HomeMy WebLinkAbout20090856RESOLUTION RE: ESTABLISH PUBLIC HEALTH AGENCY, DESIGNATE SIGNATORY AUTHORITY, CLARIFY SCOPE OF WORK, AFFIRM MEMBERSHIP OF WELD COUNTY BOARD OF PUBLIC HEALTH, AND AFFIRM APPOINTMENT OF DR. MARK WALLACE AS DIRECTOR WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, S.B. 08-194, signed into law by the Governor of the State of Colorado on June 3, 2008, revised nearly all of the public health statutes contained in Title 25 of the Colorado Revised Statutes, and WHEREAS, pursuant to Section 25-1-506(1), C.R.S., each county, by and through a resolution of its board of county commissioners, must establish and maintain a public health agency or participate in a district public health agency, and WHEREAS, by letter dated March 16, 2009, the State of Colorado Department of Public Health and Environment (CDPHE) has requested that the Board provide the official name of the public health agency thus established by the Board, designate the signature authority for the established agency, and clarify the scope of work for the established agency, and WHEREAS, pursuant to Section 25-1-508(1), C.R.S., each board of county commissioners, after adopting a resolution to establish and maintain a public health agency or participate in a district public health agency, must appoint a county board of health, which, for Weld County, pursuant to Section 25-1-508(2)(d), C.R.S., shall be the Board of Health as established in the Weld County Home Rule Charter, with such duties and responsibilities as detailed therein, and WHEREAS, pursuant to the provisions of the Weld County Home Rule Charter, the Board has the power and authority to appoint and employ a Director for the WCDPHE, and WHEREAS, this Resolution is intended to comply with the requirements set forth in Sections 25-1-506(1) and 25-1-508(1), C.R.S., and to provide the WCDPHE with the information it is requesting. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Board hereby establishes the Weld County Department of Public Health and Environment (WCDPHE) as a "county public health agency" pursuant to the requirements of Section 25-1-506(1), C.R.S. The signatory authority for the WCDPHE shall rest in the Board of County Commissioners, and as delegated for particular purposes according to the provisions of the Weld County Code. The scope of work of the WCDPHE may include, but not be limited to, the duties, responsibilities and activities enumerated for public health agencies in Title 25, Article 1, of the Colorado Revised Statutes, applicable regulations contained in the Colorado Code of Regulations, the Weld County Home Rule Charter, and the Weld County Code. BE IT FURTHER RESOLVED by the Board that it hereby affirms the Weld County Board of Public Health, as constituted pursuant to Section 4-3 of the Weld County Home Rule Charter, with the members and terms for said Board as set forth in the attached Exhibit "A." 2009-0856 HL0036 ESTABLISH PUBLIC HEALTH AGENCY, DESIGNATE SIGNATORY AUTHORITY, CLARIFY SCOPE OF WORK, AFFIRM MEMBERSHIP OF WELD COUNTY BOARD OF PUBLIC HEALTH, AND AFFIRM APPOINTMENT OF DR. We have until July 1, 2009 to be in compliance with the Board's passage of a resolution identifying us as the local public health agency. Key points in this and other communications: The name of our agency: we must be designated by name in the resolution. I presume we are committed to keeping the current name - Weld County Department of Public Health & Environment. Internally, some have suggested we simplify our name to either our old name - Weld County Health Department - or the Weld County Department of Health. This is the time to decide if we wish to make a name change. All contracts must be in the name of the local public health agency; we are being asked to notify CDPHE prior to April 15, 2009 of our official name so they can begin to prepare task orders under that name. Any delegated signature authorities that the commissioners will give to local health department staff. Any change in partnerships that would change our scope of work. This is most relevant to new agencies that might be contracting out some of their services. Our scope of work should not change. Date the Board is scheduled to approve the resolution establishing our department as the local health agency. Let me know how I can help us comply with SB08-194. This request is related to the mandatory establishment of a county or district public health agency by resolution of the board of county commissioners pursuant to C.R.S. §25-1-506 of the 2008 Public Health Act, which was created in Senate Bill 08-194. As explained in more detail below, the Department can only render payments to local public health agencies effective July 1, 2009 if that agency has been designated pursuant to Senate Bill 08-194 as the county's public health agency. We have approximately 500 agreements, throughout most divisions within our department, with local health partners that are comprised of a Master Contract through which we issue Task Orders. Pursuant to the Public Health Act, if your entity name/and FEIN changes, we will need to amend those Master Contracts, a process which typically takes approximately 8 weeks. Task Orders cannot be issued until the Master Contracts reflect the appropriate entity name. This creates an immediate issue, as most programs are currently preparing their new Task Orders for July l' and there may be other current Task Orders that will need to be amended and effective July 1 ". If Task Orders are not in place as of July 1, 2009, or if existing Task Orders no longer reflect the correct name of the local health partner, no work required under the Mast Contract can be performed and consequently, no payments made. Due to the timelines for processing and approving contracts, if your resolutions to establish a local public agency by your board of county commissioners are not finalized, it is imperative that we receive the following information no later than April 15, 2009 concerning the anticipated organizational structure of your public health agency: • The name of your agency; • Any signature authority that would be delegated to you or any of your staff from your board of county commissioners for your newly and/or formally established board of health under the Public Health Act; • Any potential collaborations or partnerships that you will be implementing that would change the scope of work in on -going contracts of which your agency has been the recipient; and • Date of scheduled hearing with your board of county commissioners concerning passage of the resolution establishing a public health agency in accord with Senate Bill 08-194. The Department can begin to draft and circulate contracts and task orders based upon the information requested above; however, no contract can be finally signed by the Department or the State Controller until a copy of the county resolution designated the public health agency is received. Failure to timely provide the necessary information may result in a break in services, as work cannot be performed in the absence of a valid contract.
