Board of Assessment Appeals: You have the right to appeal the County Board of Equalization's (CBOE's) decision to the Board of Assessment Appeals (BAA). Such hearing is the final hearing at which testimony, exhibits, or any other evidence may be introduced. (Section 39-8-108.5, C.R.S.) Selecting the Arbitrator: In order to pursue arbitration, you must notify the CBOE of your intent. You and the CBOE select an arbitrator from the official list of qualified people. If you cannot agree on an arbitrator, the District Court of the county in which the property is located will make the selection. Arbitration Hearing Procedure: Arbitration hearings are held within sixty days from the date the arbitrator is selected. Both you and the CBOE are entitled to participate. The hearings are informal. The arbitrator has the authority to issue subpoenas for witnesses, books, records, documents and other evidence. Greeley, CO 80632 Dear Assessor: Enclosed please find copies of documents from Washington Mutual dated June 27, 2008. As you can see our credit limit was reduced $284,100.00 after our lender had obtained an updated home value assessment. Per a phone conversation with Washington Mutual they were valuing our property at $528,000.00. Our original credit limit was $475,000.00 and was lowered to $190,900.00 a decrease of $284,100.00 (please see supporting documentation) Also please find enclosed several properties that were sold during the appraisal time period for 2009 tax assessments. These homes have more square footage and more land than our home and selling in the $500,000- $600,000 range. We have not performed any improvements to our home in the past several years or changed any of the landscaping. Based on the home value assessment from Washington Mutual and the enclosed comp's we feel our property value decreased significantly prior to June 2008 rather than increased in value as our NOV is revealing. The NOV gives an increase in our value of $24, 977 while the comparable comp's and Washington Mutual home value assessment shows an average decrease of $150,000.00 to $200,000.00 in value.
