MEMORANDUM
DEC 057nnA
RECEIVED
TO: Kim Ogle, Planning Services DATE: December 3, 2008
FROM: David Snyder, E.I., CFM, Public Works
SUBJECT: 4th AmUSR-552, Duke Energy Field Services
The Weld County Public Works Department has reviewed this proposal. Comments made during this phase of
the process may not be all-inclusive, as other concerns or issues may arise during the remaining application
process. This project falls primarily under the purview of the Use by Special Review Standards, Weld County
Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows:
COMMENTS AND REQUIREMENTS:
WCR 43 is a major arterial road, which requires a 140 -foot right-of-way at full build out. There is presently a
60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
Access: Utilize existing access
The applicant shall indicate specifically on the plat the type of right-of-way/easement that exists on the
property.
oovide contours for the site and 200' offsite with minimum 2 -foot contour intervals.
Storm Water Drainage:
A final drainage report stamped, signed, and dated by a professional engineer licensed in the State of
Colorado is required and shall conform to Weld County CODE 24-7-130.D and Ordinance 2006-7. All offsite
flows must be taken into account and routed through or around the site. If retention is proposed, a variance
request must be sent to the County Engineer and the water must drain in 72 hours.
The historical flow patterns and runoff amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.
pc: 4th AmUSR-552
The applicant shall address the comments listed above for this review process. Issues of concern must be resolved with
the Public Works Department prior to recording.
