DATE: 11/12/2008 Environmental Health Services has reviewed this proposal for an oil and gas support operation consisting of an injection well facility. An individual commercial well will provide potable water. An individual sewage disposal system (ISDS) will be installed for use in the operations building. The ISDS was approved by the Board of Health on October 28, 2008. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall file an Air Pollution Emission Notice (A.P.E.N.) with the Colorado Department of Health and Environment's (CDPHE) Air Pollution Control Division. 2. A Ground Water Monitoring Plan shall be submitted to the Weld County Department of Public Health & Environment (WCDPHE) for review and approval. 3. If appropriate, Stormwater Discharge Permit coverage shall be obtained from the CDPHE Water Quality Control Division. 4. The applicant shall submit evidence to the Weld County Department of Public Health and Environment and the Department of Planning Services, from the Colorado Division of Water Resources, demonstrating that the well is appropriately permitted for the commercial use. 2009-0052 We recommend that the following requirements be met prior to receiving final approval of building permits: 1. A concrete secondary containment structure (floor and walls) surrounding each tank or battery of tanks shall be constructed. The volume retained by the structure shall be 150% greater than the volume of the largest tank inside this structure. A registered professional engineer shall design the structure. The structure shall prevent any release from the tank system from reaching land or waters outside of the containment area. The operator shall provide evidence from the engineer to the Weld County Dept. of Public Health and Environment (WCDPHE) indicating that the structure has been constructed to meet this criterion. 2. A detailed design of the "concrete unloading pad" shall be submitted to WCDPHE for review and approval. The design shall demonstrate how all spilled waste, stormwater and wash down water will be contained within the receiving area and concrete sump. The design shall also include the method in which seams will be sealed to prevent leakage through the pad. A leak detection system shall be designed and installed beneath the "concrete unloading pad". The "concrete unloading pad" shall be constructed and operated in accordance with the approved design. • • 3. The applicant shall submit evidence to the WCDPHE, Weld County Planning Services and the Colorado Oil and Gas Conservation Commission (COGCC) that the facility was constructed in accordance with application materials. 4. A copy of the drilling log shall be submitted to the WCDPHE. 5. An individual sewage disposal system (I.S.D.S.) permit is required for sewage flow from the proposed operations building. The system must be designed by a Colorado Registered Professional Engineer and in accordance with Weld County I.S.D.S. Regulations. 6. Solids and sediment will accumulate in the storage tanks. The facility shall submit a detailed plan to WCDPHE for approval that describes the method of solids removal, including all on -site handling procedures and disposal. Any amendments to the approved plan shall be submitted in writing to WCDPHE for approval. 7. A Detailed Closure Plan shall be submitted to the Weld County Department of Public Health and Environment and the Colorado Oil and Gas Conservation Commission. The Closure Plan shall include a description of the manner in which the well will be plugged and abandoned, as well as specific details regarding reclamation of the property. No structures or equipment associated with the facility shall remain on the property following closure. 2 • • • 8. The facility shall post financial assurance with the COGCC. The financial assurance shall be adequate to cover a third -party closure of the facility, including the plugging and abandonment of the well, in accordance with industry standards, and the removal of all structures (including concrete) on the facility. The site shall be returned to its original grade. In the event the COGCC does not have the authority to require financial assurance for the entire cost required for the third -party closure, the facility shall post the remainder of the financial assurance with Weld County. The facility shall submit evidence, in writing, to the WCDPHE that the appropriate financial assurance has been obtained. We recommend that the following requirements be incorporated into the permit as development standards: 1. The facility shall be constructed and operated to ensure that contamination of soil and groundwater does not occur. 2. A manager, knowledgeable in operating an injection well, shall be on site when the facility is receiving waste. /3. No disposal of waste, other than Class II, as defined by the Environmental Protection Agency, is permitted. Any changes from the approved Class II use would require an amendment to this Special Use Permit. Any wastes generated on the facility shall be disposed of in accordance with the Colorado Solid Waste Act, Section 30-20-100.5, C.R.S., or other appropriate rule, regulation or law. -5. This facility shall adhere to the maximum permissible noise level of 70 dBA as allowed in the industrial Zone as delineated in 25-12-103 C.R.S. '6. 1. Fugitive dust and fugitive particulate emissions shall be controlled on this site. All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. - 8. The facility shall comply with Colorado Air Quality Control Commission Regulations and any air permits issued by the CDPHE Air Pollution Control Division. 9. All liquid wastes received at the facility shall be unloaded on the unloading pad. The concrete unloading pad shall be cleaned at a frequency that prevents oils and other wastes from building up on the pad. At a minimum, the pad shall be pressure washed daily to remove any waste build-up. During winter months, the facility shall maintain the unloading pad free of ice. 3 • • • ,1'6.Any analysis of waste shall be forwarded to the WCDPHE, who reserves the right to require additional, more extensive monitoring at a later date. ,11.All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 12: Any petroleum contaminated soils on the facility shall be removed, treated or disposed of in accordance with all applicable rules and regulations. 1.3.The property owner or operator shall be responsible for complying with all of the Development Standards. Noncompliance with any of the Development Standards may be reason for revocation of the Permit by the Weld County Board of County Commissioners. 14. The facility shall comply with the approved groundwater monitoring plan. ,15.All storm water, which has come into contact with waste materials on the site, shall be confined on the site. In the event that storm water is not adequately controlled on the site, upon written notification from the WCDPHE or CDPHE, a comprehensive site -wide storm water plan shall be developed and implemented. The plan must be approved, in writing, prior to implementation by WCDPHE and CDPHE. 16.All contaminated soils shall be stored on an impervious surface where any stormwater that comes into contact with the soils would be contained. 17. The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: 1. Weld County Road Classification Plan (FHUI: (June 2002) a. REQUIREMENTS: WCR 32 is a local paved road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The most current road counts for WCR 32 are 842 AADT taken in August of 2007 WCR 35 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The most current road counts for WCR 35 are 97 AADT taken in July of 2006 2. Road Access Policy: (Policy Established Sec. 8-2-10) a. If a drainage culvert is required, a 15 -inch corrugated metal pipe is the County's minimum size requirement. If the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size your culvert. b. A 40' radius is required on all accesses to public roads for accesses designed to accommodate truck traffic. {A minimum effective turning radius of forty (40) feet shall be used for accesses intended to accommodate truck traffic. (Weld County Codification Ordinance 2000-1)} Sec. 8-2- 40 B. Road access design standards. 3. The access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. The applicant shall utilize the existing access to Lot A. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. The applicant shall indicate specifically on the plat the type of easement and indicate whether it is • dedicated, private, or deeded to provide adequate access to the parcel. 7. The applicant shall contact the neighboring property owner to obtain, in writing, permission to utilize their access road for an oil and gas access. 8. The right-of-way or easement shall be a graded and drained road to provide an all-weather access. The internal road(s) shall enter onto WCR 32 at a 90° angle, for a minimum of one vehicle length to provide adequate sight distance in both directions. 10. A local residential/agricultural access shall be a minimum distance of 150 feet from an intersection county or state roadway. 11. The access width requirements for emergency equipment (fire department) are a minimum of 20 feet. 12. Storm Water Drainage: a. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. b. The applicant must take into consideration storm water capture/quantity and provide accordingly for best management practices. • • c. A final drainage report stamped, signed, and dated by a professional engineer licensed in the State of Colorado is required and shall conform to Weld County CODE 24-7-130.D and Ordinance 2006-7. d. Appropriate design storm periods shall be utilized for the proposed land use, see Weld County CODE Sec. 24-7-130.D Table 24.2 Storm Design Frequencies. e. Weld County will not maintain drainage related areas or medians. This must be addressed by the homeowner's association or owner. f. Final drainage construction and erosion controls plans (conforming to the final drainage report) stamped, signed, and dated by a professional engineer licensed in the State of Colorado shall be submitted with each plan (phase). These plans (storm water management plans) shall be based upon Urban Storm Drainage Criteria Manual methodology as modified by Weld County Ordinance 2006-7. g. The applicant is required to comply with all Colorado Department of Health and Environmental (CDPHE) regulations regarding berming and spill prevention for materials and liquids stored on site. h. The applicant is required to comply with all Colorado Department of Health and Environment, Water Quality Control Division regulations regarding storm water quality permitting and protection and construction storm water discharges. In addition to these requirements, the plat scale shall be 1" = 40 feet. The Vicinity Map scale of 1" = 2000 feet scale shall be accurately delineated on the plat. This application shall be in compliance with Section 23-3-250 A. and B and is address in the following comments. Section 23-3-250.A.2 Parking. Sufficient screened, off-street, paved parking areas shall be provided to meet the requirements of employees, company vehicles, visitors and customers of the Uses Allowed by Right and Accessory Uses. Appendix 23-A describes the design requirements for parking spaces and Appendix 23-B delineates the number of parking spaces required by use for this property. The proposed facility will accommodate 30 truck drivers within any given twenty-four hour period, further, there will be six employees, two per each eight (8) hour shift. Total on site parking will be a minimum of six (6) spaces. Additionally, semi -tractor spaces shall be provided to accommodate the staging of vehicles associated with this facility. All parking spaces shall comply with the minimum design requirements for off-street parking as delineated in Appendix 23-A of the Weld County Code. Compliance with the minimum parking and access standards for the Americans with Disability Act shall be followed at all times, as applicable. Should the employee or visitor numbers increase, the parking requirement shall be structured according to Appendix 23-B of the County Code. Written evidence of compliance shall be submitted to the Department of Planning Services. • High Plains Disposal, USR 1677 - Page 1 • • Section 23-3-250.A.4 Required Yards - Setback No use or accessory use may be located closer than twenty (20) feet to the existing or proposed (whichever represents the greater right-of-way width) highway or street right-of-way. Off-street parking areas may be permitted in the required setback area when the area is screened from direct view of persons on the public rights -of -way. Fences over six (6) feet in height are not required to comply with the minimum setback and may be located on the property line. Fences located on corner lots abutting public right-of-way shall not obstruct the view of vehicular traffic at an intersection. There was not a scaled elevational drawing of the proposed facility, therefore, prior to the release of building permits, the set back shall be verified given the existing proposed site conditions, specifically addressing the landscape and screening component that is delineated within the County Road 32 right-of-way. Written evidence of compliance shall be submitted to the Department of Planning Services. Section 23-3-250.A.4 Required Yards - Offset No use or accessory use may be located closer than ten (10) feet to its lot line. Fences over six (6) feet in height are not required to comply with the minimum Offset and may be located on the property line. The plans submitted with the application materials have not delineated the offset. Written evidence of compliance shall be submitted to the Department of Planning Services. Section 23-3-250.A.5.A Required Landscaped Areas No more than eighty-five percent (85%) of the total area of a lot shall be covered. Land shall not be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered by decorative gravel or wood chips, or if it is otherwise suitably Landscaped. There was not a schematic Landscape and Screening Plan submitted with the application materials. The applicant shall address this issue and provide additional documentation including all proposed fencing, lighting, adjacent property screening and landscape treatment to meet this section of the Weld County Code. Further, staff will require an approved weed management plan and a reseeding /post construction plan to facilitate soil stabilization and plant material growth. Further, staff will require an updated landscape and screening plan that addresses the issue of the landscape and screening component for the buffer between the outdoor storage component and the adjacent properties for this proposed facility. Written evidence of compliance shall be submitted to the Department of Planning Services. Section 23-3-250,A.6 Areas used for trash collection shall be screened from public rights -of -way and all adjacent properties. These areas shall be designed and used in a manner that will prevent wind- or animal -scattered trash. The application materials did identify the location of the three dumpsters for recycling on the plat, however, there was no evidence of immediate screening or other recycling material control device employed to control this issue. Future submittals shall address this issue as outlined in this Section of the Code. Written evidence of compliance shall be submitted to the Department of Planning Services. Section 23-3-250.A.9 Outside Storage. Uses involving outdoor storage of vehicles, (including the parking of employee • High Plains Disposal, USR 1677 - Page 2 • • • vehicles) equipment or materials when permitted shall be screened from public rights -of -way and all adjacent properties. The applicant shall submit documentation as to how the outside storage will be screened during the construction period, and for periods thereafter as applicable. Section 23-3-350.B. Operation Standards. Uses shall demonstrate conformance with the following operation standards to the extent that they are affected by location, layout and design prior to construction and operation. Section 23-2-250.6.6 Light. Any lighting, including light from high temperature processes such as welding or combustion, shall be designed, located and operated in such as manner as to meet the following standards: sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties; neither the direct nor reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets; and no colored lights may be used which may be confused with or construed as traffic control devices. The application materials did not include a Lighting Plan. Should exterior lighting be a part of this facility, all light standards shall be delineated on the USR Plat. Section 23-2-250.B.7 Property Maintenance. Property shall be maintained in such a manner that grasses and weeds are not permitted to grow taller than twelve (12) inches. In no event shall the property owners allow the growth of noxious weeds. The application materials do not address property maintenance. Future correspondence shall identify how the property will be in compliance with this Section of the County Code. Section 23-4-50. Off Street Loading. The applicant shall delineate on the plat the location of the loading zone that is in compliance with this Section of the Code. There shall be no parking or staging of vehicles within the public rights -of way. Further, the applicant shall meet all requirements of the Department of Public Works concerning access and internal circulation of vehicles for this proposed facility. Section 23-4-90 Signs. The application materials did not address the issue of on -site signs. The applicant shall provide written evidence that all proposed signs are in compliance with this section of the Code. The applicant shall enter into an Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all transportation (access drive, parking areas, et cetera) and non -transportation (plant materials, fencing, screening, et cetera). The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the USR plat. End Memorandum. Director Re: USR-1677 — High Plains Disposal Inc. — A site specific development plan and a special review permit for oil and gas support facility in the A Zone District Dear Mr. Gathman: This referral does not appear to qualify as a "subdivision" as defined in Section 30-28- 101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or the physical availability of water. According to the referral information, water to the site will be provided by a proposed commercial well. The applicant recently obtained well permit no. 278835 which allows the applicant to construct a well on Lot A of Recorded Exemption RE -4049. The uses allowed by the permit are drinking and sanitary purposes for a commercial business. Water from the proposed well cannot be used for lawn or landscape irrigation or for any other purpose outside the business building structure. Once constructed, the well can be used for drinking and sanitary purposes for the commercial operation as long as the well is operated in accordance with the terms and conditions of the well permit.
