HomeMy WebLinkAbout20092667.tiffRESOLUTION RE: APPROVE CORRECTIVE QUIT CLAIM DEED AND AUTHORIZE CHAIR TO SIGN - COMMUNITY DEVELOPMENT INSTITUTE HEAD START WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Quit Claim Deed from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, to Community Development Institute Head Start, 10065 East Harvard Avenue, Suite 700, Denver, Colorado 80231, commencing upon full execution, with further terms and conditions being as stated in said Corrective Quit Claim Deed; said property being described as: Lot 2, 31 Road Business Park, County of Mesa, State of Colorado, with street address of 3093 East 1/4 Road, Grand Junction, Colorado 81504, including all improvements located thereon, all modular buildings appurtenant thereto, and an associated storm water drainage easement over adjacent property conveyed by grant recorded on January 23, 2002, in the Office of the Mesa County Clerk and Recorder at Book 3007, Page 889, Reception Number 2037056, and WHEREAS, after review, the Board deems it advisable to approve said Corrective Quit Claim Deed, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Corrective Quit Claim Deed from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, to Community Development Institute Head Start, be, and hereby is, approved. This Corrected Quit Claim Deed is made necessary because of a mistake with the original where we referred to the wrong easement. A copy of the correct easement is attached to this e-mail. 1 2009-2667 CORRECTIVE QUIT CLAIM DEED THIS CORRECTIVE QUIT CLAIM DEED is made this 12th day of October, 2009, between the COUNTY OF WELD, a body politic and corporate of the STATE OF COLORADO, of the first part, and to Community Development Institute Head Start, a Colorado nonprofit corporation, whose address is 10065 E. Harvard Avenue, Suite 700, Denver, Colorado 80231, of the second part. WITNESSETH, that the said party of the first part, for and in consideration of the sum of One Dollar ($1.00), and other good and valuable consideration, to the said party of the first part in hand paid by the said party of the second part, the receipt whereof is hereby confessed and acknowledged, has remised, released, sold, conveyed and QUIT CLAIMED, and by these presents does remise, release, sell, convey and QUIT CLAIM unto the said party of the second part, its heirs, successors and assigns, forever, all the right, title, interest, claim and demand which the said party of the first part has in and to the following described lots or parcels of land situate, lying and being in the County of Mesa and State of Colorado, to wit: Lot 2, 31 Road Business Park, County of Mesa, State of Colorado, with street address of 3093 E. TO HAVE AND TO HOLD the same, together with all and singular the appurtenances and privileges thereunto belonging or in anywise thereunto appertaining, and all the estate, right, title, interest and claim whatsoever, of the said party of the first part, either in law or equity, to the only proper use, benefit and behoof of the said party of the second part, heirs and assigns forever. This Corrective Quit Claim Deed is being executed for the purpose of correcting an erroneous reference to an appurtenant easement, which reference was contained in the original Quit Claim Deed given by the County of Weld to Community Development Institute Head Start and recorded in the Office of the Mesa County Clerk and Recorder on February 17, 2009 at Book 4796, Page 433, Reception Number 2476255.
