HomeMy WebLinkAbout20093097.tiffHEARING CERTIFICATION DOCKET NO. 2009-75 RE: SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED USE BY SPECIAL REVIEW PERMIT #485 FOR A NATURAL GAS COMPRESSOR STATION (AMENDED TO INCLUDE A NEW OFFICE BUILDING AND FUTURE COMPRESSOR BUILDING) IN THE A (AGRICULTURAL) ZONE DISTRICT - COLORADO INTERSTATE GAS COMPANY A public hearing was conducted on November 25, 2009, at 10:00 a.m., with the following present: Commissioner William F. Garcia, Chair Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway - EXCUSED Commissioner Barbara Kirkmeyer Commissioner David E. Long Also present: Acting Clerk to the Board, Jennifer VanEgdom Assistant County Attorney, Cyndy Giauque Planning Department representative, Chris Gathman Health Department representative, Mary Cavnah Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated October 16, 2009, and duly published October 22, 2009, in the Windsor Beacon, a public hearing was conducted to consider the request of Colorado Interstate Gas Company for a Site Specific Development Plan and Amended Use by Special Review Permit #485 for a Natural Gas Compressor Station (amended to include a new office building and future compressor building) in the A (Agricultural) Zone District. Cyndy Giauque, Assistant County Attorney, made this a matter of record. Chair Garcia advised the applicant's representative, Mike Rutherford, that he has the option of continuing the matter to a date when the full Board will be present. However, if he decides to proceed today, the matter will require three affirmative votes, or in the case of a tie vote, Commissioner Conway will review the record and make the determining vote. Mr. Rutherford indicated he would like to proceed today. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He stated the site was originally approved in 1978 through SUP -351, and was amended in 1982, through the issuance of USR-485. He indicated this amendment addresses the addition of an office building and a possible future compressor building, which will house compressors. He further indicated this amendment will also incorporate the changes to the site which have occurred since the approval of USR-485 in 1982, including additions to the site through the Wyoming Interstate Company Expansion Project, the Cheyenne Plains Project, and the Front Range Project, which occurred between the years 1997 and 2004. He stated the site is in a remote location, with existing oil and gas improvements located to the south and east of ('CPcu, lIc 2009-3097 PL0582 (-St/ /07 HEARING CERTIFICATION - COLORADO INTERSTATE GAS COMPANY (AMUSR-485) PAGE 2 the site, and no residences within close proximity. He confirmed no telephone calls or letters of concern were provided, seven referral responses were received, and no referrals were provided by the Nunn Fire Protection District, Colorado Oil and Gas Conservation Commission, Sheriff's Office, the Soil Conservation District, or the Office of Emergency Management. Mr. Gathman displayed photographs of the site, and in response to Commissioner Rademacher, he indicated the proposed building is expected to look similar to the existing building on the site, and the applicant can address the specifics of the building. Further responding to Commissioner Rademacher, Mr. Gathman reiterated the site was first approved as SUP -351 in 1978, and amended to become USR-485 in 1982, and all of the minor additions which have been added through the years have been determined by staff to constitute a Substantial Change, therefore, the permit is being updated through this proposed amendment. Mary Cavnah, Department of Public Health and Environment, stated the permanent water source for the site is through two wells, one permitted for industrial uses, and one permitted for human consumption. She indicated the site contains four permitted septic systems, which need to be identified on the plat. She confirmed a new septic system has been installed for the office building, the applicant will be required to submit Dust Abatement and Waste Handling Plans, and the noise on the site must comply with the levels allowed within the Industrial Zone District, as addressed within Development Standard #7. Don Carroll, Department of Public Works, stated the site is located adjacent to U.S. Highway 85, north of County Road 126, and is four miles south of the Wyoming border. He indicated the site is located in an area that is not included within the U.S. Highway 85 Access Control Plan; however, if the Plan is extended to the Wyoming border at some point in the future, the applicant will be required to work with the Colorado Department of Transportation (CDOT) regarding any necessary access permits for the site. He clarified the response from CDOT indicated the applicant is not currently required to obtain a new access permit for the site. Mr. Carroll indicated the entrance improvements include a tapered southbound turn lane, a cattle guard at the property line, and most of the internal roads of the site are paved. He stated it is expected that the new office facility will have one to four employees, the truck unloading operations will have ten to fifteen employees, and there will be a total of between six to ten transfer bays on the site to transfer oil into the pipeline. He indicated the site requires water quality features to capture runoff, and no buildings or storage uses will be allowed within the designated areas. Mr. Rutherford represented the applicant and clarified the new building to be constructed on the site will be approximately one-half of the size of the existing building, which he indicated on the map provided. He further clarified Colorado Interstate Gas does not have any plans for expansion of the site at this time; however, the plans were presented so that when a need exists in the future, the plans may be carried out. He confirmed staff is in the planning stages for the required water quality features on the site, and will move forward with the required work soon. No public testimony was offered concerning this matter. In response to Chair Garcia, Mr. Rutherford indicated he has reviewed, and concurs with, the Conditions of Approval and Development Standards. 2009-3097 PL0582 HEARING CERTIFICATION - COLORADO INTERSTATE GAS COMPANY (AMUSR-485) PAGE 3 Commissioner Long moved to approve the request of Colorado Interstate Gas Company for a Site Specific Development Plan and Amended Use by Special Review Permit #485 for a Natural Gas Compressor Station (amended to include a new office building and future compressor building) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. There being no further discussion, the hearing was completed at 10:20 a.m. This Certification was approved on the 30th day of November, 2009.
