RESOLUTION RE: GRANT OF A SPECIAL USE PERMIT FOR EASTMAN KODAK COMPANY, OPEN CUT MINING. Sec. 5 T5N R65W SUBJECT: "C" to "I-UD" and Preliminary Plat APPEARANCE: Gary Sears DISCUSSION: The Planning staff sent a letter to Denver to check on the mineral deposit on this property. This item was tabled at the July 20th, 1976, meeting. The Weld County Planning staff now recommends approval for the following reasons: 1 ) Although the Colorado Geo- logical Survey has indicated that the mineral deposit under the subject property is a deposit of commercial value, the Planning Commission staff does not feel that it is commercially feasible to extract the gravel resource for the following reasons: A) The existing land use (residential and commercial ) in the immediate area would not be compatible with gravel extraction on the subject property; B) Extraction would not be compatible with the existing zoning (Estate, Commercial and Industrial ) in the adjacent areas es- pecially with regards to the extensive Estate District located immediately to the north; and C) Development of a gravel pit operation Page 1307 , on the subject property would not be in conformance with the per- mitted uses proposed for the area under the City of Greeley Compre- hensive Plan. The subject property is proposed to be a light in- dustrial district. Gravel extraction is permitted only in conserva- tion districts; 2) The Weld County Utility Advisory Board has recommended approval of the utility plat on July 29, 1976; 3) The Weld County Health Department has indicated the subject area can support individual on-lot sewage disposal systems; 4) The Western Hills Fire Department has indicated they have no objections to the proposal provided the fire protection Provisions are followed as shown on the plans; 5) The Weld County Building Inspection Division indicated they have no objections provided there is adequate flood- proofing design for the proposed development and 6) the City of Greeley Planning Commission has recommended approval of the zone change and preliminary plat. Tom Hann explained that the uses would be listed in the County Zoning Regulations under both Commercial and Industrial Districts, but would have to be compatible with the City of Greeley' s light industrial zone regulations. Final Site Plans and Parking will have to be reviewed by the County and the City at time of submittal . Mr. Sears stated he has talked with the City some more, and there is good possibility that he will be making application to the City for sewer. RESOLUTION: Be it therefore resolved to recommend to the Weld County Board of County Commissioners approval of this request for a change of zone from "C" to "I-UD" . Motion by Tim Weigand . NW4 Sec. 13 T6N R65W SUBJECT: Greyhound training track APPEARANCE: Earl Anderson DISCUSSION: Mr. Anderson explained that he has been in the business of training greyhounds for 10 years. It is a competitive business and he can't compete unless he is equiped to do so. Weld County Planning staff recommends approval for the following reasons: 1 ) The request is in compliance with the Comprehensive Plan in that it is compatible with the area and surrrounding land uses; 2) The Weld County Engineering Department indicated there were no anticipated engineering problems; 3) The Weld County Health Department has indicated that the proposed operation is in conformance with all applicable State Health Standards and regulations; 4) The Cache La Poudre Reservoir Company has indi- cated the ditch company has no objections to the greyhound training track; 5) The applicant has submitted a petition form signed by the majority of the surrounding property owners. Our office has not received any opposition from any of the remaining property owners in the area; and 6) The Soil Conservation Service has indicated the soils in the area pose no problems for the proposed operation. Page 1308 , Development standards were read into record. Mr. Anderson explained that the cost of this track (without ground) is approximately $20,000. There will be no expansion in the number of dogs. Other trainers in the area will also use the track. Traffic will not be increased by this track. Mr. Anderson explained that training will be com- pleted by 10:00 each morning because the dogs can't run in the heat of the day. The track will be used as long as possible except for months when the ground is frozen. There is no other facility like this in Colorado. This facility was approved for Mr. Anderson' s own use and has already been constructed. Construction was started last April . Mr. Anderson does not feel that this will encourage other breeders to come into this area. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners, approval of this request for a dog training track. Motion by Bill Elliott. Seconded by Percy Hiatt. SEq Sec. 3 T2N R68W SUBJECT: Extention of Zone Change "A" to "C" APPEARANCE: Clarence Evers DISCUSSION: Mr. Evers explained that the property was zoned "C" for only six months. Now he would like for it to be permanently zoned as Commercial . The property is for sale, but there is no specific plan for its use. Property all the way around it is zoned commercial . Ramada Inn is to the west of this property (Del Camino Area). Mr. Fortner explained that when this property was before the Commission several months ago it had been misrepresented as commercial several times because of the other zoning around it. Basically, there is no land there that can really be used for agricultural purposes. Weld County Planning staff recommends approval for the following reasons: 1 ) The original commercial zoning of the contiguous property to the east and a portion of this parcel did not conform to the proposed lines at the time of rezoning. (Part of the parcel was zoned C and part A); 2) The proposed change of zoning is com- patible with surrounding zoning which is all commercial ; and 3) The proposed change of zone would not effect the commercial value of any gravel deposits because of the small acreage involved and be- cause all surrounding zoning prohibits mineral extraction. RECOMMENDA- TION OF APPROVAL IS CONDITIONAL UPON: 1 ) The applicant shall sub- mit a final site plan and construction schedule to be reviewed by the Weld County Planning Commission and approved by the Board of County Commissioners prior to development on the subject property; 2) The applicant shall comply with all of the conditions under which the commercial zoning was granted except that the subject property shall have a permanent commercial zoning classification. Page 1309 RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners approval of this request for permanent zoning subject to staff recommendations. Motion by J. Ben Nix. Mr. Fortner requested flexibility to enable staff to reword item #1 (in reasons for approval ) for clarity. Sec. 33 T6N R67W SUBJECT: Zone change "I" to "A-UD" and Open Cut Mining Permit APPEARANCE: Jim Mueller \. DISCUSSION: Mr. Mueller explained that this request is to allow Eastman Kodak to have an economical source of film material for future \ building. Comprises approximately 15 acres. While it will be a long term use, the actual period of time that work will be done is six to eight weeks. There will be three to eighteen month periods when no work at all is done. This is located in the bluffs along Kodak' s south property line. After completion of this project, approximately 10 acres will be used as irrigated farmland. No pit is involved. Water table will not be exposed. Mr. Mueller has recommendations from the Soil Conservation Service for seeding, topsoiling, etc. These recommendations are included on the plat, Weld County Planning staff recommends approval for the following �'' reasons: 1 ) The request is in compliance with the Weld County Cal- i\ prehensive Plan and the Weld County Extraction Plan, Mineral Resources Volume II. The area in question is non-irrigated. SWa SW1 Sec. 16 T5N R65W SUBJECT: "E" to "C" , Final Site Plan and Recorded Exemption APPEARANCE: Doug Sears DISCUSSION: Mr. Sears explained that this is the property at the intersection where Highway 34 will go east from U.S. 85 Bypass and 1st Avenue. There is just a little over 10 acres in the parcel . The Weld County and Greeley Comprehensive Plans do call for industrial useage in this area. Mike Nabors, McDoy Distributing, was with Mr. Sears. He is an intended user for one of the tracts. This is why application for Recorded Exemption is being made. Mr. Sears explained that it was the Planning staff' s recommendation to go through application for Recorded Exemption rather than platting the land. Weld County Planning staff recommends approval for the following reasons: 1 ) The requests comply with the Weld County Comprehensive Plan since the development is adjacent to the City of Greeley and the uses comply with those proposed in the City of Greeley Comprehensive Plan; 2) The City of Greeley has recommended approval of the requests; 3) The Weld County Health Department has indicated the soils in the area are suitable for individual sewage disposal systems; and 4) the Western Hills Fire Department has indi- cated they have no objections to the proposal . RECOMMENDATION OF APPROVAL IS CONDITIONAL UPON: 1 ) A guarantee that the developer is obtaining water from the City of Greeley and has an approved con- tract for water service and installation of the water line. The developer shall submit said contract to the Department of Planning Services prior to advertisement for the Board of County Commissioners' hearing; 2) The letter as submitted dated July 30, 1976, to be signed by McDoy Distributing Company and Sierra Investment Company prior to advertisement for the Board of County Commissioners' hearing and that portion of said letter in quotes be made a condition of approval in the resolution by the Board of County Commissioners; 3) The "Grant of Right-of-Way and Easement" and "Warrenty'Deed" documents being made a part of the approval by the Board of County Commissioners such that copies of the recorded instruments as attached be submitted to the files of the Planning Commission and Board of County Commissioners subsequent to recordation; 4) Limitation of access onto the future State Highway frontage road to two access points as requested by the State Department of Highways; and 5) Final approval from the City of Greeley on the drainage study submitted for Parcel A of the Recorded Exemption prior to advertisement for the Board of County Commissionrs ' hearing. COMMENT: The City of Evans gave no response to the referral sent to them on these requests by Sierra Investments Company. Mr. Sears explained that he was unaware of the requirement for contracting with the City of Greeley for water. The property is within and is being served by a viable water district. He questioned the legality of the County making this requirement. He explained that the City is expanding and picking up boundaries within the water district, but at present, Delta can serve the property. Page 1311 Mr. Honn explained that the applicant had named the City of Greeley as being the source of water. Proof that water is available is all that is necessary. John Watson, representing Industrial Acres, read letter dated July 30, 1976 into record. Industrial Acres strongly opposes rezoning a small piece of property such as this, without giving consideration to the entire area. They feel this is spot-zoning and is not in compliance with Weld County and the City of Greeley Comprehensive Plan. Jim Smith, partner in Industrial Acres, explained that he owns a parcel of land just to the north. He envisions the Planning Commission's role as one of not reacting to a certain situation, but one of leading forward. Basically, Industrial Acres was requesting to be rezoned at the same time as the property of Sierra Investments is. Mr. Heitman explained that the only reason Sierra Investments is being considered today is because they have a specific use in mind and have requested a change of zone. Industrial Acres has not made that type of application. Mr. Smith said it is conceiveable that Industrial Acres could be re- zonelas Residential because there is residential property to the north, or it could be rezoned as commercial because there is commercial property to the south. He feels that Industrial Acres needs a frame- work so they know where they fit in. He is concerned with what type of buffer will be used between properties. Roy Lundvall was also present as a partner in Industrial Acres. Mr. Sears stated that Mr. Watson was talking as though he is a very naive citizen of Weld County, when in fact he has served on the Planning Commission Board for a good many years. He stated that Mr. Watson most definitely knows what is going on because he helped to create the Weld County Comprehensive Plan. Mr. Sears explained that he had an informal conversation with the partners from Industrial Acres prior to this hearing. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners approval of this request for change of zone. Motion by J. Ben Nix. Seconded by Chuck Carlson. A vote of "aye" by Elliott, Carlson, Weigand, Heitman, Hiatt, Nix, and Elliott. MOTION CARRIED. A vote of "aye" by Elliott, Carlson, Weigand, Heitman, Hiatt, Nix, and Kountz. MOTION CARRIED. APPLICANT: Amoco Production Company PC Tape 633 (# 57 - 961 ) CASE NUMBER: SUP 314 LOCATION: Pt. Sec. 34 T2N R67W SUBJECT: Gas Processing Facility Expansion APPEARANCE: John Lang, Harry Hickman, and Robert Chinaud DISCUSSION: Mr. Lang gave a lenghty presentation of the request. The plant is located about 4 miles west and z mile north of the Town of Ft. Lupton at the intersection of County Roads 14 and 19. Natural Gas which is produced with oil from the spindle and single tree fields is processed here. Liquids which are removed from the gas include ethane, propane, butane and pintane +. These liquids are removed and stabilized and put in a surge tank where they are then delivered from the plant by pipeline. All liquids leave the plant in a mixed stream. The residue gas is sold to Colorado Interstate Gas Company. It also leaves the plant by a buried pipeline. Plant is designed as a completely closed system. There are no specific odors connected with the process. All compressor units are equiped with exhaust silencers and compressor buildings are completed with noise insulation. Proposed addition to the plant involves the addition of six compressors and some plant processing equipment. The plant processing equipment would increase the plant capacity approximately twelve million cubic feet per day. The new equipment is indicated to be parallel to existing equipment. Plant is operated on a round- the-clock basis. Water is supplied by a water well at a plant site in the vicinity of the plant office. No expansion oR the water supply will -be required. No additional road requirements are necessary as a result of this proposed expansion. Robert Chinaud, Engineering Dynamics Incorporated, was consulted by Amoco to survey the noise increase. The new compressors will actually be farther away from the existing residences. The survey shows the existing noise level at 53 decibels. The increase in compressors would create an increase of 2 decibels in noise level . Mr. Lang explained that acoustical barriers can be installed on the stacks of the compressors to help with the noise problem. Dr. Chinaud will be designing these barriers. Planning Commission staff indicated that it would be desirable to have some type of screening on the site. Mr. Lang explained that the site is well maintained and is actually weed free. Mr. Lang also explained that trees had been planted on the site in the past, but when the site was sprayed to kill the weeds, the spray also killed the trees. Page 1313 Weld County Planning Commission staff recommends the request be tabled for the following reasons: 1 ) Letters of opposition to this proposed expansion have been received from August Gittlein, William Gittlein, and Mr. and Mrs. Sheldon Sickler. Copies of those letters are included in an attached packet; 2) Noise has been identified as one of the problems in the area by the surround- ing property owners. The Planning Commission staff has requested a noise study be done which would indicate: A. The noise level of the existng operation; B. The noise level of the facility with the proposed expansion; and C. How these noise levels com- pare with acceptable noise level ratings at the perimeter of the Special Use Permit area and also at the nearby residences. The requested noise study has not been presented to date; 3) In December, 1972 when the Special Use Permit was granted for the original facility, there was to be a landscape screen planted around the perimeter of the area. According to Amoco, trees were planted, but later died from a dust applied to control weeds on the internal area of the facility. The Planning Commission staff has requested the applicant to develop a landscape plan for visual and noise screening purposes to be plantediaround the perimeter of the Special Use Permit area to be in compliance with the recommendation of the Soil Conservation Service. This has not been done to date; and 4) Another sheet to the Special Use Permit plans needs to be submitted to include the proper certificates and development standards. William Gittlein was present. He lives on Road 19 just south of the plant. He was concerned about the noise, dust and traffic. He stated that a good percentage of the traffic is related to the plant. Dr. -Chinaud explained his ideas for designing noise barriers. He stated that the increase in noise would not be very detectable with the addition of new compressors. The Weld County Planning staff recommends denial for the following reasons: 1 ) The proposal at hand is inconsistent with the Weld County Comprehensive Plan. The Plan states that agriculture is a resource in Weld County which must be protected from the impacts of urban growth. To accomplish this objective, the plan states that urban residential , commercial , and industrial uses will be encouraged, to located around existing urban centers so that their impacts will be minimized, and so that the cost of providing the services associated with such uses will be minimized to the greatest extent possible. Inthe pending proposal , the pro- posed use is not an agriculturally related use, but is an urban residential use proposed for a predominately agricultural area . The proposal sets forth no evidence that the use is related to in- tended agricultural uses of the land in question. The subject property is in fact one of several approximately 35-acre parcels which were split out of the SA of Section 5, Township 3 North, Range 68 West of the 6th P.M. , since 1972 when said quarter section was one agricultural unit. The land in question consists primarily of Class II soils which are classified as prime agricultural soils by the Soil Conservation Service. The area could easily support agricultural uses if urban encroachment on the land does not occur; 2) The granting of this request would enhance the conflict between basically incompatible uses, i . e. the traditional conflicts between urban and agricultural uses; 3) If such urban residential uses, as proposed in the pending appl4cation are allowed to occur, the cost of providing services to such rural areas can only be increased , thus resulting in over- all increased costs to the taxpayer. As stated by the Weld county Comprehensive Plan, such uses should be encouraged to locate around existing urban centers, where the base for providing such services is already established; and 4) Finally, if such development is encouraged, more and more agricultural lands will be split into parcels which are basically too small to support viable farm operations, and too large to be maintained properly by those who work in the city but live in the country. As a result of the latter factor, additional conflicts with surrounding agricultural uses occur. Tom Honn explained that the Planning Commission staff has not been able to understand where the deeds describing the property match the description submitted by Carol Lee. The filtered effluent is discharged to the Cache La Poudre River in accordance with an existing NPDES permit. The lagoons are operated in series to provide aeration for oxidation of organics followed by settling of suspended solids . Each lagoon is lined with a single layer of EPDM membrane. The liners, which have been in use for more than 15 years , have experienced occasional incidents when gas would collect and cause localized floating of a membrane. In addition, the unprotected membranes are subject to punc- ture at or near the water surface when aerators or mixers are removed for repair. Slumping of the lagoon banks under the liners has also started to occur in specific areas, which if left unchecked, would create excessive stresses in the membrane. Kodak has undertaken a project to rehabilitate the existing lagoons to correct these conditions and minimize future maintenance requirements. The project site plan showing the location of the treatment facility and borrow area is presented in Drawing EW 00XX-010-002 . PROJECT SCOPE The project consists of rehabilitation of the two existing lagoons and construction of a new lagoon (Lagoon No. 3) as shown on Drawing EW 00XX-011-006 . The new lagoon is designed with two cells with floating aerators to provide aeration for removal of the wastewater organics . The cells will normally be operated in parallel with the influent divided equally in a new concrete flow splitter box. Adequate volume will be provided in each cell so that either may be taken out of service temporarily for repair as necessary without interrupting the treatment process. The lagoon lining will consist of a double layer of HDPE membrane separated by HDPE geonet. The secondary (lower) liner will be supported by HDPE geonet placed over a geo- textile. The lining systems will be installed on a compacted clay base. Bottom and side slopes are designed to permit escape of any gas bubbles that may form and prevent slumping of the embankment. ',1AR 9 1989 DEN/110R/027 1 A Each existing lagoon will be rehabilitated by removing the EPDM liner, regrading and recompacting the clay bottom and stabilizing of the berms to prevent slumping. The lagoons will then be lined with the same dual liner system used for Lagoon No. 3 . Additionally, a new berm will be installed in Lagoon No. 2 to reduce the effective storage volume as recommended for dual-power lagoons. A new building will be constructed near the south edge of Lagoon No. 3 to house the motor control center, pump controls, and process analyzers for the treatment system. The project also includes the construction of pump sumps and underground piping systems to convey water from Lagoon No. 3 to the settling lagoons. Earth for the new berms will be obtained from a borrow area located at the south side of Kodak' s property west of C257 as shown on the site plan. The borrow area consists of a hillside south of the Cache La Poudre River flood plain as shown on Drawing EW00XX-011-007. The earth, which will be used as general embankment fill , will be hauled in trucks to the treatment lagoons. Upon completion of the project, the borrow area will be graded to the slopes shown on the drawing to provide drainage and prevent ponding of stormwater runoff. This 26-acre site lies in an area I had not mapped as a gravel resource on the Colorado Geological Survey sand and gravel resources map of the Windsor quadrangle. There are indications of small gravel deposits along the river bluffs, but they are typically very small, spotty in occurrence, and covered by substantial overburden. Therefore, I did not consider them significant or economic deposits. What Kodak plans to mine is fill or embankment material, which, as I see it, consists of colluvium or slope debris and underlying bedrock (Pierre Shale) . The transitional Pierre in this area consists of interbedded shales and sandstones. Unless the excavation proceeds into a dominantly sand phase, there is a possibility of failure on the southern slopes in the later stages of the operation. The reclamation plan shows the final cut slopes of 40 percent on the south end of the excavation. Pierre Shale by itself cannot tolerate slopes this steep. Even with interbedded sandstones, failure could result at the slope top--either from natural watering or from excess watering during the reclamation phase. Although any failure here would likely be small, it could result in excess siltation in Eaton Ditch or remotely even physically damage the ditch itself. My recommendation is to ask Kodak to address this slope stability problem as it relates to existing and final drainage into and across the site, bedrock lithology and grade of final cut slopes, and the frequency and magnitude of watering during the reseeding phase. The impact on wildlife will be minimal. The species involved are small rodents and rabbits (both cottontail and jackrabbits) and not in too great numbers. There is a prairie dog colony just to the east of the area to be mined, but as near as could be determined there are none on the site. There are no threatened or endangered species involved in the area. Reclamation plans include grading the area and reseeding with Crested Wheatgrass or pubescent wheatgrass as recommended by the SCS. The lower or north end of the area will be reclaimed as cultivated farm land and treated with fertilizers to bring it back to production. Presently the land is in a native grass condition, interspersed with a generous stand of weeds and presents somewhat of a "go back" condition.
