Request for Final Release of Collateral:
The Department of Planning Services received a request from the applicant, Michael Aberle,
requesting an inspection of the property in order to obtain the final release of collateral.
Weld County Public Works and Planning Departments performed a site inspection on 5/21/09, at
the above mentioned USR site, and observed the following:
• All Public Works related items have been completed and are found to be acceptable.
Any non -Public Works -related items should be verified by Planning Services prior to collateral
release.
Recommendation:
The Department of Public Works is recommending final release of collateral.

Donna,
Michelle and I did a final inspection of the site on 5/21/09 and I believe I sent her my
usual memo stating that Public Works related items were acceptable and any collateral could
be released. Section C., page 3 of the USR-1658(Doc.#2008-3251)says the applicant will enter
into an agreement and post collateral, but if the improvements are completed satisfactorily ,
then the agreement and collateral won't be necessary. It appears that this is what happened
and you are correct that we never collected any collateral, so we had none to release.
Michelle will be able to enlighten us further on the matter and reveal if my recollection of
the matter is accurate. I now defer to Michelle.:)

The drawing submitted does not address the requirements the drilling windows on the plat.
The site is located in the Greater Wattenberg area and therefore will need to adhere to the
rule 318A. I have enclosed the requirements of 318A for your review. The applicant shall
either submit a copy of an agreement with the property's mineral owner/operators stipulating
that the oil and gas activities have been adequately incorporated into the design of the site or
show evidence that an adequate attempt has been made to mitigate the concerns of the
mineral owner/operators. Drill windows can be delineated on the plat in accordance with the
State requirements as an attempt to mitigate concerns. The plat shall be amended to include
any possible future drilling sites
318A. GREATER WATTENBERG AREA SPECIAL WELL LOCATION, SPACING AND UNIT
DESIGNATION RULE
a. GWA, GWA wells, GWA windows and unit designations. The Greater Wattenberg Area ("GWA") is defined to
include those lands from and including Townships 2 South to 7 North and Ranges 61 West to 69 West, 6th P.M.
In the GWA, operators may utilize the following described surface drilling locations ("GWA windows") to drill, twin,
deepen, or recomplete a well ("GWA well") and to commingle any or all of the Cretaceous Age formations from
the base of the Dakota Formation to the surface:
( I ) A square with sides four hundred (400) feet in length, the center of which is the center
of any governmental quarter -quarter section ("400' window"); and,
(2) A square with sides eight hundred (800) feet in length, the center of which is the center
of any governmental quarter section ("800' window").
(3) Absent a showing of good cause, which shall include the existence of a surface use or
other agreement with the surface owner authorizing a surface well location outside of a
GWA window, all surface wellsitcs shall he located within a GWA window.
(4) Unit designations.
A. 400' window. When completing a GWA well in a 400' window to a spaced formation, the
operator shall designate drilling and spacing units in accordance with existing spacing orders.
B. 800' window. When completing a GWA well in an 800' window, whether in spaced or
unspaced formations, the operator shall: (i) designate drilling and spacing units in accordance
with existing spacing orders where units are not smaller than a governmental quarter section:
or (ii) form a voluntary drilling and spacing unit consisting of a governmental quarter section;

or (Hi) where designating a drilling and spacing unit smaller than a governmental quarter
section, secure waiver(s) from the operator or from the mineral owners (if the operator is also
the holder of the mineral lease) of the lands in the governmental quarter section that are not
to be included in the spacing unit; or (iv) apply to the Commission to form an alternate unit or
to respace the area.

I do not have a detailed timeline. I am working on everything as much as possible. I have finished
addressing all requirement with Lauren Light. I have sent out a certified letter to the mineral
owners in accordance with item 1 A, and as soon as I have return confirmation I can provide you
with the letter and confirmation. I am currently working on the changes to the plat map, and will
be submitting my building applications soon. Item C should not be required as I will have all
improvements completed. Item 2 I was told that the mylar plat can be done in your office for a
fee. Please advise because if not I would appreciate it if you knew where I can get that done ( eg:
Kinkos ). I think that is about everything and hope to have everything done in about 1 -month
and hopefully will not need the three months.

7215 x4225. At the hearing the BOCC waived many of the requirements based on the nature of the
business therefore please provide a detailed timeline of when you expect to have each one the remaining

Here is the letter you asked for pertaining to my request for extension on USR-
1658.
I am asking for the full 3 -months for the $50.00 fee as stated in my paperwork. I
don't think it will take me this long, but I would prefer to have more time just in
case. In my business January - April is my slower time that will allow me to focus
more time on completing everything.
I have already spoke with public works on what I need to change on the plat, and
have already done so. I am emailing Lauren L. with Health on the few things that
she is asking for. I have filled out my application for Bldg. Dept. and just need to
meet and make sure they have everything they need. I have already purchased a
portable toilet, and it is ready for use.
This is not my profession, so I know I will have to submit and make corrections a
few times before everything is correct. This is why I am requesting the additonal
time. If you have any questions or concerns please let me know.

Re: Attempt to mitigate concerns to the Mineral Owner/Operators for USR - 1658
This is a letter required by Weld County Colorado to attempt to mitigate any concerns that you may have
concerning the oil and gas activities on my property. My property is located at 12988 C.R. #4, Brighton,
CO 80603 ( Legal Description: PT NE4 31-1-66 NW4 32-1-66 — Lot A Rec Exempt RE -4217) or (NE4
of Section 31 and NW4 of Section 32 all in TIN, R66W ). I want to make sure that you are in agreement
that the oil and gas activities have been adequately incorporated into the design of the site.
In accordance with COGCC Rule 603A which states that a well must be located 150 feet from any
Building, occupied road, and adjacent properties, there is no area of my property that would allow for
future drilling for oil and gas.
I am not making any changes to the property such as new buildings, parking lots or paved driveways. The
existing layout of the property is to remain the same, and I am planning on utilizing all existing structures.
Please contact me if you have any concerns and I will assist with anything you may need.
