WELL AGREEMENT AND EASEMENT
THIS AGREEMENT made and entered into this '5 day of &0ld. 2000, by
and between FORMBY, INC., a Colorado corporation, hereinafter called "Formby", and
OTTESENS', INC., a Colorado corporation, hereinafter called "Ottesens"".
WHEREAS, Formby is the owner of 2.6 acres more or less located in the SEI/4 of the
NE1/4 of Section 30, Township 2 North, Range 66 West of the 6'^ Principal Meridian, County of
Weld, State of Colorado, designated on the Amended Recorded Exemption No. 1309-30-t-RE456
as "SUBD. EX NO. 633 Parcel", (hereinafter "2.6 acre Parcel"), upon which there is located a
domestic well (hereinafter "Domestic Well") which serves said 2.6 acre Parcel with inside domestic
water and an outside sprinkler system for the yard around the residence, and an irrigation well (Permit
No. 22612F); and
WHEREAS, Ottesens' is the owner of Lot B of Amended Recorded Exemption No. 1309-
30-1-RE546, Part of the E1/2 of the NEl/4 of Section 30, Township 2 North, Range 66 West of the
611' Principal Meridian, County of Weld, State of Colorado, 51.976 acres more or less (hereinafter
"Ottesens' Property"), upon which there are located two irrigation wells (Permit No. 6231R and
Permit No. 93439) which serve said Ottesens' Property with water for irrigation; and
WHEREAS, Formby has conveyed Well Permit No. 22612F to Ottesens'; and
WHEREAS, it is necessary for Ottesens' to have access to the 2.6 acre Parcel to facilitate
its use of said well; and
WHEREAS, the parties desire to commit their agreements to writing.
NOW, THEREFORE, in consideration of the mutual covenants and agreements herein
contained, it is agreed as follows:
1. It is agreed that Ottesens' shall be entitled to the exclusive use of the irrigation well
Permit No. 22612F for use on the Ottesens' Property.
2. It is agreed that Formby shall be entitled to the exclusive use of the Domestic Well
located on the 2.6 acre Parcel for its permitted use on the 2.6 acre Parcel.
Each party shall pay the charge for electricity for the well(s) owned by them.
4. Formby hereby grants to Ottesens' an exclusive easement for maintenance purposes
over and across the 2.6 Acre Parcel for the sole purpose of maintaining the irrigation
well Permit No. 22612F.

5. In the event either party sells its respective property, there shall be no restriction on
the subsequent assignment of this Agreement to their grantee(s).
6. The parties acknowledge that the existing concrete conveyance facility for the
irrigation well Permit No. 22612F is located on the Ottesens' Property.
7. The provisions herein shall be binding upon and extend and inure to the benefit of the
parties, their heirs, representatives, successors in ownership of their respective
property, and assigns and shall tun with the land.
