Dear Mr. Jaurequi:
This law firm represents Anadarko Land Corp., ("Anadarko Land"), Anadarko E&P
Company LP ("Anadarko E&P) and Kerr-McGee Oil & Gas Onshore LP ("Kerr-McGee") with
respect to your request for a waiver of timely notice of a hearing that is currently scheduled on
March 17 before the Weld County Planning Commission regarding a special use permit
application for a concrete repair and services shop ("Hearing") on property described as a parcel
generally located in the S/2NW/4 of Section 27, Township 2 North, Range 66 West, which is
hereinafter referred to as the "Property."
The Anadarko entities own mineral interests that underlie the Property and Kerr-McGee
owns oil and gas leasehold rights under the Property. This letter constitutes a waiver by them to
the receipt of timely notice of the Hearing pursuant to the requirements of Colorado Revised
Statutes §§ 24-65.5-101 et.seo.
This waiver is limited to applications for development as defined in C.R.S. § 24-65.5-
102(2) to the extent that the applications cover the Property, or portions of the Property, and to
the extent that the Anadarko entities and Kerr-McGee own minerals and oil and gas leasehold
rights under the Property. It does not in any respect apply to mineral interests or leasehold
interests owned or claimed by any other person or entity in any portion of the Property or to
notices of hearings that are required to be provided to the Anadarko entities or Kerr-McGee after
the date of this letter.
The Anadarko entities and Kerr-McGee understand that you intend to.provide this waiver
letter to representatives of Weld County.

Here is the first letter that was sent back to me. I haven't recieved my certified slip back from the
mineral owner in Texas. I do have all three reciepts though. Now if I don't get the rest in time can I still
use this letter for a future hearing or will I have to send out another one for that specific hearing? Let me
know what you think.

I apologize; I was out of town this past weekend. I don't mind giving
you a waiver onthe property, but I do not think that I have seen a plat
or any information on this property?
As you may not know, if the property encroaches KPK's well site or
leasehold fixtures above or below the ground, KPK will require a Surface
Use Agreement.
Let me know if you have more information concerning your plans to the
property in conjunction to KPK's operations in the area.

Hi Jason,
Just following up to see if you were able to look at the waiver
letter. I was hoping to get a response by today but if you could get
back to me before Monday the 16th a day prior to the first hearing
date that would be helpful and very much appreciated. I just need an
email saying that it's ok that I didn't have to notify you (The
mineral owner) within 30 days prior to the hearing date for the
business permit I am applying for. I have sent letters to the other
mineral owners as well and your company is the last mineral owner to
get a response from. I have attached the letter that I sent on march
03 to this email for your convenience.
