. Without traveling more than five miles from the front door of my shop I found three businesses with the same type of storage cans that I have. None of them met the property line set backs that was stated I must meet. One of these businesses currently uses these cans as a form of income. My point here is why am I being required to meet certain county guidelines while it appears that other companies in the neighborhood doesn't. During the meeting Friday, it seemed that the priority of this entire process is to meet a deadline that you're office created. It doesn't however seem to matter to anyone there how much all this extra effort is costing me. In fact it was mentioned that an fine of $500.00 has been imposed because I'm not working fast enough to the County's liking. What I'm failing to see is any concern as to the disruption this entire process or the expense this has cost me. Now I'm seeing that what is being demanded of me is not being required around me. Maybe there is a reasonable explanation. If so.I'll look forward to hearing it. Nevertheless, this entire process has made me question as to who's best interest it is in. During the meeting Friday, no one could answer why a business was allowed to operate in my location for decades without the proper zoning. Now all of a sudden its a priority. I will continue to work diligently with your office to resolve any problems with my property that may exist. I am not however interested in spending any more money than I should have to. This company has approximately six trucks that are utilized for various reasons. Their hours of operation are from 6am to 5pm Monday through Friday. They sometimes work weekends and evenings when required. Their vehicles are professionally maintained and all work of that nature is outsourced off site. Their office is actually mobile with the phone being forwarded to the owner at all times. The old farm house is used for making copies of paper work. Although it was converted to office space during a previous owners occupation, it is my understanding that the proper permits were never acquired. No employees occupy the office space. There is a copy and a fax machine. No customers utilize this space nor is there any other kind of traffic in or out. It is however their intent to someday utilize this space as office space.
