USR-1680 - North Weld Water District plat and conditions of approval & Items for drainage
report, collateral
Sorry for the delay. I had to have Public Works take a look at the plat to make sure their
required items on the plat were covered. The original Public Works employee who reviewed
this case no longer works at the County. Improvements agreement and Public Works
requirements are also spelled out in this e-mail.
Here are the required modifications to the plat:
1) The word "major" shall be removed from the Property Owner's approval
Certificate.
2) The Planning Commissioners Certificate shall be revised to read as follows:
"This is to certify that the Weld County Planning Commission does hereby
confirm and adopt this Use by Special Review and Development Standards as shown and
described hereon this day of 2009."
3) Remove the Board of County Commissioners Certification.
4) Indicate Right -of -Way (and book & page info.) for County Road 13 on the plat -
since the access road to the site is off of County Road 13.
5) The Poplars shown on the site map are acceptable as long as they are a
Cultivar of Buleana variety.
6) Provide a drainage easement around the detention pond (and indicate access -
minimum 20 -foot to the pond) - do you have a gate proposed?
7) If allowed/possible, please indicate some poplars along the northern portion
of the site.
8) If seeding proposed, indicate type and location on plat.
Improvements Agreement (requirements):
1) Weld County now has a different format for improvements agreements. Please send
over an updated exhibit A and B (the timeline & cost estimates). Rich Hastings of
Public Works will then draft the improvements agreement for your review. (I will
be forwarding the exhibits to you under a separate e-mail).
2) The Department of Planning Services will request a cost list for the trees
and shrubs, seeding for the project to verify costs.
3) Public Works will also need construction drawings for the site and road to
verify costs.
* The access road dimensions (including the access onto the easement) plus surface
treatment shall be shown. The minimum road dimensions shall be 24 -feet with 1 -foot
shoulder on each side. The road will need to be an all-weather surface.
Drainage Report (requirements):
1) A stamped, signed and dated drainage report will need to be submitted to the

Department of Public Works.

* Recalculate the 5 -year historic release rate and road size.
County Road 13 improvements:
1) Contact Amy Burry with Public Works at 304-6496 ext. 3764 re: a right-of-way
permit for any work in the right-of-way and/or hauling of oversized loads/equipment.
2) Minimum culvert size is 15 -inch CMP with at least 1 -foot of cover.

Attached is a letter I sent to Chris Gathman today to clarify the term and condition that Farmers Independent
is requesting. I received the notice of the December 1 hearing today. Is A&W willing to accept the proposed
term and condition, and, if so, would you be willing to communicate that to Weld County so that FIDCo does
