RE : AUTHORIZATION TO EXECUTE MEMORANDUM OF AGREEMENT BETWEEN
THE DEPARTMENT OF HUMAN RESOURCES BY AND THROUGH WELD
COUNTY AND THE CITY OF EVANS, COLORADO.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a Memorandum of Agreement has been submitted by
and between the Department of Human Resources (Weld County,
Colorado) and the City of Evans , Colorado, wherein Weld County
is to provide certain transportation services to the City of
Evans in connection with the Summer Youth Recreation Program
in the City of Evans , and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado deems it advisable and in the best interest of Weld
County to authorize the Chairman of the Board of County Com-
missioners of Weld County, Colorado to execute said Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the Chairman of the
Board of County Commissioners of Weld County, Colorado, be and
hereby is authorized and directed to execute the Memorandum
of Agreement between the Department of Human Resources of Weld
County, Colorado and the City of Evans, Colorado for transpor-
tation services to be provided to the City of Evans in connec-
tion with the Summer Youth Recreation Program of the City of
Evans, Colorado.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 27th day of
June, A.D. , 1977.
The above and foregoing Resolution was read into the record
and signed on the 6th day of July A.D. , 1977 .

MEMORANDUM CF AGREEMENT
THIS AGREEMENT , made and entered into this 20th day
of June , 1977, by and between THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO,
hereinafter referred to as "Weld County" and THE CITY OF
EVANS, COLORADO, hereinafter referred to as "City of Evans , "
WITNESSETH:
WHEREAS, Weld County has resources and equipment to
provide limited transportation service to Summer Youth
Recreation participants of the City of Evans ; and
WHEREAS , the City of Evans is desirous of entering
into an agreement with Weld County to obtain transportation
services from Weld County for the City of Evans ; and
WHEREAS, the parties hereto are desirous of formalizing
an agreement which will operate to the benefit of both
parties in the establishment and operation of a limited,
temporary transportation service for the use of Summer Youth
Recreation participants of the City of Evans ;
NOW THEREFORE , the parties hereto agree and convenant
as follows :
1 . Weld County shall supply to the City of Evans a
vehicle which has the capacity to carry at least twenty
(20) passengers for the use of transporting Summer Youth
Recreation participants of the City of Evans on each day of
the week (Monday through Friday) , commencing June 20, 1977,
and ending July 29 , 1977 . Such vehicle shall be at the
Weld County Shop , 1500 Second Street , Greeley, Colorado,
on each day to serve the City of Evans and shall provide
Summer Youth Recreation services to the City of Evans as
hereinafter defined, between 12 : 00 p .m. and 5 : 00 p .m.
2. The City of Evans shall provide insurance in
accordance with laws of the State of Colorado . The vehicle
as provided by the Agreement shall remain under the
exclusive control of the transportation program of the Weld
County Division of Human Resources . The City of Evans
agrees to operate the vehic in accordance with the
Transportation Policy of the Weld County Division of
Human Resources .
3 . The City of Evans shall provide a bus driver
to operate the vehicle . The bus driver shall possess
a Class (S) or School Bus license .
4 . The City of Evans agrees to submit daily mileage
and passenger reports to the transportation program of
the Weld County Division of Human Resources on the last
working day of the month.
5. The City of Evans shall purchase gas, oil , and
maintenance for the vehicle at the Weld County Shop . The
purchase shall be charged and billed to the Weld County
Division of Human Resources by the Weld County Shop . The
Weld County Division of Human Resources shall in turn bill the
City of Evans on a monthly basis for the gas , oil , and
maintenance purchased by the City of Evans .
6. The City of Evans agrees to pay for maintenance
incurred due to the neglect of the bus driver.
7. The City of Evans shall not impose any mandatory
fee schedules for the use of the vehicle provided by the
Agreement .
8. It is agreed between the parties that either party
hereto has a right to terminate this Agreement within
thirty (30) days after service is instituted upon thirity (30)
days written notice given to the other party .
IN WITNESS WHEREOF, the parties hereto have set their
hands and seals this 6th day of July , 1977.

Subject: Transportation Agreement with the City of Evans
Enclosed for Board approval is a Memorandum of Agreement with the
City of Evans to provide limited, temporary transportation services
for the period of June 20, 1977, to July 29, 1977.
The City of Evans is requesting the use of a vehicle to transport
youngsters participating in the City's Summer Youth Recreation
Program.
