HomeMy WebLinkAbout20092053.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO AUGUST 12, 2009 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, August 12, 2009, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner William F. Garcia, Chair - EXCUSED Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway Commissioner Barbara Kirkmeyer - EXCUSED UNTIL 9:10 A.M. Commissioner David E. Long Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Elizabeth Strong Director of Administrative Services, Monica Mika MINUTES: Commissioner Long moved to approve the minutes of the Board of County Commissioners meeting of August 10, 2009, as printed. Commissioner Conway seconded the motion, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Conway moved to approve the Certification of Hearings conducted on August 10, 2009, as follows: 1) Hearing to allow citizens input on CDBG Grant Application for the Bella Romero Sidewalk Project, and 2) Hearing to allow citizens input on CDBG Grant for the Intrado/Tiburon Zoll (Emergency Services Software) Project. Commissioner Long seconded the motion, which carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. PUBLIC INPUT: No public input. CONSENT AGENDA: Commissioner Conway moved to approve the Consent Agenda as printed. Commissioner Long seconded the motion, and it carried unanimously. COMMISSIONER COORDINATOR REPORTS: Commissioner Conway thanked everyone for their support throughout the last two weeks regarding his health set -backs, and he stated for the record the reason he was not able to attend various meetings during the past two weeks was due to his health issues, which included periods of hospitalization. 2009-2053 BC0016 BIDS: APPROVE BID #B0900143, 2009 TRASH - DEPARTMENT OF BUILDINGS AND GROUNDS (CON'T FROM 8/10/09): Monica Mika, Director of Administrative Services, stated the low bid from Gallegos Sanitation, Inc., is recommended, which is the company that is currently providing the service for the County. Ms. Mika stated Gallegos Sanitation, Inc., is located out of the City of Fort Collins, and staff has been pleased with the service it has provided. Commissioner Long indicated the rate from another vendor is lower for the compactor; however, the overall costs may not be lower. Ms. Mika confirmed the overall costs were factored into the cost determinations. David Rietema, Waste Management, stated his company submitted the third lowest bid and it is approximately $200.00 dollars higher than the low bid, per month. Mr. Rietema stated he wants the Board to consider what his company can offer, even though it did not submit the low bid. He stated his company has been a platinum sponsor for the Greeley Stampede, which annually costs $40,000.00, and it has supported many other community events, which he can supply a list of upon request. He stated it will be difficult for Waste Management to continue to partner with government agencies that do support it, due to the current economic times. He stated Waste Management's landfill is located in Weld County and employees over 100 people; therefore, he encourages the Board to consider all of these factors before it accepts another bid. (Clerk's Note: Commissioner Kirkmeyer is now in attendance.) Commissioner Conway thanked Mr. Rietema for his company's support. Commissioner Kirkmeyer inquired as to what the percentage of difference is between the two bids. Commissioner Conway indicated there is approximately $200.00 between the two bids, per month. Commissioner Kirkmeyer inquired as to what the Weld County Home Rule Charter rule is regarding the procurement of services and utilizing local vendors. Bruce Barker, County Attorney, stated the Weld County Home Rule Charter permits the Board to select a vendor that did not submit the low bid if the vendor it selects is local and the bid is within a certain percentage of the low bid; however, if a bid other than the low bid is accepted, the Board needs to explain its reasons for selecting the bid for the record. Commissioner Kirkmeyer inquired as to if the bid from Waste Management is within the percentage that will allow it to be considered. Mr. Barker indicated he does not know the bid amounts. Ms. Mika stated the low bid is from Gallegos Sanitation, Inc., in the amount of $2,393.00 per month; the next lowest bid is from Northern Colorado Disposal, in the amount of $2,488.00 per month, and it is located in the City of Greeley; the third lowest bid is from Waste Management, in the amount of $2,632.00 per month, and it is located in the Town of Ault; and the fourth lowest bid is from a vendor located in the City of Evans. In response to Commissioner Conway, Ms. Mika indicated the bids include all of the associated costs, including roll -off trailer costs. Toby Taylor, Department of Buildings and Grounds, clarified the roll -off trailer costs are not included in the monthly or annual costs because they are provided only upon request; they are not automatically provided on a monthly basis. Commissioner Rademacher inquired as to how many roll -off trailers are used by the County on a monthly basis. Mr. Taylor stated it varies according to demand; however, there is only one roll -off used consistently by the County, and it is a roll -off compactor the jail utilizes. Commissioner Kirkmeyer inquired as to the percentage of cost difference between each of the bids, and reiterated the Weld County Home Rule Charter states the Board will give preference to Weld County bidders if the cost is competitive. Commissioner Conway stated the two lowest bids are within five percent of one another. Chair Pro-Tem Rademacher stated the second lowest bid is from Northern Colorado Disposal, which is located in the City of Greeley; therefore, it will be awarded the bid if the Board chooses to follow the rule regarding the vendors being located within Weld County. Commissioner Conway stated there is more than one vendor located in Weld County and within the five percent range with their bids. Mr. Barker indicated five percent has been used as a guideline; however, it does not specify a particular percentage in the Weld County Home Rule Charter; it simply specifies bids that are competitive and of a Minutes, August 12, 2009 2009-2053 Page 2 BC0016 similar quality. Commissioner Conway inquired as to the quality of service provided by each of the vendors who submitted the three lowest bids. Mr. Taylor stated all of the references have indicated each of the three vendors will provide a high quality of service. Commissioner Long indicated he is curious about the roll -off costs, and there should be an average cost that staff can provide to establish a ball park figure. He stated he is concerned the roll -off costs may be substantially different between the three companies. In response to Chair Pro-Tem Rademacher, Mr. Taylor stated there is time to continue the matter to allow the Board to conduct a work session before making its determination. Commissioner Conway moved to continue the matter to August 17, 2009, in order for the Board to be able to attend a work session prior to the Board making its determination. Commissioner Kirkmeyer seconded the motion, which carried unanimously. NEW BUSINESS: CONSIDER APPLICATION FOR ENERGY AND MINERAL IMPACT ASSISTANCE PROGRAM FOR U.S. HIGHWAY 85 COALITION AND AUTHORIZE ELECTRONIC SUBMITTAL: Commissioner Kirkmeyer stated she submitted a grant application, on behalf of the Board, for the U.S. Highway 85 Coalition. She stated it was hoped that the City of Evans would be able to sponsor the grant; however, the matter has not been considered at a City Council meeting. She stated the local financial commitment will be in the amount of $50,000.00, if the grant is awarded, and the amount requested from the grant is $150,000.00. Commissioner Kirkmeyer stated it is a Tier 1 Grant, and the County has not committed to a specific financial amount; however, it has indicated it will contribute. In response to Chair Pro-Tem Rademacher, Commissioner Kirkmeyer stated the grant funds may be declined if the County is unable to find other local municipalities to participate, and she moved to approve said application and authorize the electronic submittal of it. Seconded by Commissioner Conway, the motion carried unanimously. CONSIDER DECLARING CERTAIN EQUIPMENT AS SURPLUS PROPERTY: Barb Connolly, Controller, stated the equipment consists of two obsolete printers, which are broken, and there are no replacement parts available for them. In response to Chair Pro-Tem Rademacher, Ms. Connolly clarified the printers will not be sold; they will be disposed of. Commissioner Conway moved to declare certain equipment as surplus property. Seconded by Commissioner Long, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
