CILIM . . ` 4�_= RESOLUTI ON RE: APPROVAL OF CONDITIONAL USE PERMIT NO. 33 :78 : 2 FOR PASTOR RESIDENCE AND CHURCH SANCTUARY ON A TRACT OF LAND LOCATED IN SECTION 15, TOWNSHIP 6 NORTH, RANGE 67 WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 9th day of August, 1978 at the hour of 9 : 00 o 'clock a.m. for the purpose of hearing the application of the First Baptist Church of Windsor for the granting of a Conditional Use Permit for a pastor residence and church santuary on the following described real estate, to-wit: A tract of land located in Southwest Quarter (SA) of Section 15, Township 6 North, Range 67 West of the Sixth Principal Meridian, Weld County, Colorado and being more particularly described as follows: Commencing at the South Quarter Corner (SaCor) of said Section 15, and considering East Line of Southwest Quarter (SWQ) to bear North 00°36'23" East with all bearing contained herein being relative thereto: Thence North 00`36'23" Fast, along East Lire of the Southwest Quarter (SWQ) of said Section 15, 93.34 feet to the True Point of Beginning; Thence South 89°33'00" West, along the North Right-of-Way Line of Colorado State Highway No. 392, 424.17 feet; Thence North 51°53'25" East, along the South Right-of-way Line of Great Western Railroad 543.53 feet; Thence South 00°36'23" West, along East Line of the Southwest Quar er (SE4) of said Section 15, 332.14 feet to the True Point of Beginning. Said tract of land contains 1.617 acres. WHEREAS, evidence was presented in support of the grant of the Conditional Use Permit for pastor residence and church santuary, and WHEREAS, Section 3 . 3 .D. of the Weld County Zoning Resolution authorizes such a use in an Agricultural District on the grant of a Conditional Use Permit by the Board of County Commissioners , and WHEREAS, the Board of County Commissioners of Weld County, Colorado, heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits /pH ii/421 PL0576 780234 and evidence presented in this matter, and having been fully informed and satisfied that the request for a Conditional Use Permit for pastor residence and church sanctuary on the herein- above described real estate, complies with all of the conditions as set out in Section 3 .3 .D. (2) of the Weld County Zoning Resolution; NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application of the First Baptist Church of Windsor for a Conditional Use Permit for pastor residence and church sanctuary on the hereinabove described tract of land, be, and hereby is, granted, subject to the development standards contained in the Conditional Use Permit. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the reasons for apporval contained in the Planning Commission Recommendations dated August 1, 1978 be, and hereby are, incorporated as the findings of fact of the Board of County Commissioners in this matter. RECOMMENDATION August 1, 1978 "The Planning Commission and the Board of County Commissioners shall consider the following in making their determination in approving or denying a con- ditional use permit : Compatibility with the surrounding area, harmony with the character of the neighborhood and existing agricultural uses in the area, need for the proposed use , its effect upon the immediate area, its effect on future development of the area, and the health, safety and welfare of the inhabitants of the area and the County. Before a permit for a conditional use permit is issued, the Planning Commission and the Board of County Commissioners shall determine through hearings, that the following plans, methods and studies, which shall accompany the application for a conditional use permit , provide adequate protection of the health, safety and welfare of the inhabitants of the area and the county. " This determination is based upon the following: A. The proposed Development Standards for the Conditional Use Permit will provide for the adequate protection of the health, safety and welfare of the inhabitants of the area and the county. B. The permitted uses on the her-eon described property shall be the church and all other uses permitted by right in Section 3. 3B of the Weld County Zoning Resolution . 2. The single family residence may be used as a temporary sanctuary for worship. 3. The Conditional Use Permit area shall he maintained in such a manner so as to prevent -soil erosion , fugitive dust , and the growth of noxious weeds . 4 . All parking shall be provided on-site. No parking shall be allowed over any leach field area. B. All accesses to the property shall have the approval of the Colorado Division of Highways . All accesses shall be constructed in accordance with recommendations and/or requirements of the Colorado Division of Highways . 6. All sewage disposal -facilities shall comply with County and -State Health Standards and Regulations . 7. Prior to construction of the church building , a soil engineering test shall be conducted to determine proper footing design in accordance with the Weld County Building Code . 8. A sign with dimensions as shown hereon may be erected on the property. 9. No permanent structures , signs , or landscaping shrubbery shall be permitted in the 12 foot right-of—way reservation or dedication along the north side of State Highway 392 . 10. The Conditional Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or -stated above shall require the approval of another Conditional Use hermit before such changes shall be permitted . Any other changes from the plans and/or Development Standards shall be filed in the Office of the Department of Planning Services . Comments : 1. The Weld County Health Department in a letter dated April 6 , 1978 , and the West Greeley Soil Conservation District in a letter dated April 17 , 1978 , have raised concerns with this request . These concerns have been addressed in the Development Standards. • 2 . Our office has received one letter from Helen Miller , a surrounding property owner , indicating she is opposed to this request . (A copy is included in the -attached packet ) . Mrs. Miller' s signature also appears on the petition supporting the approval of this request . APPLICANT': Flatiron Paving Company CASE NUMBER: SUP-365:78 :16 LEGAL DESCRIPTION: SEt NEI, Section 30, and SW4 NW , Section 29, T2N, R68W LOCATION: fl miles north and 1 mile east of Erie SUBJECT: Addition of Asphalt Plant and ,a Concrete Batch Plant Amending SUP-260 APPEARANCE : Ed McDowell and Mike Hart DISCUSSION: This application was continued from the Planning Commission meeting on July 18, 1978, for any further information to he presented. There was concern at the last meeting regarding compatibility with the surrounding area. HIlichael Hart stated in this regard that there is a parcel of land on the south side of Road 16 and on the west side of Boulder Creek that is zoned Indust : ial . There was also concern about the potential impact of the mining operation and the difference of the impacts regarding air quality of the area. Dr. George McVeel then gave an extensive report of his investigation of the air quality as it now exists in the area and what the effects would be of the sand and gravel alone. He stated that as the operation exists now the air quality -is relatively good at the present time with the exception of some particulate matter such as dust and small amounts of other pollutants from oil and gas wells in the area and from automobiles . The impacts of the sand and gravel operation alone will produce some particulate matter as will the asphalt and concrete plant . lie stated that the impacts will be small in the long-run and on the average there will actually be a reduction of the amount of particular released into the air. Discussion followed regarding how many employees would be involved with the operation . There will be approximately 15 persons involved according to Ed McDowell . Mr. Kiefer asked if the material mined five miles upstream isbrought to the plant or will the asphalt and concrete plant use only the material that is on site. Mr. McDowell stated that the material is hauled back to Boulder and is processed further upstream i.n an asphalt plant there and used in Boulder. The concrete plant in Boulder presently has its own source of material where it is located. No material from these sites would be hauled to the proposed . Planning Commissioeinutes • Page 2 August: 1, 1978 plants and would be very uneconomical . Discussion followed where the majority of the material will be processed. Tom Bauer then expressed, his opposition to the proposal by stating that the non-particulate emissions would be trapped because the proposal is in a valley and there would also be an increase of carbon monoxide and hydrocarbons because of the increased traffic and dust . Helen Bryant stated that her father owned the property that is zoned industrial and had no intention of having an industrial operation on the land. At this time the slide presentation was again shown for the benefit of Mrs. Kountz that was prepared by surrounding property owners opposed to the proposal. Mrs. Kountz was not present for the previous Planning Commission hearing. Other persons expressing opposition because of incompatibility with the area, dust , noise, and pollution included: Ken Neuens , Dale and Lynn Johnson , John True, Mike Shaw, Carol Bultaup, Howard Rasmussen , Sandy True, Mrs. Saudee and Doris Saudee . Lucy Stromquist , also a , surrounding property owner, was concerned about the possible decrease of food production and Helen Nelson read some statistics which stated that there is 4* miles of surrounding property of which 1. 75 .miles and 410 acres represent those opposing the site and 2* miles and 960 acres . which represent those who have no objection to the proposal . Mr. Nix raised the concern of the possible conflict of interest in knowing Mr. Milton Nelson . No member on the Board felt it necessary for Mr. Nix to abstain from voting. Tom Honn then read the conditions that were to be subject to the staff 's recommendation into the record. Chairman Carlson asked for clarification as to whether it was County Road 3 or 3*: . Tom Honn stated that the memo from the County Engineer' s Office refers to it as County Road 3. Discussion followed regarding alternate routes. It was decided the County Commissioners should make this final decision . MOTION: Be it therefore resolved to recommend approval with the Development Standards using County Road 3 as the alternate route to the Board of County Commissioners with the County Commissioners to make the final decision regarding alternate routes. Motion by Frank Suckla, seconded by Ben Nix. A vote of "aye" was cast by Chuck Carlson , Ben Nix, Frank Suckla, Percy '; iatL and Bette Kountz. A vote of "no" was cast by Jerry Kiefer and Irma White. Motion carried 5 'to 2. Each member was then requested by John Houtchens regarding clarification of why each Planning Commission member voted the way they did which each member did as requested. Discussion followed regarding what had happened at various points of time. Mr. Kiefer asked if there was a time table at all. Mr. Drawer responded there was not . Mrs. White stated she was not convinced the proposal was feasible with no water and no assurance it will be carried out . Mr. Kiefer asked if there was a certain time table to carry this out and have everything in order. Mr. Drawer responded there was not . Mr. Drawer also commented in regard to the staff ' s• recommendation that he felt this would be of benefit to the county. Also stated that Mr. and Mrs. Earl Riley were opposed to this because they thought County Road 16 would be an access road, but Mr. Drawer assured them they do not want it to be an access. MOTION: Be it therefore resolved to deny the application based on the staff ' s recommendation to the Board of County Commissioners with the deletion of the last quoted paragraph and Reason ##'2 of the staff' s recommendation and the last sentence of the recommendation. Motion by . Ben Nix, 'seconded by Irma White. A vote of "aye" was cast by Chuck Carlson , Ben Nix, Frank Suckla, Jerry Kiefer, Percy Hiatt , Bette Kountz, and Irma White. Motion carried. APPLICANT: Erie Water and Sanitation District CASE NUMBER: SUP-367: 78: 19 LEGAL DESCRIPTION: Pt. SE4 NW*, Section 6, T1N, R68W LOCATION: 11 miles north of Erie SUBJECT: Wastewater Treatment Plant APPEARANCE: Keith Bell DISCUSSION: This proposal is to serve the community of Erie and is designed to accommodate the anticipated future growth of Erie and to meet the effluent standards of the Weld County Health Department , the Colorado Department of Health and the EPA. The plant will employ a maximum of three persons. The noise level will be relatively low for the type of equipment which will be used and will be housed within the building. The activated sludge process is being utilized to minimize odors. There will be some odor, but will be very slight . This particular sight was chosen because of gravity flow, is not subject to flooding, is isolated from housing , and is down wind of prevailing winds. Discussion then followed regarding the selection of the site . Tom Honn read the staff' s recommendation to continue the hearing to August 15, 1978. Chairman Carlson then calledfor comments from the audience. At this time Virginia Thurman asked who will be served if : the proposal is granted and requested more information regarding the odor. Joyce Rees expressed concern regarding the potential for flooding, and also stated that she had received a letter from the Town Clerk of Erie which stated there was gravel at the site. Mr. Bell later commented there was no gravel at all at this site. Carol Bulthaup expressed concern with odor, Shirley Koch expressed concern about flooding as did Russell Rees. Mr. Nelson has this date hand delivered a copy of the October, 1972 letter referred to in Cathy Carter 's Summary Report . Cathy Carter indicated that Bob Adams , who wrote the October, 1972 , letter was present and available for questions regarding his recollection of this matter in the past. Copies of said letter were handed out to the Planning Commission members. Cathy Carter further stated that several letters have been received in the Planning Office by the residents of Seemore Heights that are in favor of Mr. and Mrs. Nelson operation. A phone call was received just prior to this hearing by Cathy Carter from a complaining person in Seemore Heights who stressed their concern about this excavating business continuing. Chuck Saxton at this time said that witnesses am 'resent at this meeting who can testify to the fact that Mrs . Nelson aa_c given assurance in 1972 that the present use of the property was within the law and they could continue it . There were also several persons in attendance who do not think the use of the property is obnoxious to their use of the property. Negotiations have been made at this time. Kay Norton then stated that in a meeting with Mr. Bob Adams of the Planning Department Mr. Adams did in fact tell the Nelson's in 1972 they could operate their business as a family operated business under the home occupation section of the Zoning Resolution . At this point Mrs . Norton suggested that the best settle- ment would be to get precise information on the operation as it is now and to agree that the operation will not be changed or expanded in any quality or quantity from this day forward. Mr. Nelson stated that there would probably not be any equipment there if it were not for vandalism when the equipment is stored elsewhere. Cathy Carter suggested that the documentation of equipment at present by the Nelson 's be very well itemized and submitted to the Planning Office so that it does not increase and they can keep track of it. Mr. Saxton stated that it would be submitted within two weeks. SW' , Section 15, Township 6 North, Range 67 West) has been evaluated by our staff and the following recommendations submitted for your review: 1. We are concerned primarily with sewage disposal at the 1.617 acre site. Mr. Terry Bird, Pastor, has applied for a sewage disposal permit (#99, 4-5-78) . However, the church proposal states that the home will be used as a "temporary sanctuary for worship" for at least one year, as plans are not definite for building the actual church structure. 2. Also, we are concerned wit the high water table at the site. Land in the northwest section of the site exhibits salt accretion and the evidence presented by the soil conservation staff state that, "Most of the soils (Aquolls and Aquepts, flooded) are subject to excessive runoff. A water table is at or near the surface in the Spring, and during the peak irrigation season. " The request states that a drainage area will be made in this area. Kim loan type soils are found in the rest of the area and could support a sewage system. The system must be engineer designed per the Weld County Health Department's Individual Sewage Disposal System Regulations requirement 3.5.c. This design must then be approved by the Weld County Board of Health. 3. Because of lot size limitations, and high ground water potential, we would recommend that both the single family residence and the church building be tied into the same sewage disposal system, which would be sized accordingly for both structures. The high water table may preclude conventional septic systems; however, this is an engineering consideration. Proposed plans call for parking all around the church building which could pose a hazard to a sewage system located next to that building. No parking would be allowed over any leachfield area. Lines connecting building sewers to the septic tanks and running under parking areas would be required to be cast iron. In no case would a septic system be allowed in the proposed drainage area. It is to be located in the SEySE4SW4 of Sec. 15, Twp. 6N, Range 67W. The planned development is confined to a 1.6 acre area, which is made up of two soil types as indicated by our soil survey. They are Aquolls and Aquepts, flooded (85%) , and Kim loam, 1 to 3 percent slopes, (15%). The Aquolls and Aquepts soil type, which is deep and a poorly drained soil, is subject to excessive runoff and usually has a water table at or near the surface in the spring and during the peak irrigation season. The planned church building seems to be located on the Aquolls and Aquepts soil. There is no soil engineering data with the request to indicate water table depths or engineering data to indicate the necessary foundation design for water table construction. It is our feelings that some soil engineering test- ing be performed to evaluate the feasibility of constructing a building on this site. The residence building does seem to be located on the Kim loam soil which has few limitations for the construction of a septic tank filter field, but does exhibit a low strength condition for construction of dwellings with or without basements and may require soil engineering tests to determine proper footing design. The drainage area as shown on the map of the area has adequate capacity to hold surface drainage of a 10 year, 24 hour frequency storm. However, the planned capa- city may be lessened if there is sub-surface water present. The drainage basin is shown to be constructed in the Aquolls and Aquents soil type. The retention pond should also have a conduit of 2 CFS capacity to discharge additional surface runoff should the pond be full at time of another storm. The development area defined in the request is not considered prime farmland. We can see no reason, other than those sited above, why this plan should not be accepted as long as it meets the present county development plan. Our existing right of way on State Highway 392 is 138 feet: 60 feet north of centerline and 78 feet to the south of centerline. In order to meet our projected needs based on anticipated traffic increases, we require a total of 150 feet of right of way. We request that an additional 12 feet be pro- tected on the north side of the existing right of way. This can be accom- plished by reservation, setback, or dedication (preferably the latter) , as local zoning laws and regulations permit. 2. We note that some shrubbery is to be provided along the highway. We ask that this shrubbery be located outside of the 12-foot setback so that it will not conflict with potential highway improvements. 3. The existing access point is of concern to us, and we feel that it should be relocated for several reasons. Its proximity to the railroad tracks could create safety problems for vehicles slowing to enter the church property from the west. There could also be sight problems for vehicles exiting the property and proceeding west. It would also be difficult for a driver exiting the property to see a train by looking back over his right shoulder. We suggest that the access point be moved to the eastern edge of the property adjacent to the SW 4 corner line of Section 15. W4 £; `.:_ • M * _,, / - ... • /1 - Aquolls and Ague ts , flooded These nearly level soils are on smooth plains in depressions and along the bottoms of natural drainageways throughout the survey area. The Aquolls , which have dark colored surface layers , make up about 55 ' percent of the mapping unit . The Aquepts , which have lighter colored surface layers , make up about 25 percent . About 20 percent is made up of soils which are well drained and soils which have sandstone or shale within 48 inches of the surface . These are deep , poorly drained soils . They formed in recent alluvium. Typically they have mottled , mildly to moderately alkaline , loamy or clayey surface layers and underlying materials which extend to a depth of 60 inches or more . They may or may not have a gleyed layer in the underlying material. Most of these soils are subject to excessive runoff. A watertable is at or near the surface in the spring and during the peak of the irri- gation season. These soils are used for rangeland and wildlife habitat . Some small areas are used for irrigated pasture. The potential native vegetation on these soils is dominated by switch grass , prairie cordgrass , saltgrass , alkali sacaton , big bluestem, Indiangrass , western wheatgrass , slender wheatgrass , sedge and rush. Cattails and bullrush occur on swampy spots associated with this site. Much of this site has an increased amount of salts due to farming and irrigation of adjacent areas . Potential production ranges from 4000 • • pounds per acre in favorable years to 3000 pounds per acre in unfavorable years. When range condition deteriorates the tall and midgrasses decrease , production drops and saltgrass sedge and rush increase. Management of vegetation on this soil should he based on taking half and leaving half of the total annual production. Switchgrass , big bluestem Tndiangrass , western wheatgrass , pubescent wheatgrass , intermediate wheatgrass , tall wheatgrass and tall fescue are suitable for seeding. The plants selected should meet the seasonal requirements of livestock . For successful seeding, a firm, prepared seedbed -- several tillage operations will normally be needed to eliminate the undesirable vegetation-- and a grass drill should be used . Early spring seeding has proven most successful. Wetland wildlife , especially waterfowl , utilize these areas . The availability of moisture due to the wetness of this soil allows pro- duction of wetland plants that provide nesting and protective cover . as well as some food for waterfowl. The juxtaposition of this soil to irrigated cropland areas where wildlife obtain much of their food . • along with the cover provided , make this soil valuable to both wetland and openland wildlife. Openland wildlife , especially pheasants , use these areas for cover and nesting , while they also provide excellent cover for deer when found in areas inhabited by deer. Management for wildlife would include prevention of overgrazing by livestock , protection from unplanned fire , and prevention of drainage . Where livestock are present , these valuable wildlife nreas should be fenced to prevent encroachment and overuse by livestock. Capability subclass VIw Aquolls - Salt meadow range site Agnepts - Wet mcaduw rail e : ite ►ei som it Low/ 53,, X H • • 32 - Kim loam, 1 to 3 percent slope This is a deep, well drained soil on smooth plains and alluvial fans at elevations of 4900 to 5250 feet. It formed in mixed eolian deposits and parent sediments from a wide variety of bedrock. Included in this unit are some soils that have sandy loam or loamy sand underlying material. Typically the surface layer is a brown to pale brown loam about 12 inches thick. The underlying material is a light clay loam or loam about 28 inches thick. The substratum, to a depth of 60 inches is a loam or fine sandy loam. ?rmeability is moderate. Available water capacity is high. Effective rooting depth is 60 inches or more. Surface runoff is medium and erosion hazard is low. Where irrigated this soil is suited to all crops adapted to this area, including corn, sugar beets, beans, alfalfa, small grains, potatoes and onions. An example of a suitable cropping system is alfalfa 3 to 4 years followed by corn, corn for silage, sugar beets, small grain, beans and back to alfalfa. Some conservation practices such as land leveling, ditch lining and pipelines may be needed for proper water applications. All methods of irrigation are suitable with furrow irrigation the most common type used. Barnyard manure and commercial fertilizers are needed for top yields along with maintaining good organic matter content. 6 y\-•wfm i • In non-irrigated ares this soil is suited to winter wheat , barley and ,ror✓ sorghum. Most of the area is devoted to winter wheat which is alter- nated with summer fallow to allow moisture accumulation. Normally, precipitation is too low to make beneficial use of fertilizers. Good cultural practices such as stubble mulch farming, strip cropping and minimum tillage are needed to combat wind and water erosion. Terracing may also be needed to control water erosion. The potential native vegetation on this soil is dominated by blue grama. Several midgrasses such as western wheatgrass and needle and thread are also present. Potential production ranges from 1600 pounds per acre in favorable years to 1000 pounds in unfavorable years. When range condition deteriorates, the midgrasses decrease, blur grama, buffalograss, snakeweed, yucca and fringed sage increase and production drops. Undesirable weeds and annuals invade the site as range condition becomes poorer. Management of vegetation on this soil should he based on taking half and leaving half of the total annual production. Seeding is advisable if range is in poor condition. Sideoats grama, little bluestem, western wheatgrass , hlue grama, pubescent wheatgrass and crested wheatgrass are suitable for seeding. The grass selected should meet the seasonal requirements of livestock. For successful seeding, a clean , firm, sorghum stubble--prepared the growing season prior to seeding--or a firm, prepared seedbed and grass drill should be used. Early spring seeding has proven most successful. Windbreaks and environmental plantings are generally well suited on this soil. Generally all trees and shrubs adapted to this area will grow. . • • Continued cultivation to control competing vegetation should be practiced for as many years as possible following planting. Trees that are best suited and have good survival are Rocky Mt. juniper, eastern redcedar, ponderosa pine , Siberian elm, Russian olive and hackberry. Shrubs best suited are skunkbush sumac , lilac , Siberian peashrub and American plum. Wildlife is an important secondary use , with these soils best suited for openland and rangeland wildlife. In cropland areas , habitat favorable for ring-necked pheasants , mourning doves , and many non-game species can be developed by establishing wildlife areas for nesting and escape cover. For pheasants , the inclusion of undisturbed nesting cover is vital and should be included in plans for habitat development: this is especially true in areas of intensive agriculture. Rangeland wildlife , exemplified by the pronghorn antelope, can be assisted and encouraged by development of livestock watering facilities , proper livestock grazing management , and range reseeding where needed. This Kim soil has a good potential for urban and recreational development. Increased population growth in the area (county) has resulted in increased home site construction. The primary limiting soil feature for urban development and road construction is the sdils limited abil�o support a load. Septic tank absorption fields will function properly, however, community sewage systems ahould be provided if the population density is increased. The permeability of the substratum may require sewage lagoons to be sealed. Lawns , shrubs and trees for beautification will do well.
