RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST MARIE PIXLER FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Marie Pixler, ZCV #0800230, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of January, 2009, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Marie Pixler, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until April 13, 2009, to allow adequate time for the property owner to complete the
screening of the noncommercial junkyard from all adjacent properties and public rights -of -way to
bring the subject property into compliance and for an inspection of the property by the Department
of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0800230 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Marie Pixler to remedy the violation of the Weld County Code, and
any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties, with an instruction for delay of action
upon such referral until April 13, 2009, to allow adequate time for the property owner to completely
screen the noncommercial junkyard from all adjacent properties and public rights -of -way to bring
the subject property into compliance.

last or currently registered under the property owner and/or tenant's name.

During our on -site inspection, we discussed your intent to construct an opaque fence around any
DERELICT VEHICLES, the boat and the little bit of miscellaneous items on the North side of the shed.
Hopefully by scheduling this hearing out until January you will have enough time to finish construction
of the fence; however, if you do not, you can request a small extension from the Board at the above
referenced hearing. If you feel you have finished prior to the hearing, please call me so a final
inspection can be conducted. If the property is deemed to be in compliance, the hearing will be
cancelled.
RECOMMENDATION
The Department of Planning Services recommends this case to be referred to the County Attorney's
Office for immediate legal action.

Upon a visual inspection of the property, the following
items were noted: derelict vehicles and miscellaneous
debris. No pitures were taken during this inspection.
Marie Pixler (303-857-0529) called. She said she went
through a divorce 2 years ago this coming January. She
is just getting some extra time to start cleaning out the
barn so she can move the vehicles back into the barn.
Her brother (who bought a couple of the vehicles) lives in
Georgia. He is checking into seeing how much it would
cost to have it towed. I told her I would send her a 60
day letter. I explained that she needs to keep track of
what she is able to accomplish during this 60 days and
make sure to call me before the end of the 60 day
extension. I explained that if I do not hear from her my
next step is to schedule a Violation Hearing and once a
hearing has been scheduled, I do not cancel them. She
said she just wrote it down on her calendar.
Marie Pixler (303-857-0529) called. She advised that
she thinks she is close to being done. She asked how
long of an extension she could have. I explained that I
would push out any violation hearing until January 13th.
If she were done before the 13th, it would cancel the
hearing; otherwise, she could request additional time
directly from the Board at the Violation Hearing. She
asked what my expectations were. I explained that I
would be happy to meet her on the property to go over all
the remaining items. She said that would be great. We
scheduled an appointment for 11/24/08 @ 3:00 pm.
During an on -site inspection with Marie, the following
items were discussed: her son has a boat that he will be
taking home (out of state) sometime after winter. Her
brother (out of state) has 1 or 2 cars that he plans on
removing by July of next year. We discussed the
installation of a fence. We discussed that the fence has
to screen the debris and vehicles from all adajacent
properties and public rights -of -ways. I re-itterated that if
it was done prior to the hearing on the 13th of Jan, the
case would be closed and the hearing cancelled. If not,
she would need to request additional time from the
Board. She said she understood.

the action necessary to correct the violation, and that you were given sufficient time to remedy

After our conversation, it is my understanding that you are in the process of cleaning out
the barn and once you have been able to do so, you will be re -locating any remaining items
inside the barn. You also indicated that you have sold a few of the DERELICT VEHICLES
to family members, who will not be immediately able to remove the vehicles. Hopefully by
granting this 60 day extension, it will allow you time to continue to make progress.
As we discussed, if you should need additional time, please do not forget to call me prior to
the end of this time period so an additional extension might be granted.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have until
11/24/2008, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the
County Attorney's Office for legal action.

It has come to the attention of the Department of Planning Services staff that the uses on your property may
not be in compliance with the Weld County Code, Chapter 23. The potential noncompliance(s) with the
Weld County Code are as follow:
While the presence of a NONCOMMERCIAL JUNKYARD consisting of DERELICT
VEHICLES and miscellaneous debris is an allowed use within an Agriculturally zoned
subdivision, such as Aristocrat Ranchettes, it must be completely SCREENED from all

operational at all times and evidence of current registrations shall be submitted to this
office.
