WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a show cause hearing on September 5, 1979 con- cerning Mountain Meadow Egg Ranch, 2790 West 175th, Erie, Colo- rado 80516 and 1234 Weld County Road 7 , Erie, Colorado 80516, on parcels of land more particularly described as follows : PARCEL I Lot 6, Ranch Eggs Inc. Subdivision, County of Weld, State of Colorado. PARCEL II The South 179. 47 feet of the following described property: A tract of land located in the South- west Quarter of Section 27, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colo- rado and being more particularly described as follows : Commencing at the West Quarter Corner of said Section 27 , and considering the West line of the Southwest Quarter of said Section 27 , to bear South 00°00' 00" West and with all other bearings contained herein relative thereto; Thence South 00°00' 00" West, along the West line of the Southwest Quarter of said Section 27 , 992 . 25 feet; Thence North 90°00' 00" East, 30. 00 feet to the TRUE POINT OF BEGINNING: Thence continuing North 90°00 ' 00" East, 799. 86 feet, thence South 31°19' 13" West, 151. 58 feet; thence South 41°31' 26" West, 267. 04 feet; thence South 90°00' 00" West. 544. 04 feet; thence North 00°00' 00" East, 329. 42 feet to the TRUE POINT OF BEGINNING. for non-compliance with Section 25-1-613 , CRS 1973, as amended, and WHEREAS, in accordance with Sections 25-1-617 , 25-1-507 and 25-1-514 , CRS 1973 , as amended, the Board of County Commissioners is authorized to hear and decide this matter, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard the testimony of representatives from the Weld N/,©o0 7 791002 County Health Department and the testimony of Mrs. Don Schwarz of Mountain Meadow Egg Ranch, and WHEREAS, the Board, being fully advised in this matter, finds that there is an open pit containing broken chicken eggs on Par- cel II described above; that piles of chicken manure are present on Parcel I and Parcel II described above; and that said open pit and piles of chicken manure are a source for the breeding of flies and endanger the health and welfare of the citizens of Weld County. NOW, THEREFORE, BE IT RESOLVED that the Board of County Com- missioners of Weld County, Colorado hereby recommends that the abovedescribed conditions be abated within two (2) weeks from the date of this hearing by the following means: 1. Clean up and dispose of the broken chicken eggs. 2. Cover the pit containing the broken chicken eggs. 3. Remove the piles of chicken manure. MORRISON HEALTH DEPARTMENT REPRESENTATIVES, JOHN HALL AND BYRON HOWELL The following business was transacted: I hereby certify that pursuant to a SHOW CAUSE NOTICE dated August 22, 1979 , duly published August 23, 1979 in the Platteville Herald, a public hearing was held on said show cause for Mountain Meadow Egg Ranch. John Hall reviewed the events that have transpired to date. He stated that on Wednesday, August 15, 1979, John Droullard and Byron Howell attempted to reinspect the properties and were refused entry by Mrs. Don Schwarz,; Therefore, the Health Department has no knowledge whether any measures have been taken to abate the health nuisance. Mrs. Schwarz was present and testified concerning the conditions on the properties. After deliberation a motion was made by Commissioner Steinmark to allow Mrs. Schwarz two weeks from the date of this hearing to abate the health hazards by the following means: 1. Clean up and dispose of the broken chicken eggs. 2. Cover the pit containing the broken chicken eggs. 3. Remove the piles of chicken manure and further that the properties be inspected by the Health Department to assure compliance. Commissioner Dunbar seconded the motion and it carried unanimously. Following discussion by the Assistant County Attorney Commissioner Roe made a motion that the Chairman of the Board be authorized to sign an order requiring abatement by the above means if within two weeks an inspection of the premises by representatives of the Health Department is not permitted by Mr. and Mrs. Schwarz Commissioner Kirby seconded the motion and it carried unanimously. Mr. John Johnson and area resident elaborated on common problems of the residents of Ranch Eggs Subdivision. Wheeler, Greeley RE: Summary Sheet Complaint Investigation Mountain Meadow Egg Ranch TO WHOM IT MAY CONCERN: By mandate of the Weld County Commisioners a surveillance program of Ranch Eggs Subdivision was initiated by Weld County Health Dept. . On July 20, 1979, John Droullard and Byron Howell inspected, with permission by the owner, the property of Don Schwartz located at 2729 W. 175th Ave. , Erie, Colorado. Found East of the chicken house was an excessive chicken manure build-up containing maggots. On July 25, 1979, John Droullard and Byron Howell also inspected with permission, the property of Don Schwartz, an Egg Processing Plant, located at 1234 WCR #7. This inspection was also a part of the Ranch Eggs Subdivision montioring programs The inspection of the aforementioned property showed excessive manure build-up which contained maggots. Also at the egg processing plant, there was an open pit containing broken eggs which were attracting rodents as evidenced by numerous rat droppings in the area. On August 1, 1979 a violation letter citing Colorado Revised Statutes Number 25-1-613 was issued to Mountain Meadow Egg Ranch, Don Schwartz, 2790 W. 175th Avenue, Erie, Colorado. Ten days were given for the excessive manure build-up including maggots to be cleaned up and disposed of. On Wednesday, August 15, 1979, John Droullard and Byron Howell attempted to reinspect Don Schwartz's properties located at 2790 W. 175th Avenue in Erie, Colorado and 1234 WCR #7, Erie, Colorado as specified in the order from the Weld County Health Department dated July 31, 1979. John Droullard and Bryon Howell were refused entry to reinspect the aforementioned properties in order to determine compliance with Colorado Revised Statute number 25-1-613 by Mrs. Don Schwartz. We also inspected your egg processing plant on Wednesday, July 25, 1979. The inspections showed excessive manure build-up which contained maggots. Also, at the egg processing plant, there was an open pit containing broken eggs which was attracting rodents as evidenced by numerous rat droppings in the area. Colorado Revised Statute number 25-1-613 provides the following: • "The board of health shall examine all nuisances, sources of filth, and causes of sickness, which, in its opinion, may be injurious to the health of the inhabitants, within its town, city, or county. . . , and it shall destroy, remove, or prevent the same as the case may require." You are hereby notified that the aforementioned items of excessive • build-up of manure, and the open pit of broken eggs attracting rodents are not in compliance with C.R.S. 25-1-613, and that you have 10 days from the date of receipt of this notification to come into compliance with 25-1-613. Colorado Revised Statute number 25-1-514 provides the following: "It is unlawful for any person, association, or cor- poration and the officers thereof to willfully violate, disobey, or disregard the provisions of the public health laws or the terms of any lawful notice, order, standard, rule or regulation issued pursuant thereto." In the event this order is not complied within the time period provided, C.R.S. 25-1-512 provides the following: ll ' Page 2 Mountain Medow Egg Ranch July 31, 1979 "The district attorney of the judicial district in which 11 a cause of action arises shall bring any civil or criminal action requested by a public health officer to abate a condition which exists in violation of, or to restrain or enjoin any action which is in violation of or to prosecute for the violation of or for the enforcement of, the public health laws and the standards, -orders, rules, and regulations of the state board of health or a county or district board of health." Coto. On Friday, July 20, 1979, we inspected your property located at 2790 W. 175th, Erie, Colorado. We also inspected your egg processing plant on Wednesday, July 25, 1979. The inspections showed excessive manure build—up which contained maggots. Also, at the egg processing plant, there was an open pit containing broken eggs which was attracting rodents as evidenced by numerous rat droppings in the area. Colorado Revised Statute number 25-1-613 provides the following: "The board of health shall examine all nuisances, sources of filth, and causes of sickness, which, in its opinion, may be injurious to the health of the inhabitants, within its town, city, or county. . . , and it shall destroy, remove, or prevent the same as the case may require." You are hereby notified that the aforementioned items of excessive build—up of manure, and the open pit of broken eggs attracting rodents are not in compliance with C.R.S. 25-1-613, and that you have 10 days from the date of receipt of this notification to come into compliance with 25-1-613. Colorado Revised Statute number 25-1-514 provides the following: "It is unlawful for any person, association, or cor- poration and the officers thereof to willfully violate, disobey, or disregard the provisions of the public health laws or the terms of any lawful notice, order, standard, rule or regulation issued pursuant thereto." Instrumentation which results in equivalent readings may be used in specific installations if approved in advance by the Air Pollution Control Division." An inspection of your sugar beet processing facility located at 1st Ave. and 13th Street, Greeley, Weld County, Colorado, was made by Ronald K. Stow, a duly delegated and qualified representative of the Weld County Health Department, on November 2, 1979. On said date, emissions from the scrubber stack were observed to be in excess of 20% opacity between the times of 3:15 pm, and 3:20 pm, with opacity readings as follows: 6 readings of 55% opacity 9 readings of 60% opacity 11 readings of 65% opacity 3 readings of 70% opacity 1 reading of 75% opacity Mr. Arthur Lee Carlson, Acting Plant Manager, was contacted at the time of the inspection and informed of the violation. Upon completion of the inspection, a copy of the attached Analytical Report of Visible Emmission Violation (Form APC-55) was given to and signed for by Mr. CarTson4 �0 ,, ' i� e, /V- 7y November 5, 1979 r"` �-- 2 Great Western Sugar Company Pursuant to the above information, and as provided by Section 25-7-115(2) , C.R.S. 1973, this letter will serve as an OFFICIAL NOTIFICATION OF VIOLATION of Regulation No. 1, as cited above. In accordance with the requirements of Section 25-7-115(3) , a conference regarding the alleged violation has been scheduled for November 19, 1979, at the Division of Envirnmental Health Services , Weld County Health Department, 1516 Hospital Road, Greeley, Colorado at 10:00 a.m, As a result of the conference a determination will be made as to whether a violation occurred and, if such violation did occur, whether a non-compliance penalty must be assessed under Section 25-7-115(5), This conference will provide Great Western Sugar Company an opportunity to submit data, views and arguments concerning the alleged violation and whether assessment of a non-compliance penalty is required. The Division may provide further opportunity for Great Western Sugar Company to respond after the conference if circumstances warrant. The amount of a non-compliance penalty is calculated in accord with the provisions of 25-7-115(5) (b) , C.R.S. 1973, and is basically equivalent to the "economic savings" to Great Western Sugar Company resulting from failure to comply with applicable air pollution control requirements.
