THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
The submitted materials are in compliance with the application requirements of Section 23-2-260
of the Weld County Code.
2. It is the opinion of the Department of Planning Services' staff that the applicant has shown
compliance with Section 23-2-220 of the Weld County Code as follows:
A. Section 23-2-220.A.1 -- The proposed use is consistent with Chapter 22 and any other
applicable code provisions or ordinance in effect. Section 22-2-20.6.3 A.Policy 2.3,
states, "Encourage development of agriculture and agriculturally related businesses and
industries.... Agricultural businesses and industries include those related to ... agri-
tainment or agri-tourism uses." Further, Section 22-2-20.F.4 A.Policy 6.4 states
"Encourage agri-tourism; and Section 22-2-70.A TR.Goal 1 states "Recognize the
importance of cultural and heritage tourism and recreation to local, regional and
agricultural economies, including events and sites such as corn mazes, County fairs,
farm implement museums, etc. Encourage the provision of adequate support services
and facilities necessary for the continuation and expansion of these activities, consistent
with other goals and policies of the Comprehensive Plan." (Weld County Code Ordinance

2002-6; Weld County Code Ordinance 2008-13) This application is an amendment to an
existing permit approved by the Board of County Commissioners in 1999. This
application seeks to increase the numbers of persons utilizing this facility on a daily basis
for 26 special events throughout the calendar year without requesting approval by the
Board of County Commissioners for each special event. The applicant seeks to hold six
events with a maximum daily visitor population of up to 10,000 persons; 10 events with a
maximum daily visitor population of up to 5,000 persons; and 10 events with a maximum
daily visitor population of up to 1,200 persons. On all other days of operations, the facility
will be permitted for up to 499 persons as approved under USR-1232.
Section 23-2-220.A.2 -- The proposed use is consistent with the intent of the A
(Agricultural) Zone District. Section 23-3-40.C.8 of the Weld County Code provides for a
Recreational Facility with uses similar to those seen at guest farms and fairgrounds as a
Use by Special Review in the A (Agricultural) Zone District.
C. Section 23-2-220.A.3 -- The uses which will be permitted will be compatible with the
existing surrounding land uses. The surrounding area has large tract agricultural uses
and mineral resource acquisition. Reflection Bay subdivision is '/: mile Northwest of the
existing facility.
D. Section 23-2-220.A.4 -- The uses which will be permitted will be compatible with future
development of the surrounding area as permitted by the existing zoning and with the
future development as projected by Chapter 22 of the Weld County Code and any other
applicable code provisions or ordinances in effect, or the adopted Master Plans of
affected municipalities. The facility is within the three mile referral areas for the City of
Dacono, City of Firestone, Town of Erie and Town of Frederick and Boulder County. The
City of Dacono in a referral dated July 29, 2008, the Town of Erie in a referral dated July
30, 2008, and the Town of Frederick in a referral dated July 31, 2008, all reviewed the
request and find no conflicts with their interests. The Town of Firestone and Boulder
County did not respond to the referral request.
E. Section 23-2-220.A.5 -- The application complies with Section 23-5 of the Weld County
Code.
Effective January 1, 2003, Building Permits issued on the proposed lots will be required
to adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11)
Effective August 1, 2005, Building permits issued on the subject site will be required to
adhere to the fee structure of the Capital Expansion Impact Fee and the Stormwater/
Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40)
F. Section 23-2-220.A.5 -- The site does not lie within any Overlay Districts.
G. Section 23-2-220.A.6 -- The applicant has demonstrated a diligent effort to conserve
prime agricultural land in the locational decision for the proposed use. The site is
designated as "Prime" by the USDA Soil Conservation Service. The proposed use will not
remove any additional agricultural land from production. The agricultural activities on the
property are an important part of the proposed use.

H. Section 23-2-220.A.7 -- The Design Standards (Section 23-2-240, Weld County Code),
Operation Standards (Section 23-2-250, Weld County Code), Conditions of Approval and
Development Standards ensure that there are adequate provisions for the protection of
health, safety, and welfare of the inhabitants of the neighborhood and County.
This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities.
The Department of Planning Services' staff recommendation for approval is conditional upon the
following:
1. Prior to recording the plat:
A. The plat shall be amended to delineate the following:
1) All sheets of the plat shall be labeled AmUSR-1232. (Department of Planning

2) The plat shall be prepared per Section 23-2-260.D of the Weld County Code.

3) The attached Development Standards. (Department of Planning Services)
4) County Road 3.25 is designated on the Weld County Road Classification Plan as
a local paved road, which requires an 60 -foot right-of-way at full build out. There
is presently sixty feet of right-of-way. A total of 30 feet from the centerline of
County Road 3.25 shall be delineated on the plat. This road is maintained by

5) The screened trash enclosure for the facility. (Department of Planning Services)
6) A graphic key and or symbol serving to identify each component that is located
within the USR Boundary. The key and corresponding component shall be
summarized in tabular format and be clearly delineated on the plat.

7) The applicant shall delineate the locations of all Stop signs. (Department of

8) The applicant shall amend General Note #2, on the submitted draft plat to
accurately delineate the FEMA panel map and map date. The correct panel map
is number 080266 0860 C dated September 28, 1982. (Department of Public

9) The applicant shall delineate a parking and circulation layout plan for the
overflow parking component. The plan shall be dimensioned and demonstrate
that there is adequate turning radii, internal circulation and adequate access for

10) The applicant shall identify a minimum of two parking areas for emergency
responders and/or EMT personnel that may be on site during all events greater

11) The overflow (secondary) parking area shall place the single point of ingress and
egress seventy-five feet from the southernmost property line of the Anderson
Farm property. This access shall be gated. (Department of Planning Services

B. The applicant shall submit evidence that a building permit has been obtained for the
Education Building and Haunted Theme Park, or for the construction of any new
structures .An annual permit will be required for any alterations or additions to the

C. The applicant shall furnish a Traffic Control Plan for the 26 events which have greater
than 499 visitors to the facility on any given day for review and approval by the
Departments of Public Works and Planning Services. (Department of Planning Services)
D. The applicant shall submit in writing, evidence that the existing domestic water tap has
been re -permitted for a commercial customer and commercial water tap. Further, the
applicant shall submit written evidence that the concerns raised in the July 31, 2008
referral from the Left Hand Water District referral have been addressed to their

E. The applicant shall submit a waste handling plan, for approval, to the Environmental
Health Services Division of the Weld County Department of Public Health & Environment
(WCDPHE). The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should include
expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number). Written evidence of approval
from the Department of environmental Health shall be submitted in writing to the
Department of Planning Services. (Environmental Health)
F. The applicant shall submit a dust abatement plan for review and approval, to the Weld
County Department of Public Health & Environment. Written evidence of approval from
the Department of environmental Health shall be submitted in writing to the Department

G. The applicant shall address the requirements of the Department of Building Inspection,
as stated in their referral response dated July 8, 2009. Evidence of approval with all
conditions met or mitigated shall be submitted in writing to the Department of Planning

H. The applicant shall address the concerns of the Mountain View Fire Protection district as
stated in their referrals dated December 2, 2008, August 5, 2008. Evidence of approval

with all conditions met or mitigated shall be submitted in writing to the Department of

The applicant shall submit for review by the Department of Planning Services a method
of documentation for the daily visitor numbers to the aMAIZEing Farm Events facility.

2. Upon completion of 1. above the applicant shall submit a Mylar plat along with all other
documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office
of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall
be prepared in accordance with the requirements of Section 23-2-260.D of the Weld County
Code. The Mylar plat and additional requirements shall be submitted within ninety (90) days from
the date of the Board of County Commissioners resolution. The applicant shall be responsible for
paying the recording fee. (Department of Planning Services)
3. The Department of Planning Services respectively requests the surveyor provide a digital copy of
this Recorded Exemption/Subdivision Exemption/Use by Special Review/. Acceptable CAD
formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles,
Arclnfo Coverages and Arclnfo Export files format type is .e00. The preferred format for Images
is .tif (Group 4). (Group 6 is not acceptable). This digital file may be sent to

Prior to commencement of operations:
A. The applicant shall complete an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for all required materials. The
agreement and form of collateral shall be reviewed by County Staff and accepted by the
Board of County Commissioners prior to recording the Amended USR plat; or, the
applicant may submit evidence that all the work has been completed and approved by

5. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat
not be recorded within the required thirty (30) days from the date of the Board of County
Commissioners resolution a $50.00 recording continuance charge shall be added for each

6. The Special Review activity shall not occur nor shall any building or electrical permits be issued
on the property until the Special Review plat is ready to be recorded in the office of the Weld

2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld
County Code. (Department of Planning Services)
3. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination. (Department of Public Health and

4. No permanent disposal of wastes shall be permitted at this site. This is not meant to include
those wastes specifically excluded from the definition of a solid waste in the Solid Wastes
Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. (Department of Public Health

5. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
fugitive particulate emissions, blowing debris, and other potential nuisance conditions.

7. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall

8. There shall be no open burning conducted on the site, with exception to burning defined as
"agricultural open burning" as defined by Regulation No. 9 of the Colorado Air Quality Control

9. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial

10 Permanent hand washing and toilet facilities shall be provided for 200 people per day.

11. The facility shall utilize portable toilets and hand washing units to temporarily supplement the

12. The "Sewage Disposal and Portable Toilet Plan", dated June 30, 2009, shall be adhered to, at all

13. Any septic system located on the property must comply with all provisions of the Weld County

15. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado

16. The applicant shall comply with Colorado Retail Food Establishment Rules and Regulations
governing the regulation of food service establishments. (Department of Public Health and

• 17. If applicable, the applicant shall comply with the Colorado Department of Agriculture (CDA),

18. The operation shall comply with all applicable rules and regulations of the State and Federal

19. No parking or staging of vehicles on the county road is allowed. Use on -site parking area.

20. The Applicant shall continue follow Traffic Control Plans that conform to the Manual on Uniform
Traffic Control Devices (MUTCD) for all events held at this facility. All Traffic Control Plans at a
minimum must contain flagger control, temporary traffic control signing and cones.

21. Ingress and egress to the facility shall be from the existing access along Weld County Road 3

22. Prior to the sale of any alcoholic beverages applicant shall apply for and receive all appropriate

23. The landscaping on site shall be maintained in accordance with the approved landscape plan.

24. A plan review is required for each building for which a building permit is required. Two complete
sets of plans are required when applying for each permit. Include a Code Analysis Data sheet
provided by the Weld County Building Department with each Building permits submittal plans

shall include a floor plan showing the specific uses of each area for the building. The Occupancy
Classification will be determined by Chapter 3 of the 2006 International Building Code. The plans
shall also include the design for fire separation and occupancy separation walls, when required
by Chapter 5 and 7 of the 2006 International Building Code. Fire Protection shall conform to
Chapter 9 and exiting requirements by Chapter 10. (Department of Building Inspection)
25. Buildings shall conform to the requirements of the various codes adopted at the time of permit
application. Currently the following has been adopted by Weld County: 2006 International
Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006
International Fuel Gas Code; 2006 International Energy Conservation Code and the 2008
National Electrical Code and Chapter 29 of the Weld County Code. (Department of Building

26. Building permits will be required for the haunted theme area and the educational building if they
will be utilized under this amended Use by Special Review Permit. (Department of Building

27. The Education Building is permitted to utilize more than one cargo container in the construction of
this structure, per Section 23-3-40.AA. (Department of Planning Services)
28. All building plans shall be submitted to Mountain View Fire District Fire District for review and
approval prior to issue of building permits. (Department of Building Inspection)
29. The facility is restricted to six events with a maximum daily visitor population of up to 10,000
persons; 10 events with a maximum daily visitor population of up to 5,000 persons; and 10 events
with a maximum daily visitor population of up to 1,200 persons per day. On all other days of
operations, the facility will be permitted for up to 499 participants at any one time as approved

30. The existing tail water ditch downstream of the overflow parking lot area shall be used as a water
quality feature. It shall be maintained using the Best Management Practices. Should sediment
from this water quality feature enter into the Boulder Creek waterway additional measure will be
required as determined by the Weld County Public Works Department. (Department of Public

31. A right turn deceleration lane is warranted for the project site access based on the turning
movement figures in the traffic study. Weld County Public Works is not requiring the construction
of the right turn deceleration lane, however, if the number of events or volumes increase beyond
the submitted information within the traffic study, the construction of a right turn deceleration lane

I am working on an updated letter to Michelle so that our request to modify our events and daily numbers go back
out for referral review and comment. In review of the March 6, 2009 letter to you I found a typo concerning the
5000 person events and the 10,000 person events. The letter indicates in paragraph one "We will request up to
10 events a year with up to 1200 people, 6 events a year with up to 5000 people and up to 10 events a year with
up to 10,000 people."
The sentance should read: "We will request up to 10 events a year with up to 1200 people, 10 events a year with
up to 5000 people and up to 6 events a year with up to 10,000 people."
This is consistant with our prior correspondence and our prior application numbers for the 5000 and 10,000
people events.

Planning Staff has determined per Section 23-3-50.E of the Weld County Code which states,
No BUILDING or STRUCTURE, as defined and limited to those occupancies listed as Groups A, B, E,
F, H, I, M and R in Section 302.1 of the 2003 International Building Code, shall be constructed within a
two -hundred -foot radius of any tank battery, within a one -hundred -fifty -foot radius of any wellhead or
within a twenty -five-foot radius of any plugged or abandoned oil and gas well. Any construction within
a two -hundred -foot radius of any tank battery or one -hundred -fifty -foot radius of any wellhead shall
require a variance from the terms of this Chapter in accordance with Subsection 23-6-10.C of this Code.
Therefore the structures located within the setback that have an occupancies listed as Groups A, B, E, F, H, I,
M and R in Section 302.1 of the 2003 International Building Code will require a variance from the
Board of adjustment or will need to be relocated outside of the setback.

Dennis Renley, Building Inspector, has approved setbacks, structural framing and footing
/caissons for Anderson Farms shade shelters. The only thing left is final approval. I
talked to Mr. Anderson about 2pm; he planned on pouring the concrete later today and will
e-mail pictures of the pour. If he does this I can final the permits from the office.
Mr. Anderson decided to remove all electrical from the shelters, and will permit the
electrical work at a later date. There have no permit applications submitted for the
kitchen hood or the education structure.

Anderson submitted his building permit application on Monday (04/27/09). We had the
permit ready to be issued by Tuesday morning (04/28/09). Mr. Anderson picked up the
building permit on Tuesday (04/28/09).
Greg Reisdorf (with Frank's ride) called me Tuesday late afternoon to see what was going
on regarding the building permits. I explained that Jim had picked it up earlier that
day. I advised him that if Jim called in for an inspection before 3 pm — the inspection
would be scheduled for the next available working day. He said he would call Jim's
daughter and have them call in right away.
Iteg Reisdorf called me today (04/30/09) to see what was going on regarding the building
rmits. I explained we still have not received a phone call requesting an inspection. I
again explained that in order to have an inspection for the next day we needed to receive
a phone call before 3 pm. He said he was going to call Jim's daughter again. I explained
to Greg that most likely at Monday's hearing I would be asking the Board to either require
Mr. Anderson to have the inspections completed before the event on the 17th or that orange
style mesh barricade material installed around the shade shelters so they are not
utilized. If they use the structures without a completed building permit - Maybe the
Sheriff's Office can shut them down as a Condition of Approval. I have his phone number
if there is a better suggestion.

On April 20, 2009, a hearing was held by the Board of County Commissioners to discuss the application for
the issuance of a Temporary Assembly Permit for Frank's Ride for Children event scheduled to occur on May
17, 2009. The Board's principle concern in its consideration was the lack of approved building and electrical
permits along with an engineer letter for the four (4) metal covered structures. Greg Risedorf with Frank's
Ride for Children indicated they would not be utilizing the "classroom facility" or the stove (range hood) in the
cafeteria. Although those items and structure also need requisite building and/or electrical permits, their
issuance and approval were not of immediate concern specific to this permit because of Mr. Risedorf's
comments.
The lack of approved building and electrical permits for the four (4) metal covered structures prompted the
Board to continue the above hearing to May 4, 2009. The matter may be taken up by the Board earlier if it is
informed that the building and electrical permits have been issued.

Just in case you don't have the application submittal packet handy, I have attached the written portion that you
reviewed for your prior referral. You can find the original proposal on participant numbers in item 5a of the
application.
In Anderson Farms original application to amend the existing USR-1232 we indicated that the daily proposed
count would be up to 1200 people at one time and also proposed limitations on special events as follows:
up to 6 events per year with a maximum of 10,000 participants per day of the event and
up to 10 events per year with a maximum of 5000 participants per day of the event.
In working with the Health Department and other referral agencies Anderson Farms is now proposing to reduce
the daily maximum during the year back down to the existing number of no more than 499 people at any one time
and special events as follows:
up to 6 events per year with a maximum to 10,000 participants per day,
up to 10 events per year with a maximum of 5000 participants per day of the event, and
up to 10 events per year with a maximum of 1200 participants per day of the event.
The proposed changes are a reduction in the original request and are very consistent with existing operations with
a little room for growth. The larger event is consistant with the harvest festival that has been operating in the past
with temporary assembly permits. The proposed amendment would allow them to continue the existing
operations without going before the Board every year for the special events.

Dear Ms. Light:
As in our prior conversations and correspondence we are proposing to amend our
AmUSR-1232 application to lower the daily number from 1200 back to the existing
permitted number of 499 people at any one time on a daily basis. We will request up to
10 events a year with up to 1200 people, 6 events a year with up to 5000 people and up to
10 events a year with up to 10,000 people.
Based on prior experience, traffic counts on the busiest fall harvest festival day,
discussions with you and a Larimer County Health official, and review of the Stanford
Event and Labor Services Portable Toilet Chart we offer you the following revised
Sewage Disposal and Portable Toilet Plan to address the sewage disposal on the larger
events and to act as a development standard for AmUSR-1232.
Sewage Disposal and Portable Toilet Plan:
An appropriate number of portable toilets and hand washing stations will be provided on
site for any event over 200 people at one time. The number of portable toilets used will
be determined by past experience and review of the Stanford Event and Labor Services
Portable Toilet Chart as follows: A minimum of 16 portable toilets and 3 hand washing
stations will be provided far the largest temporary events up to 10,000 people. A
minimum of 8 portable toilets and 2 hand washing stations will be provided for the
temporary events with up to 5000 people. A minimum of 4 portable toilets and I hand
washing station will be provided for the temporary events of up to 1200 people. These
larger events typically do not have the maximum number on site at any one time. Should
an event have the maximum number on site at any one time the event duration would
typically be two hours or less. Portable toilets will be added on an "as needed" basis for
events when necessary. The existing permanent restroom facilities will be available for
all the events. For events that have 1200 or more people the septic tanks will be pumped
and hauled by a Weld County licensed pumper in good standing. The tanks will be
pumped as necessary on the Friday, Saturday, Sunday and Monday of the event.

Based on this email from Frank, what buildings will be required to be permitted. Some of
the buildings are historic and were in place for the prior USR permit. Based on our last
meeting, Frank indicated that the class room, office and shelters would need some paper
work and/or permitting follow up. Is this still the case and if so, can we get direction
concerning the building permits that will be required? Let me know if it would be easier
to meet Frank on site.

1111 ADA will be required for this AmUSR-1232 Public Works will only require handicap signs
for each parking space and that the ADA parking spaces be a hard surface treatment such as
concrete, asphalt, recycled asphalt, brick or other hard surface material.

Hi Michelle,
I am both glad and sad that I went yesterday and feel really bad that I didn't know about the ghost town.
I have very serious concerns about this facility. It's all I have thought about since our visit. I really
thought about the fact that these people have continued to build structures over and over again without
any permits or even talking to the fire department or building department to see if they needed anything.
They say in their narrative, they have worked in harmony with everyone and believe they have provided
safety, but when they continue to build things and they have been told not to build anymore stuff, they
just ignore us. They built a Group A-5 occupancy (the ghost town) without even discussion their plans.
The AmUSR site plan shows this area as a haunted theme area showing no details at all or any of the
buildings. I just thought that was a part of their corn maze. I know that you thought it was really neat
and I thought so do from a creative standpoint, but I have some very serious concerns as does Frank.
I just keep wondering what are they going to do next? Another shed here, another classroom here,
another shelter type building. They referred to the shelters as portable, I don't believe any of those
things are portable except the props in the corn maze itself.
I really hope that I can make the meeting, and that we all take a very hard look at what this facility has
now become. I just wanted you to know that I would be out of Town November 3-11.

As far as the Consumer Protection Division is concerned the problems at Anderson Farm have been addressed.
The items we requested are as follows:
1. All cooking on the outside grill is approved. During time of no use the grill will be covered and secured
with a locking device to prevent tampering of grill. Jim agreed to do this.
2. As far as the hood is concerned if Mountain View Fire Department approves heating of soups, water, re-
heated meat and sauces is okay with no hood/extinguishing system. We defer to the Fire District to enforce hoods
and fire suppression systems.
3. Hand washing stations (total of 5 faucets) are in place at the eating area and one is located by the rabbit
enclosure. These appear to be adequate and according to Jim Anderson, used frequently.
As far as the septic system and port -o -lets are concerned that is being addressed by Lauren and Trevor.
If you need anything else please let me know. Thanks for your's and Frank's help with this.

I have talked with Jim Anderson concerning the size and number of events based on your referral to our original
AmUSR-1232 application submittal.
Jim would like to propose a change concerning the 1200 number. The proposal is that there be up to 10 events
per year with up to 1200 people at one time vs. the original submittal of 1200 people per day the entire year. With
these events it is proposed that port a lets are available as with the other larger events (up to 6 at 10,000 and up
to 10 at 5000). The rest of the year would be left at the existing number of 499 people at one time per the
resolution for the existing USR-1232.

On Thursday January 31, 2008 an informal discussion took place at the Greeley Administrative
Offices Conference Room regarding the proposed amendment to the existing USR-1232 (The
legal description is Lot A, Recorded Exemption RE -281; and part E2NW4; part NE4; part N2SE4
Section 32, Township 2 North, Range 68 West of the 6th P.M. Situs Address: 6728 County
Road 3.25, Erie, CO 80516. The property is located East of and adjacent to Weld County Road
3 %2 , west of and adjacent to Weld County Road 5 and 1/4 mile north of State Highway 52.
Acreage for this facility is 243 acres more or less.
Background Information:
The Anderson family operates a guest farm operation for agri-entertainment and agricultural
production. The farming operation has been in the family for 50 years. This facility has been in
operation since 1999. The existing permit affords a Fall Festival in autumn that operates
approximately 40 days each year. Current visitor counts number on average 54,000 persons
[based on tickets sold] per season. The facility is restricted in numbers to 200 persons whereby
port -a -lets are required and up to 499 persons before a Special Assemblage Permit is required.
In the years of operation there have been no complaints filed with the Board of County
Commissioners or the Andersons when events have occurred. The Anderson Family has been
diligent in their hands on operations approach and oversight of activities.
The shop/party barn structure is able to accommodate 197 persons with an adequate hydraulic
load for up to 200 persons. There is a commercial kitchen within this structure with a Colorado
Retail Food Establishment permit in good standing with the State of Colorado.
Access will be from County Road 3.25 a local road maintained by County. Public Works
indicated that the existing points of ingress and egress would be retained. Public Works
reserves the right to require a traffic study, which will be required per consultation with D.
Dunker, Senior Engineer. Stormwater should be addressed with a Preliminary Drainage Report.
This document is required given the proposed increase in vehicles on site and the acreage of
compacted soils.

Water is provided by Left Hand Water District, and an ISDS system handles the effluent flows
from the residence and party barn.
All current operations will remain as permitted.
The Anderson/ Smith party seek increase their on -site permitted numbers to 10,000 persons for
their current facility, numbers greater than this upstand limit would proceed through the
Assemblage Permit process. It was indicated that large corporate groups, wedding and
reception, birthday, office/ family/ school reunions, office/ family/ school picnics, music festivals
and office/ family/ school holiday parties have been turned down in the past due to the limit
imposed under the existing permit.
County will require a traffic circulation plan and parking configuration to be submitted with the
amendment to the USR application
County provided Procedural Guide application, aerial photograph to Hodges. Staff will require 4 -
sets of the complete application less the Certificate of Conveyances and Mineral Notice for
review for completeness prior to accepting the remaining packets, the additional documents
exempted here and a check for the application.
Staff suggested that a letter from the town be requested and included in the application
materials from the Town of Frederick.
Ogle to provide referral list of agencies to be contacted for this proposal and submit with meeting
Notes.

In reviewing the pre -submittal application, the Public Works Department shall be looking for four
critical items.
> Site Plan Review
> Traffic study
> Preliminary Drainage Report
➢ Geotechnical Soils Report
Site Plan Review: I utilized the questionnaire and the plat drawing to evaluate the Pre -Submittal
item. Item no. 5. Identify additional 30 acres of available overflow parking, show location on the
plat drawing to accommodate the expansion from 499 existing to a proposed 10,000 to utilize
the. facility. I estimated three to four people per/car, this additional overflow parking shall be
required to accommodate the maximum number of users.
Traffic Study: The applicant needs to submit a traffic study, which was required by Don Dunker,
Senior Engineer, for any improvements associated with the expansion, for review and
'acceptance. The applicant shall provide CDOT with a copy of the traffic study for any additional
improvements that may be necessary for the intersection of WCR 3.25 and State Highway 52.
Preliminary Drainage Report: The applicant shall provide a preliminary drainage report to be'
evaluated given the proposed increase in vehicles on site and the acreage of compacted soils.
-" = A Soil Narratives and Soil Classification plat was attached. The Geotechnical Soils Report
needs to be provided for review and acceptance.
Please find attached the Weld County Use by Special Review (USR) preliminary drainage
outline and final drainage report along with the scope of work for a traffic impact study. These
items will be a part of your submittal process.
