HomeMy WebLinkAbout20091084.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MAY 6, 2009 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, May 6, 2009, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner William H. Garcia, Chair Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway Commissioner Barbara Kirkmeyer Commissioner David E. Long - EXCUSED Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Jennifer VanEgdom Controller, Barb Connolly MINUTES: Commissioner Rademacher moved to approve the minutes of the Board of County Commissioners meeting of May 4, 2009, as printed. Commissioner Conway seconded the motion, and it carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. PUBLIC INPUT: No public input was given. CONSENT AGENDA: Commissioner Conway moved to approve the Consent Agenda as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. PRESENTATIONS: RECOGNITION OF SERVICES, WELD COUNTY FAMILIES, YOUTH, AND CHILDREN COMMISSION - JUAN LOPEZ: Chair Garcia read the certificate into the record, recognizing Juan Lopez for six years of service with the Weld County Families, Youth, and Children Commission. He stated Mr. Lopez is one of the many great people who make Weld County a great place to live. He confirmed Mr. Lopez is employed by Weld County School District 6, and he stresses the importance of attending school to school -aged children. Chair Garcia indicated Mr. Lopez displayed his passion as a representative on the Commission, many projects were accomplished during Mr. Lopez's tenure as the Chair of the Commission, the meetings were always well attended, and he hopes Mr. Lopez will consider service on another advisory board within the future. Mr. Lopez was present to receive his certificate and he confirmed each of the Commissioners have been amazing and helpful during their duties with the Commission. He confirmed he has a passion for the community in which he lives, and he knows that the Commissioners do as well. He further confirmed the Commission is responsible for reviewing funding sources for various Weld County agencies, 2009-1084 BC0016 and he has always taken his role seriously as the Chair of the Commission, as it was very important. He clarified he served as Chair of the Commission for six years, and throughout the years there have never been any arguments between the representatives; however, there have been numerous times of good discussion. He stated the Commission does makes a difference within the community, and the Commission has always strived to be a good steward of the funds allocated by the Commissioners. He further stated, because of the generosity of the Commissioners, many kids have been served with, and positively impacted by, the various funds provided, including provisions for mental health. He expressed his appreciation to the Board for always searching for ways to streamline costs so that funding cuts did not have to happen, and he further expressed his appreciation to the dedicated staff members within the Department of Human Services. Mr. Lopez indicated he is term -limited, and since he already served six consecutive years, he plans to take off one-year, as required, and then come back and serve on the same Commission, or another advisory board. Commissioner Conway expressed his appreciation to Mr. Lopez for all of the efforts he provides to improve the community, and Commissioners Kirkmeyer and Rademacher concurred. COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Coordinator Reports. NEW BUSINESS: CONSIDER TEMPORARY CLOSURE OF CR 78 BETWEEN CR 19 AND SH 257: Janet Carter, Department of Public Works, stated County Road 78, between County Road 19 and State Highway 257, will be closed from May 11, through May 14, 2009, for a culvert replacement. She indicated the average daily traffic count for County Road 78 is approximately 126 vehicles, water will be utilized for dust control along the detour route, and standard road signs and barricades will be utilized during the road closure. Commissioner Rademacher moved to approve said temporary closure. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. CONSIDER TEMPORARY CLOSURE OF CR 7 BETWEEN CR 48 AND SH 60, AND OF CR 48 BETWEEN CR 7 AND THE MUNICIPAL LIMITS FOR THE TOWN OF JOHNSTOWN: Ms. Carter stated County Road 7, between County Road 48 and State Highway 60, will be closed from May 11, to July 31, 2009, and County Road 48, between County Road 7 and the municipal limits for the Town of Johnstown, will be closed from May 11, through August 7, 2009, for new road construction related to the re -alignment of County Road 7. She indicated a turn lane will be constructed on State Highway 60, and County Road 7 will be paved over the current recycled asphalt. She stated the average daily traffic count for County Road 7 is approximately 1,386 vehicles, and the traffic count for County Road 48 is approximately 1,394 vehicles. She confirmed magnesium chloride will be utilized for dust control along the detour routes due the expected length of the project. Commissioner Conway moved to approve said temporary closure. Seconded by Commissioner Rademacher, the motion carried unanimously. CONSIDER INSTALLATION OF TRAFFIC CONTROL DEVICES AT INTERSECTION OF CRS 40 AND 57: Ms. Carter stated staff received a telephone call from representatives of A and W Water and Noble Energy, requesting the installation of a Stop sign at the intersection of County Roads 40 and 57, which is a T -intersection. She indicated she reviewed the intersection during a site inspection and determined that the installation of a Stop sign is necessary, due to area consistency and sight distance concerns. In response to Commissioner Rademacher, Ms. Carter confirmed only the eastbound traffic will be stopped. Commissioner Rademacher moved to approve said installation. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. CONSIDER INSTALLATION OF TRAFFIC CONTROL DEVICES ON CR 22 BETWEEN U.S. HIGHWAY 85 AND CR 31: Ms. Carter stated during a previous Board meeting, public input was provided by a Weld County citizen, who requested that the speed limit along a section of County Road 22, between U.S. Highway 85 and County Road 31, be increased to 55 miles per hour. She indicated the Minutes, May 6, 2009 2009-1084 Page 2 BC0016 Department conducted a Speed Study, at which time it was discovered that the 85th percentile speed of traffic along this section of road is 55 miles per hour. She confirmed the Manual on Uniform Traffic Control Devices (MUTCD) indicates that speed limits shall be posted within 5 miles per hour of the 85th percentile speed of traffic, therefore, she recommends increasing the speed limit to 55 miles per hour, and installing the necessary signs. Responding to Chair Garcia, Ms. Carter confirmed the Department does not have outstanding safety concerns regarding increasing the speed limit on this section of road. She confirmed the speed limit east of County Road 31 is 55 miles per hour, and in the past, only this portion of road was reduced to 45 miles per hour. She confirmed, for the sake of consistency, it is advisable to raise the speed limit to 55 miles per hour. Commissioner Kirkmeyer indicated she understands the surrounding area is not residential in nature; however, there are several Use by Special Review (USR) permits within close proximity, which heavily utilize truck traffic. Ms. Carter confirmed one USR permit exists along this section of road, for an automotive repair business, and the USR permits which contain truck traffic are located on a separate segment of County Road 22. Commissioner Rademacher indicated he is surprised that the 85th percentile of traffic was at a speed of 55 miles per hour because he understands that many motorists drive even faster than that on this segment of road. Commissioner Rademacher moved to approve said installation. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. CONSIDER APPOINTMENT OF DEPUTY DISTRICT ATTORNEY AND AUTHORIZE CHAIR TO SIGN - DAVID SKARKA: Commissioner Conway moved to appoint David Skarka as a Deputy District Attorney and authorize the Chair to sign. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. PLANNING: CONSIDER CANCELLATION AND RELEASE OF COLLATERAL FOR SITE PLAN REVIEW #401 - STAGECOACH PARTNERS, LLC, C/O FLOYD AND KATHARINE OLIVER: Richard Hastings, Department of Public Works, stated the applicant has requested final release of the collateral. He indicated the site is located south of State Highway 119, east of County Road 7.5, in the Del Camino area, and is immediately located between a bank and a car wash facility. He confirmed collateral, in the amount of $29,590.50 has been held during the one-year warranty period, and upon inspection of the site, the Department has determined that all improvements have been acceptably completed. He stated Michelle Martin, Department of Planning Services, has also indicated that all improvements are acceptable, therefore, staff recommends approval of the release of collateral. Commissioner Rademacher moved to approve said cancellation and release of collateral. Seconded by Commissioner Conway, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved.
