RE: EXPRESSION OF OPPOSITION TO H.B. 09-1250
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to Section 30-29-101(1), C.R.S., moneys received by the State
Treasurer from the Federal government under provisions of the Act of Congress of May 23, 1908,
as amended, relating to receipts from national forests, are paid by the State Treasurer to the
counties in which national forests are located, on the basis of the acreage of national forest land
located in each county and in accordance with information provided by the Federal government as
to source and amount, and
WHEREAS, pursuant to Section 30-29-101(2), C.R.S., the money received from the State
Treasurer is then allocated by the Board of County Commissioners between the County's road and
bridge fund and the public schools, with not less than five percent of the amount received annually
being allocated for either purpose, and
WHEREAS, if passed, H.B. 09-1250 would require that each County receiving national
forest money allocate such funds such that not less than fifty percent of the amount received go
to the public schools in the County, nor less than five percent to the County road and bridge fund,
and
WHEREAS, 203,680 acres of national forest land within Weld's 2,570,711 acres, for which
the County receives $222,398.57, annually, of national forest money, through the allocations made
pursuant to Section 30-29-101(2), C.R.S., and
WHEREAS, the Board of County Commissioners opposes any restriction as to the amounts
the Board is required to allocate between the County's road and bridge fund and the public schools,
believing instead that such decision should be made by local government leaders rather than by
the Colorado General Assembly, and
WHEREAS, for the above -stated reasons, the Board deems it advisable to oppose
H.B. 09-1250.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Board opposes H.B. 09-1250 for the above -stated reasons.
BE IT FURTHER RESOLVED by the Board that it directs the County Attorney to make
copies of this Resolution available to members of the Colorado General Assembly.
