RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
ZCV #0800245 AGAINST ABELARDO AND NANCY VEGA FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Abelardo and Nancy Vega, ZCV #0800245, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of January, 2009, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Jorge Vega, tenant, was present at said hearing, and
WHEREAS, the Board deems it advisable to dismiss said violation due to no activities or
events being held on the site at this time.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0800245 against Abelardo and Nancy Vega be, and hereby is,
dismissed.

Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a

On Thursday, September 25, 2008 an informal discussion took place at the Greeley
Administrative Offices Planning Room regarding the proposed USR for rodeo facility. (The legal
description is W2 NW4 Section 3, Township 6 North, Range 64 West of the 6th P.M.; Situs
Address is 35918 CR 55)
Background Information:
Applicant is currently operating a rodeo at this site. This site encumbers approximately 80 acres.
There is currently a house and barn located on -site.
Access is gained from CR 55. Applicant indicated that there is an Ag access from CR 74.
Applicant indicated that there are currently 3 wells: 1) domestic use, 2) Ag use for livestock, and
3) additional use. Applicant commented that he is currently in the process of getting a tap from
North Weld County Water District.
The applicant currently provides 2-3 port-a-pottys for the public. Staff expressed that the Health
Department will require handwashing facilities as well as lavatories for public use.
Public Works
A Site Plan indicating the traffic circulation and defining the parking areas will be required.
Public Works is requesting an estimated number of traffic counts to the property as they don't
believe a traffic study will be required.
Public Works stressed that there cannot be any parking or staging on the County Roads.
Applicant mentioned that the public will occasionally stop along the road to see as they are
curious and he encourages them to come park inside if they wish to watch the rodeo.
Public Works stated that a Drainage Report will not be required; however they will need to have
a water quality feature on site. No Geotechnical Report or Flood Hazard Development Permit
will be required.
Planning Department
The applicant indicated that the only lighting on -site is on the barn. The rodeo will only operate
during daytime hours — approximately noon to dark.
The parking is located in a field of grass or compacted soil. The applicant indicated that he is
proposing to irrigate farmland south of the house and rodeo operations.
Applicant indicated that he is proposing to build a house south of the existing house. Staff
alerted applicant that the County code states only one dwelling unit is allowed per parcel.
Therefore the applicant will need to subdivide the land where the current dwelling house is.
Applicant indicated that he has visited with staff previously with regard to building a proposed
house as well as the RE process.
Applicant stated that they have a rodeo every 2 weeks from Spring to Fall, weather permitting.
He added that under the USR application he would like to apply for year round operation to be
covered.
Zoning Compliance asked if alcohol was provided on -site. The applicant indicated that people
may bring their own; however he stressed that it is not encouraged and that the site is patrolled
by the Sheriffs Department and State Patrol. The applicant further added that he has staff clean
up any trash around the surrounding property and that he likes to maintain a clean and orderly
operation.
Staff recommended the USR boundary cover the rodeo operation itself and not necessarily the
entire 80 acres. Staff reviewed the fees and application with the applicant.
Staff explained the USR process - that the applicant shall submit 4 packets for our 7 day
completeness review. Once the 7 day completeness review is complete the applicant will be
informed of what items are still required to make the applicant complete. After the completed
application is submitted it will be sent out for referral for 28 days. The applicant will then meet
with their Planner to discuss the referrals and address as many of the referrals as possible. At
the meeting the Planning Commission hearing will be scheduled. The Board of County
Commissioners hearing typically follows approximately 3 weeks after the Planning Commission
hearing.
Staff urged applicant to submit the USR application prior to December 1, 2008 or the property
will go into violation. A letter will be sent by Zoning Compliance explaining the process.
Applicant indicated that there are some rodeos scheduled through November and has given the
dates to Zoning Compliance. Staff commented that they are willing to work with the applicant
through this process; however they request that there be no further rodeos after November 26,
2008.

AND WITNESSED APPROXIMATELY ONE HUNDRED AND FIFTY PEOPLE PARTICIPATING IN VARIOUS
RODEO EVENTS. I OBSERVED A MALE TAKING MONEY AT THE DRIVEWAY ENTRANCE. THE MALE,
IDENTIFIED AS ABELARDO VEGA WAS EXCEPTING DONATIONS FOR AN UNSPECIFIED CHARITY. VEGA
STATED THAT ALCOHOL WAS ON THE PREMISES, BUT IT WAS CARRIED IN BY HIS QUESTS AND NOT
BEING SOLD BY HIM OR ANYONE ELSE. FROM OUR LOCATION ON THE ROAD, I DID NOT OBSERVE ANY
ALCOHOL, AND NO CARS WERE PARKED ON THE ROAD OR CREATING ANY KIND OF HAZARD.

A complaint was received today regarding a property hosting large rodeo/roping events that also involves
alcohol. The complainant notified Commissioner Long that they would be hosting another such event tomorrow
around the noon hour. After conducting a site inspection today it was noted a small area cleared out for such
activities and some bleacher seating. I can also verify that the property does not have any permits which would
allow for this type of use and a violation will be initiated. Additionally, the Sheriff's office has been notified and
will be sending someone out at some point tomorrow. They will be updating me with a report as to what
transpires during their visit. Please feel free to contact me with any additional information, question or concerns
you all may have regarding this violation.
