Therefore we will have to push back the 11/4 hearing date for USR-1705. I spoke with the applicant - it didn't appear that any later dates in November would pose a scheduling problem for him. Thanks, Chris Gathman Planner III Weld County Department of Planning Services 918 10th Street, Greeley, CO. 80634 Ph: (970)353-6100 ext. 3537 Fax: (970)304-6498 • • 2009-2985 EXHIBIT I D Esther Gesick From: Chris Gathman nt: Thursday, November 12, 2009 8:25 AM Esther Gesick Subject: FW: Per your request Attachments: land.pdf Esther, Here is some information for the Land (USR-1705) case. It is a requirement of FAR Part 157 (Notice of Construction, Alteration, Activation, and Deactivation of Airports) to notify the FAA when establishing, altering, deactivating, or changing the status of a private or public airport. The Land Airport has complied with these notification requirements. It is the owner's responsibility to notify the FAA of changes to the airport master record (e.g., address, phone number, etc). I have attached a copy of your latest airport master record. Master records can be viewed at "www.gcrl.com". Click on airport master records on the left side. Changes can be reported to this office, or may be solicited by the Airport Safety Data Branch in Washington, D.C. It is also your responsibility to keep copies of all FAA determination letters issued to you by the FAA. Please let me know if you have any other questions. Based on this study, the Federal Aviation Administration (FAA) has no objection. Operations should be conducted in accordance with the communications requirements and restrictions of the overlying class of airspace. We recommend that a clear 20:1 approach slope he established and maintained. Please check the performance capabilities of the aircraft you intend to operate at your airport to ensure you have adequate runway length. All users of the airport should he briefed on operating conditions at the airport. This determination does not mean FAA approval or disapproval of the physical development involved in the proposal. It is a determination with respect to the safe and efficient use of airspace by aircraft and with respect to the safety of persons and property on the ground. This determination does not relieve the proponent of responsibility for compliance with any local law, ordinance or regulations, or state or other Federal regulations. In making this determination, the FAA has considered matters such as the effect the proposal would have on the existing or planned traffic patterns of neighboring airports, the effects it would have on the existing airspace structure and projected program of the FAA, the effects it would have on the safety of persons and property on the ground, and the effects that existing or proposed man-made objects (on file with the FAA) and known natural objects within the affected area would have on the proposal. The FAA cannot prevent the construction of structures near an airport. The airport environs can only be protected through such means as local zoning ordinances or acquisition of property rights. It is up to the owner to provide for this protection. No evaluation of the environmental aspects of the proposal was made in reaching this determination. Therefore, this determination is not to he construed as approval of the proposal from an environmental standpoint under Public Law 91-190 (National Environmental Policy Act of 1969).
