A public hearing was conducted on April 22, 2009, at 10:00 a.m., with the following present:
Commissioner William F. Garcia, Chair
Commissioner Douglas Rademacher, Pro-Tem
Commissioner Sean P. Conway
Commissioner Barbara Kirkmeyer
Commissioner David E. Long
Also present:
Acting Clerk to the Board, Jennifer VanEgdom
County Attorney, Bruce Barker
Planning Department representative, Chris Gathman
The following business was transacted:
I hereby certify that pursuant to a notice dated March 12, 2009, and duly published March 20, 2009,
in the Greeley Tribune, a public hearing was conducted to considerthe request of the Henry Spade
Jr. Estate; Mary Lou Spade; Roger Spade, and Pamela Brenkle, c/o James Anderson, dba QM
Company, do Ditesco, LLC, Attn: Keith Meyer, for a Site Specific Development Plan and Use by
Special Review Permit #1692 for a Use Permitted as a Use by Right, Accessory Use, or Use by
Special Review in the Commercial or Industrial Zone Districts (masonry contractors shop) in the
A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record.
Chris Gathman, Department of Planning Services, stated the applicant has provided a letter, dated
March 17, 2009, requesting that the application be withdrawn. He confirmed the applicant was
intending to purchase the property; however, the applicant is no longer pursuing the purchase of
the property. He further confirmed staff recommends approval of the request for withdrawal.
No public testimony was offered concerning this matter.
Commissioner Rademacher moved to approve the withdrawal request of Henry Spade Jr. Estate;
Mary Lou Spade; Roger Spade, and Pamela Brenkle, c/o James Anderson, dba QM Company, c/o
Ditesco, LLC, Attn: Keith Meyer, fora Site Specific Development Plan and Use by Special Review
Permit #1692 for a Use Permitted as a Use by Right, Accessory Use, or Use by Special Review
in the Commercial or Industrial Zone Districts (masonry contractors shop) in the A (Agricultural)
Zone District. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously.
There being no further discussion, the hearing was completed at 10:05 a.m.
