Comments made during this phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS AND REQUIREMENTS: WCR 43 is a major arterial road, which requires a 140 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Access: Utilize existing access The applicant shall indicate specifically on the plat the type of right-of-way/easement that exists on the property. oovide contours for the site and 200' offsite with minimum 2 -foot contour intervals. Storm Water Drainage: A final drainage report stamped, signed, and dated by a professional engineer licensed in the State of Colorado is required and shall conform to Weld County CODE 24-7-130.D and Ordinance 2006-7. All offsite flows must be taken into account and routed through or around the site. If retention is proposed, a variance request must be sent to the County Engineer and the water must drain in 72 hours. The historical flow patterns and runoff amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. North Weld County Water District supplies water to the site (account 1811000) and there is an existing septic system for sanitation needs (SP -0600025). We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Pen -nit application from the Air Pollution Control Division (APCD), Colorado Department of Health and Environment. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. 2. In the event the applicant intends to utilize the existing septic system at the control building and the number of employees using the septic system exceeds 6, the septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 3. The applicant shall submit a dust abatement plan, for on site dust, for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. • • • 4. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirement be incorporated into the permit as a condition that must be met one month prior to construction activities: 1. The applicant shall submit evidence of a Colorado Discharge Permit System or CDPS permit from the Colorado Department of Public Health and Environment (CDPH&E), Water Quality Control Division, to cover stormwater discharges from construction sites (5 CCR-1002-61) Alternately, the applicant can provide evidence from CDPH&E that they are not subject to the CDPS requirements. We recommend that the following requirements be incorporated into the permit as development standards. 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. Fugitive dust shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan" at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended. 2 • • • 7. All potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). 8. The facility shall utilize the existing public water supply.(North Weld County Water District) 9. Adequate toilet facilities (portable toilets) shall be provided during the construction of the facility. 10.Adequate handwashing and toilet facilities shall be provided for employees, at all times. 11.Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 12. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 13. A geotechnical engineering report preformed by a registered State of Colorado engineer shall be required. The current codes are 2006 International & 2008 National Electrical Codes. 2 A plan review shall be approved and a permit must be issued prior to the start of construction. 3 Setback and offset distances shall be determined by the 2006 International Building Code (Offset and setback distances are measured from the farthest projection from the structure). 4 Buildings located within a 100 year flood plain require a Flood Hazard Development Plan. 5 A letter from the Fire District to ascertain if a FPD permit is required.
