RE: ACTION OF THE BOARD CONCERNING PETITION FOR ABATEMENT OR REFUND OF
TAXES -PENMEN DEVELOPMENT, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, State of Colorado, at a
duly and lawfully called regular meeting held on the 9th day of March, 2009, at which meeting there
were present the following members: Chair William F. Garcia, and Commissioners Sean P.
Conway, Barbara Kirkmeyer, David E. Long, and Douglas Rademacher, and
WHEREAS, notice of such meeting and an opportunity to be present has been given to the
taxpayer and the Assessor of said County, with said Assessor, Christopher Woodruff, being
present, and taxpayer Penmen Development, LLC, not being present, and
WHEREAS, the Board of County Commissioners have carefully considered the attached
petition, and are fully advised in relation thereto.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Board concurs with the recommendation of the assessor and the
petition be and hereby is, denied, and an abatement or refund be allowed as follows:

Re: Assessment and tax liability on Accounts R4466606, R4466806, R4466706
Dear Mr. Lefebvre;
I am writing because I feel the Assessor's Office has unfairly valued the above properties. In
2006 the above accounts had tax amounts due of $5,500.12, $2,234.66 and $2,228.66
respectively. The amount due for 2007 is $10,004.44, $4,065.36, and $4,054.32.
The property has changed little since 2006. The 2007 assessment and tax liability is way beyond
any normal anticipated increase. The buildings in question are airport hangers located on the
western side of the Erie County Airport, There were little or no changes in building structure or
use between 2006 and the current assessed year 2007.
In addition there are similar buildings in the same area which are also used as hanger properties
or light commercial. I feel that the following comparable values are more realistic and should be
reflected in the true value of the above listed properties.

I feel these are reflective of the real value on similar type properties and would more closely
represent potential selling values of airport properties, especially In the present depressed
market. These properties are In the same immediate area and are of equal development and cost
parameters,
The huge disparity between our properties and the comparable properties is of great concern.
Also of great concern is the fact that the assessed value and taxes due on our properties has
more than doubled in one year without any major changes or improvements.
I request that consideration be given to a re -valuation of the subject properties reference above.
We strongly believe they are out of line with other similar properties in the same Immediate area.
We request some form of consideration or re-evaluation to bring our hanger properties in line
with others in the area. I personally feel, we could never sell these properties at the indicated
values and as such can not understand the large increases in liabilities or assessed values.
I am looking for a fair and equitable correction on the properties shown as R4466606, R4466806
and R9466706. I respectfully await your response and hopefully favorable considerations.
