The Weld County Public Works Department reviewed the submitted application for critical items,
including but not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical
Soils Report, and Flood Hazard Development Permit. A detailed review of these items was not
complete at this step in process. Comments made during this stage of the review process will
not be all inclusive, as revised materials are submitted other concerns or issues may arise. All
issues of concern and critical issues during further review must be resolved with the Public
Works Department.
Weld County Road Classification Plan (FHU): (June 2002) WCR 51 is a local paved road
and requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way.
This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
Our most recent average daily traffic count for WCR 51 between WCR 16 and the 1-76 Frontage
Road reflect 277 vehicles taken 7/9/2009. The 85th percentile reflects 62 mph, 31% are trucks.
Access: The applicant shall utilize the existing paved access to the facility with no additional
accesses granted.
Off-street parking spaces including the access drive shall be surfaced with asphalt, concrete or
the equivalent and shall be graded to prevent drainage problems.
Adjacent to the equipment storage is a gravel parking lot for trucks and equipment of the
farming operation or the airport. The main runway, taxi ways, and the cross wind runway are
either asphalt or concrete.
Residential Houses: House No. 1 accesses from the paved driveway with a secondary gravel
access back to WCR 51. The distance between the two access points is approximately 100
feet.
Road Access Policy: (Policy Established Sec. 8-2-10)
Direct access from a public road will be limited to one (1) per legal parcel, except as further
limited or restricted by zoning or subdivision regulations. Additional accesses may be approved
by the Department of Public Works or the Board of County Commissioners. This policy shall
apply to all new and existing accesses within the unincorporated areas of the County.
Properties within municipalities or other counties which access County roads are subject to this
policy.
Justify in writing the need for a second access for a small parcel.
House #2 has direct access to WCR 51 with a paved approach and adequate parking.

Access: The main access to the Land Airport has been paved. No. 1 and 2 both share this
existing access point. The paved section leads to the office, hanger areas, equipment shed, and
taxi ways. Utilize this main access for your farming operation and airport facility.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the
property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other
than grasses, needs to be maintained at a maximum height of 12 inches until the area is
completely developed.
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your
agricultural operation.
Traffic Study: No traffic study will be required at this time. The applicant is indicating that
during the weekends, the average vehicle traffic count is approximately 10 cars or light trucks
per day with an additional four trips in and out by heavy trucks or farming equipment. There is
also additional truck traffic during harvest season. Vehicle traffic related to the airport averages
about four car trips per day. There are eight airplanes currently houses in the enclosed
hangers. This number is expected to increase to 15 or more.
Storm Drainage:
The Weld County Public Works Department reviewed the submitted application for critical items,
including but not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical
Soils Report, and Flood Hazard Development Permit. Comments made during this stage of
the review process will not be all inclusive, as revised materials are submitted other
concerns or issues may arise. All issues of concern and critical issues during further
review must be resolved with the Public Works Department.
Preliminary Drainage Report: A preliminary drainage report was not required. However a
water quality control feature is being required. The applicant submitted calculations indicating
that a water quality control feature needed to be 0.0129 ac -ft in size. The applicant appears to
have used a 12 -hour drain time for the calculations. Typically, the 40 -hour drain time should be
utilized. Please resubmit the calculations using a 40 -hour drain time.
The water quality feature needs to be placed in a drainage easement so that it is not removed
with future site development activities. Please revise the map to show the water quality feature
in a drainage easement. Please provide a metes and bounds description for the easement on
the map.
Please add a not to the map stating "Weld County is not responsible for the maintenance of
drainage related features."
Floodplain: The northern end of the property is located in the Jim Creek floodplain as mapped
by FEMA. A note on the map indicates that all grading of the runways will be at grade. Future
development of the site that occurs in the FEMA mapped floodplain will require a flood hazard
development permit.

Environmental Health Services has reviewed this proposal for a private airport. Water
for the house (6509 CR 51) and the office (6511 CR 51) is provided by a domestic well
(permit 90875) which specifically states "This well is approved for domestic use,
including drinking and sanitary facilities in an associated small office". Water for the
house addressed as 6513 CR 51 is provided by a domestic well (permit 186153).
Individual sewage disposal systems (ISDS) provide sewer provisions for the three
structures. The residence located at 6509 CR 51 is served by ISDS permit G-19950066
and is sized for 4 people. The office located at 6511 CR 51 is served by ISDS permit
SE -0400036 and is sized for one person. The residence located at 6513 CR 51 is
served by ISDS permit SP -9900303 and is sized for 4 people.
The application indicates there are 6 people who are associated with the airport. If the
restroom facilities in the office or existing residences will be used for those people, the
system must be evaluated by an engineer for the increased flow.
Dust abatement and waste handling plans are required. In addition, all products must
be stored in compliance with manufactures recommendations.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan, for on site dust, for review and
approval, to the Environmental Health Services, Weld County Department of
Public Health & Environment.

2. In the event the applicant intends to utilize the existing septic system at the office
or one of the existing residences, for the airport, the septic system shall be
reviewed by a Colorado Registered Professional Engineer. The review shall
consist of observation of the system and a technical review describing the
systems ability to handle the proposed hydraulic load. The review shall be
submitted to the Environmental Health Services Division of the Weld County
Department of Public Health and Environment. In the event the system is found
to be inadequately sized or constructed the system shall be brought into
compliance with current Regulations.
3. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Any airplane or equipment washing areas shall capture all effluent and prevent

discharges in accordance with the Rules and Regulations of the Water Quality
Control Commission, and the Environmental Protection Agency.
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in Section 14-9-30 of the Weld County Code.
8. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
9. Adequate hand washing and toilet facilities shall be provided for employees and
patrons of the facility, at all times.
10.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. The facility shall utilize the existing commercial well. (Permit 90875)
11. The applicant shall comply with all provisions of the State Underground and
Above Ground Storage Tank Regulations.
12.All potentially hazardous chemicals must be stored secure, on an impervious
surface and handled in a safe manner in accordance with product labeling and in
a method that minimizes the release of hazardous air pollutants (HAP's) and
volatile organic compounds (VOC's).
13. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
14. This application is proposing a well as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. domestic use only, etc.
Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.
15. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Kim, this is in regard to a Notice received from your office regarding Parcel # 130531000027, owned by Mr. Lloyd
Land, Ale Partnership. On October 8, 2008, the Hudson Planning Commission considered the matter and asked
that I advise you that we do not have an immediate interest in pursuing annexation of this property. We have no
objection to the USR proposal. However, in the future if Mr. Land develops the site further we would again like to
consider annexation.
I cannot find our record of responding to the Notice last October. I apologize for the confusion.

Dear Mr. Gathman:
We have reviewed the above referenced proposal for an extension or expansion of the non-
conforming use (private strip/airport) for the property located in the E 1/2 of Section 31, Township 2 North,
Range 64 West of the 6th P.M.
Since the submitted material does not appear to qualify as a "subdivision" as defined in §30-28-
101(10)(a), C.R.S., pursuant to the State Engineer's March 4, 2005 memorandum to county planning
directors, this office will only perform a cursory review of the referral information and provide comments. The
comments will not address the adequacy of the water supply plan for this development or the ability of the
water supply plan to satisfy any County regulations or requirements. In addition, the comments provided
herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a
well permit, or the physical availability of water.
According to the submitted information, there are two existing wells that supply water to the property.
The wells were identified as permit nos. 90875 and 186153. Well permit no. 90875 is being used for an office
at 6511 WCR 51 and the south house at 6509 WCR 51. Well permit no. 186153 is used to supply the north
house at 6513 WCR 51.
Well permit no. 90875 is permitted for a pumping rate of 15 GPM, annual withdrawal of 5 acre-feet
and use of domestic including drinking and sanitary facilities in an associated small office and 1/4 acres of
lawn irrigation. Well permit no. 90875 was permitted for the nontributary Laramie -Fox Hills aquifer and the
well was constructed on July 28, 1977.
Note that the status of well permit no. 90875 as currently permitted is as exempt commercial well.
For your information, pursuant to Section 37-92-602, C.R.S., permits for commercial exempt wells are
available for small businesses that either are on lots that were created prior to June 1, 1972 or by exemption
to the subdivision regulations or are on tracts of land of 35 -acres or more where the proposed well will be the
only exempt well on that tract and the only well servicing that business. The use of the ground water from
this type of well is limited to drinking and sanitary facilities inside a commercial business. Water from this
type of well shall not be used for lawn or landscape irrigation or for any other purposes outside the business
building structure. Commercial uses that would not qualify under the exempt statutory provision are motels,
kennels, horse -boarding operations, feedlots and business with outside uses. Since, well permit no. 90875
also allowed for 1/4 -acre of lawn irrigation, this well does not qualify under the commercial exempt statutory
provision therefore the applicant needs to apply to the State Engineer's Office to change the status of this
permit from commercial exempt to commercial non-exempt, by submitting the General Purpose application

(form GWS-45), Non -tributary Ground Water Landownership Statement (form GWS-1) and the Non -tributary
Landownership of Consent Verification Notice (form GWS 43) with the appropriate fee of $100. The permit
application forms may be downloaded from the Division of Water Resources web site at:
www.water.state.co.us.
As an option, if well permit no. 90875 is used solely for drinking and sanitary purposes and the well is
not, and will not, be used for irrigation proposes the applicant can request to have the irrigation use removed
from the existing permit. If the irrigation use is removed then the well would qualify as commercial exempt
and this office would have no objection to the use of well permit no. 90875 to supply water to the office at
6511 WCR 51 and the south house at 6509 WCR51.
Well permit no. 186153 is permitted for a pumping rate of 15 GPM, annual withdrawal of 0.55 acre-
feet and use for ordinary household purposes inside one single-family dwelling, the watering of not more
than four (4) large non-commercial domestic animals and the irrigation of not more than 4,000 square -feet of
home gardens and lawns. Well permit no. 186153 was permitted for the non tributary Laramie -Fox Hills
aquifer and the well was constructed on October 9, 1995. This office has no objection to use well permit no.
186153 to supply the north house at 6513 WCR 51, as long as the well is being used within the conditions of
approval of the well permit.
