He has signed the Mylar and we are submitting for signatures and final recording. This project has had its challenges and I appreciate your (and staff's) continued diligence as we worked through the issues. I look forward to the next project that may bring our efforts together. Our preference would be that the color of the antenna be "orange" versus "white" and wanted to check with the county to see if there were any zoning regulations that would prohibit the use of "orange" for the antenna. The tower would not be painted and it would remain the galvanized steel color. Only the antenna would be painted. The proposed antenna will be at the 925 foot level and will be about 35.7 feet in length. This is a broadband antenna which will serve multiple broadcasters, and thus reduces the number of antennas required if each broadcaster installed their own. There is a site located near ours that has this type of antenna painted orange. Thank you for your attention to this matter. If you have any questions or I can be of any additional assistance to you, please do not hesitate to contact me. Since we lost our communication in November, I have finally reached the owner and have received the necessary data from him. He has also had the time to complete the site improvements as noted. Enclosed is the final information you required for final approval. Here are your last comments, copied from email: (Please note my comments in maroon) Larry, The only changes I have on the plat are: 1) Note #37 should read: "Fencing and gravel located within future R.O.W. shall be removed and relocated at owner's expense at time of County Road 15 road improvement" (Completed - except gravel would not be removed — it is usually reused in the road development) 2) Note #34 should be removed, it is a duplicate of notes #35 & #36. (Done) 3) The handicapped parking space should be adjacent to the entrance to the proposed building since it is to be located on a gravel (not smooth) surface. (Done) I was looking at pending conditions of approval in the file — based on the information I have in the file we will need these taken care of before the plat can be recorded: Condition 1.A — Mineral Owner's Agreement or indicate drilling window — Has this been addressed? (Email response to you — November 11, certified letter to mineral lessees/owners on 12/13/2007 and accepted on 12/19/2007 by Ronald Martin — no conditions or concerns received. Nothing proposed on this site would limit existing or future mineral development.) Condition 1.E (also 1.1 and 1.J) — I have sent an e-mail to the Health to Department to get their verification that these items have been addressed. (Noted and response to Health Department included) Condition 1.H — Just a letter of acknowledgement that the pertanent requirements of the Fire District will be addressed is needed. (Included in this letter) Condition 1.L — Unless fencing, landscaping, gravel, access improvements have been completed. The applicant will need to complete an on -site improvements agreement along with collateral for any of these improvements that have not been completed. (Owner has completed improvements during this review time) Let me know if you have any questions. It would be easiest to submit these completed items with the plat rather than piecemeal for tracking purposes. FYI: I will be out of the Office beginning next Wednesday 11/19 until Thursday 12/4. If you have any questions/items regarding this case you can direct them to Kim Ogle. (END OF EMAIL) Here are the remaining items that were required for completion as noted above. Planning DATE: December 12, 2007 FROM: Pam Smith, W.C. Department of Publ Health and Environment CASE NO.: RE -4748 NAME: Mario Calderon Environmental Health Services has reviewed this proposal; a review of the Department's files finds a septic permit for the address 5602 CR 15 (SP -9900235) exists on the property. It is unclear which lot this system will reside on after the RE. The application states that an application for an RV storage facility and park is being considered parallel to this RE application. The following conditions are recommended to be part of any approval: 1. A Weld County Septic Permit is required for any proposed septic system(s) and shall be installed according to the Weld County Individual Sewage Disposal Regulations. Please note, the lot owners shall verify with the nearest Town/City or Sanitation District to determine the location of the nearest sewer line. In accordance with the Weld County Code, if a sewer line exists within 400 feet of the property and the sewer provider is willing to serve the proposed structure, a septic permit cannot be granted by the Weld County Department of Public Health and Environment. 2. All septic systems must be located on their respective lots and meet all lot line set back requirements. Additionally, please note that the Department will provide additional comments in the USR referral. M./AA LiUKt. Maxcure Wax White CRD has been formulated to form a membrane film that will allow a moisture loss no greater than 0.030 g/cm' when tested in accordance with Corp of Engineers procedures. The white pigment increases reflectance proper- ties, cooling the freshly poured concrete. Reflectance reduces surface temperature, thus minimizing vapor pressure and moisture loss. USES Maxcure Wax White CRD is ideal for curing concrete that will be exposed to the sun, such as bridge decks, piers, highways, pavement slabs, airport runways, parking decks, sidewalks, ramps, curbs and gutters. BENEFITS • Contributes to LEED EQ Credit 4.2 • Water -Based: Low odor • VOC Compliant: Meets stringent requirements • Clean-up with water • Approved by many state DOTs • Minimizes thermal cracking, dusting and defects • Performance: Produces hard, dense concrete • Strength: Increases compressive and tensile strength over untreated concrete • Consistent: Strict Quality Control testing and standards STANDARDS Maxcure Wax White CRD meets and exceeds the require- ments of CRD C-300, ASTM C-309 Type II, Class A and AASHTO M-148 as tested in accordance with ASTM C-156 and AASHTO T-155. SURFACE PREPARATION Maxcure Wax White CRD should be applied to freshly placed concrete as soon as the surface water has dissipated. On ex- terior, vertical surfaces, Maxcure Wax White CRD should be applied to concrete immediately upon removal of the formwork. COVERAGE Approximately 200 ft'/gal (4.9 m2/L). Coverage may vary depending on porosity of surface. MIXING For best results, mix thoroughly before each use. Do not over agitate or use high speed mixing equipment. Available in 40 standard colors, BRICKFORM Antique Release can also be custom - matched to almost any color. Use BRICKFORM Antique Release and BRICKFORM Texture Mats over BRICKFORM Color HardenerTM to create the look and feel of many natural materials. FEATURES • Easy -To -Apply Powder • Prevents Concrete Buildup • Streak -Free, Fade -Resistant • Unlimited Color Combinations PRODUCT DESCRIPTION • Made with the finest ultra -violet -resistant pigments available, BRICKFORM Antique Release stands up to the effects of sunlight. BRICKFORM Antique Release is designed to be streak -free and is made from a finely ground formula that works with polyurethane, texturing mats to create a beautifully antiqued and textured concrete surface. USES • BRICKFORM Antique Release is broadcast onto the concrete surface, prior to the placement of mat -type texturing tools or rollers. The release prevents the concrete from adhering to the texturing mats A portion of the release becomes imbedded into the concrete, usually where there is relief in the texturing tool, leaving behind an antiqued appearance. BRICKFORM Antique Release can be used in matching or contrasting colors to create a variety of effects. A combination of colors can add interesting shadings and highlights to the finished concrete surface. LIMITATIONS • BRICKFORM Antique Release should not be used as the primary coloring agent. It should be applied over freshly placed, still plastic, color -hardened or integrally colored concrete surfaces. COLORS • BRICKFORM Antique Release is available in 40 standard colors to match or contrast with BRICKFORM Color Hardener. Custom colors and color matching are also available. PACKAGING • BRICKFORM Antique Release is packaged in convenient 31 -pound, moisture -resistant, plastic pails. COVERAGE • The rate of application for BRICKFORM Antique Release will vary depending upon the depth of the texturing -mat impressions, the degree to which the concrete has been set, and the intensity of the contrast desired. Generally, 3.5 pounds or more per 100 square feet is required. STORAGE • Store in a cool, dry place, away from acids and strong oxidants. Do not store in temperatures exceeding 48.8°C (120"F). Keep containers tightly sealed. Shelf life is approximately 1-2 years. CAUTION • KEEP OUT OF REACH OF CHILDREN. Before using or handling, read the Material Safety Data Sheet and Warranty. DO NOT TAKE INTERNALLY. All concrete finishers and all onsite personnel must wear an OSHA-NIOSH approved dust respirator while applying or working around this product. Avoid contact with skin and eyes. Wear rubber gloves to protect skin and safety eye goggles. Close containers after each use. Use good hygiene when handling this product and wash and bathe after each use. Be sure to wash clothing after each use. PREPARATION • BRICKFORM strongly recommends representative jobsite samples. Individuals who will be performing the work should use the specified materials, as well as the finishing and curing techniques that will be used on the project. Before applying BRICKFORM Antique Release, protect all surrounding areas to reduce the possibility of staining during application and removal. BRICKFORM Antique Release may be applied to the surface of the freshly placed concrete as soon as all standing water has disappeared from the concrete surface. Typically, concrete has, at least, a fresno finish. However, if BRICKFORM Color Hardener has been applied, the finishing will be more extensive. APPLICATION • BRICKFORM Antique Release should be broadcast by hand or with the use of a 6" mason's brush until a thin, uniform layer covers the concrete surface to be textured. BRICKFORM Antique Release should not be broadcast for more than a few feet or from above the knee. Avoid windy conditions. Over -application will decrease detail of the texture. Do NOT trowel the material into the concrete. Application of texturing mats may begin as soon as the release agent has been applied. BRICKFORM Antique Release should be removed from the concrete surface when removal can be safely accomplished, without any damage to the curing, concrete surface. Excess release agent may be swept from the slab. Residual BRICKFORM Antique Release may be removed to the degree desired, using a garden hose equipped with a nozzle, by scrubbing, or by buffing. Care must be taken not to damage the curing, colored -concrete surface. The amount of BRICKFORM Antique Release adhering to the concrete surface will depend upon how hard the concrete surface was at the time of application and texturing. A softer surface will retain more release agent than a harder concrete surface. If too much Antique Release remains on the surface after rensing use Antique Release RemoverTM. Following the BRICKFORM Antique Release/ Efflorescence Remover Technical Information Sheet, SEALING • After the concrete has been allowed to cure for 28 days, protect the surface with BRICKFORM GemsealTM or PolysealTM-High- Gloss Sealer, BRICKFORM MastersealTM-Abrasion-Resistant Sealer, or BRICKFORM SatinsealTM-Water-Based, Semi -Gloss Sealer. BRICKFORM Color Hardener should be applied, using the broadcast method, at the rate of at least 60 pounds per 100 square feet in two applications. Pastel shades or light colors may require up to 60 pounds per 80 square feet. The first application requires at least 40 pounds per 100 square feet. The second application should give complete and uniform coverage. Wood -float the concrete surface after the first application, but do not trowel. Subject: RE: USR 1640, Calderon Property - 5602 WCR 15 Larry, The only changes I have on the plat are: Note #37 should read: "Fencing and gravel located within future R.O.W. shall be removed and relocated at owner's expense at time of County Road 15 road improvement." Note #34 should be removed, it is a duplicate of notes #35 & #36. 3) The handicapped parking space should be adjacent to the entrance to the proposed building since it is to be located on a gravel (not smooth) surface. I was looking at pending conditions of approval in the file — based on the information I have in the file we will need these taken care of before the plat can be recorded: ondition 1.A — Mineral Owner's Agreement or indicate drilling window — Has this been addressed? (Condition 1.E (also 1.1 and 1.J) — I have sent an e-mail to the Health to Department to get their verification Tat these items have been addressed. $ondition 1.H — Just a letter of acknowledgement that the pertanent requirements of the Fire District will be addressed is needed. Xdp1.L — Unless fencing, landscaping, gravel, access improvements have been completed. The plicant will need to complete an on -site improvements agreement along with collateral for any of these improvements that have not been completed. Let me know if you have any questions. It would be easiest to submit these completed items with the plat rather than piecemeal for tracking purposes. FYI: I will be out of the Office beginning next Wednesday 11/19 until Thursday 12/4. If you have any questions/items regarding this case you can direct them to Kim Ogle. Subject: RE: USR 1640, Calderon Property - 5602 WCR 15 Larry, I went through the record for this case to see what was approved/discussed as far as screening and landscaping. I am fine with Mr. Cglderon fencing his entire frontage. There should be two items shown on the plat for this: A note indicating the fence is located within the future road Right -of -Way for County Road 15 and will need to be relocated at the property owners expense if and when it is required by Weld County or the City of Dacono. 2) We need clarification on the plat as to what will be located behind the fence within the future ROW for County Road 15 (is it just existing grass? — I am assuming no further improvements will be placed within this location). As stated previously, the parking area needs to be located outside if the future right-of-way. FYI on the sign: Mr. Calderon would be able to install a 16 -square foot sign. Any sign larger than this would require a variance. No changes to the legal description are required since it is located on Lot A of RE -2914. Let me know if you have any questions. I didn't know where we were....(I've included Don Carroll in this response) As for the landscaping and sign - I've talked to the owner and he is wanting to fence his entire frontage, aligning the new fence with the neighboring fences. He understands that as some point the fence would be moved, but is confident that it will not be soon. If this would be acceptable, we can revise the site plan to show - a 6' vinyl fence along the street frontage and we'll remove the landscaping and sign notes and not have to wait for a response from Dacono. As for the RE-4748...it did not affect this lot and the boundary for Lot -A is the same - the only lot affected was Lot - B of RE -2914, does this give you the information required? As for the scale - let me know, I can change to 1:40 pretty easily, but it would take 2 sheets for 1:20. Thanks for this dialogue - it helps with expediting the solutions to these questions! Property - 5602 WCR 15 • Page 2 of 4 Larry, Sorry for the delay in response. I am still working on Calderon. I have been looking into this matter. I forwarded your e-mail to Don Carroll with Public Works to get there opinion on bullet points #2 and #4. His suggestion was to contact the Town of Dacono re: allowing landscaping in the future ROW. I have left a message for the Dacono Planning Department and am waiting for a response. In regards to bullet point #1: The Calderon RE plat (RE -4748) was recorded in July. So the legal description should reflect this (there is a lag time between recording and when it is inputted in the Clerk and Recorders system). In regards to the scale. I am not that concerned/feel that strongly about this one. The reason for the scale change was to ensure that you maintained an even scale if the drawing was halved in size (1 = 40) or doubled in size (1 = 10). You do not get this with a 1=30 scale. Let me know if you have any questions. I sent a certified Jett•o Jennifer Krieger in Dacono, to satisfy thtlunty requirement of notification and then continued the dialogue via email. (see the email thread below) We now have this part completed and Dacono is not interested in annexing this site. I have revised the site plan with your comments, but would like further clarification from you on a couple of items before I resubmit the latest paper review copies. • You asked for a revised legal description, but the included legal matches the current county records - what data would you like revised? There is a new RE on an adjacent lot, but it did not affect this property. • There is a comment to move parking outside of future ROW - done, but then added was the comment to move the landscaping and sign, as well. We are requesting that this be done at time of road improvement as there is no current expansion planned or land dedicated to this future ROW width on adjacent properties. (Owner would furnish letter to remove and reinstall improvements at his expense at time of expansion) • The comment on site plan scale to 1:20 where the current scale is 1:30. I am curious if this is to create 2 sheets - as the complete plan with notes will not fit on one if the scale is changed. Please state reason for scale requirement. • As for the Public Work comments, all items are addressed with this current plan - no significant drainage impact since all parking/drive areas are/will be surfaced with pervious materials. Thanks for taking the time to respond electronically as this will expedite this process. I know you are taking over Roger's files and I appreciate your help.
