DETAILED DESCRIPTION OF AUTHORIZED WORK In accordance with the terms and conditions of this Department of the Army permit, Varra Companies, Inc. is granted authorization by the Secretary of the Army to excavate and place fill material into 1.2 acres of waters of the United States to mine gravel. Issuance of this permit and the description of the project is based on documents submitted in the original permit application received by the Denver Regulatory Office on 1 May 2007, and - among other communications - a revised permit application dated 8 November 2007. 2.1. Location. This project is located between the towns of Mead and Platteville, Colorado east of I-25 on Highway 66 at Weld County Road 17, within Sections 28 and 29, Township 3 North, Range 67 West, Weld County, Colorado. 2.2. Existing Conditions. The upland areas in Section 28 have been disturbed during the< process of mining gravel. Ditch F remains running the full length of the parcel. Section 29 has agricultural field in one half of the parcel with wet meadows (old oxbows of the St. Vrain), the I ast Chance Ditch and its associated wetlands and an agricultural pond. 2.3. Description of Work. As a result of revised plans, the total project impacts are reduced to the impacts to Ditch F (1.2 acres) with mitigation consisting of compensating for the loss by creating a minimum of 1.2 in the relocated ditch. 2.4. Impacts and Mitigation. The impacts are limited to irrigation ditch F and those segments cut off from its hydrology. s 3. The permittee agrees to construct the project and mitigation as shown on the attached drawings in three (3) Sheets dated 3 April 2008, which are attached to, and made a part of, this permit. C. The permittee agrees to create 1.2 acres of waters of the United States before impacting 1.2 acres of Ditch F completing through planting the mitigation within 3 months of the realignment. The permittee shall hire a professional ecologist — to oversee that the mitigation, which will be accomplished in accordance with the attached mitigation plan and with these special conditions. In cases where a conflict between the two exists, the special conditions supersede the mitigation plan. D. If heavy equipment is used for the subject project that was previously working in another stream, river, lake, pond or wetland within 10 days of initiating work, one of the following procedures is necessary to prevent the spread of New Zealand Mud Snails and other aquatic hitchhikers: (1) Remove all mud and debris from equipment (tracks, turrets, buckets, drags, teeth, etc.) and keep the equipment dry for 10 days; or (2) Remove all mud and debris from equipment (tracks, turrets, buckets, drags, teeth, etc.) and spray/soak equipment with either a 1:1 solution of Formula 409 Household Cleaner and water, or a solution of Sparquat 256 (5 ounces Sparquat per gallon of water). Treated equipment must be kept moist for at least 10 minutes; or (3) Remove all mud and debris from equipment (tracks, turrets, buckets, drags, teeth, etc.) and spray/soak equipment with water greater than 120 degrees F for at least 10 minutes. E. The permittee agrees that the created wetlands will be considered successful and self- sustaining when the following conditions have been met without intervention in the form of irrigation, removal of undesirable vegetation or replanting of desirable vegetation for a five (5) consecutive year period: a. At least 80 % (determined by ocular estimate of herbaceous and shrub foliar cover) of the mitigation site is vegetated were appropriate, at least 50% of the total number of dominant species present will consist of species rated as facultative or wetter, and at least 50% of the dominant species present shall have been planted species. b. Those species shown on the Colorado Noxious Weed Inventory list -A shall be 100% eradicated. Those species shown on list -B shall be no more than 10% or less of the total cover in the mitigation area. The lists can be found at http://www.ag.state.co.us/CSD/weeds/statutes/weedrules.pdf. c. In disturbed upland areas bordering, and draining into, the created wetlands, less than 20 percent aerial cover will contain non-native plants. F. The permittee agrees to monitor the mitigation during the summer months each year beginning in 2008. Annual Reports will be submitted to the Corps of Engineers before December 31 of each year beginning in 2008. If no work has been done, state as such in the report. The format of this report shall follow the requirements shown in Attachment A. Your responsibility to complete the required compensatory mitigation will not be considered fulfilled until you have demonstrated mitigation success and have received written verification from the Corps. If, at any time during the first two years after initial implementation of mitigation, site conditions indicate that the success criteria are not likely to be achieved, the permittee agrees that remedial efforts will be undertaken after consultation with the Corps of Engineers. In addition to on -site remedial efforts, if the Corps determines that additional on -site efforts are fruitless, remedial efforts may include new mitigation plans and sites, the purchase of credits from a mitigation bank or participation in an in -lieu fee program. G. The permittee agrees to contact the U. S. Fish and Wildlife Service, Office of Migratory Birds, at (303) 236-8171, for permitting requirements prior to the removal or destruction of any bird nest. H. The permittee agrees that they are responsible for all work accomplished in accordance with the terms and conditions of this authorization. If a contractor or other authorized representative will be accomplishing the work hereby authorized in behalf of the permittee, such parties shall be provided a copy of this authorization so they are aware of the terms and conditions. An activity that fails to comply with the terms and conditions of this authorization will be considered unauthorized and all responsible parties will be subject to appropriate enforcement action. I. The permittee agrees to follow the Section 401 Certification Requirements that are attached to, and made a part of, this permit. J. The permittee agrees that all construction debris will be disposed of on land in such a manner that it cannot enter a waterway or wetland. L. Based on information provided by the applicant, the Corps has determined the basic project purpose to be mining gravel. This project purpose was the basis upon which the Corps conducted its review of the application, as well as a basis for the Corps' determination that permit issuance is in the best interest of the public. Accordingly, the Corps authorizes no change in project purpose, or in the nature of the permitted activity, without prior review and approval. M. The permittee agrees that equipment for handling and conveying materials during construction shall be operated to prevent dumping or spilling the materials into the water except as approved herein. N. The permittee agrees that care will be taken to prevent any petroleum products, chemicals, or other deleterious materials from entering the water. O. (2) In the event of any changes in control or ownership of facilities where the construction activity or operation of the project is taking place, the successor shall be notified in writing by his predecessor of the existence of the BMPs and certification conditions. A copy of such notification shall be provided to the Division. (3) If the permittee discovers that certification conditions are not being implemented as designed, or if there is an exceedance of water quality standards despite compliance with the certification conditions and there is reason to believe that the exceedance is caused, in whole or in part, by the project, the permittee shall verbally notify the Division of such failure or exceedance within two (2) working days of becoming aware of the same. Within ten (10) working days of such notification, the permittee shall provide to the Division, in writing, the following: (a) In the case of the failure to comply with the certification conditions, a description of (i) the nature of such failure, (ii) any reasons for such failure, (iii) the period of noncompliance, and (iv) the measures to be taken to correct such failure to comply; and (b) In the case of the exceedance of a water quality standard, (i) an explanation, to the extent known after reasonable investigation, of the relationship between the project and the exceedance, (ii) the identity of any other known contributions to the exceedance, and (iii) a proposal to modify the certification conditions so as to remedy the contribution of the project to the exceedance. (4) Any anticipated change in discharge location and/or quantities associated with the project which may result in water quality impacts not considered in the original certification must be reported to the Division by submission of a written notice by the permittee prior to the change. If the change is determined to be significant, the permittee will be notified within ten days, and the change will be acknowledged and approved or disapproved. (5) Any diversion from or bypass of facilities necessary to maintain compliance with the terms and conditions herein is prohibited, except (i) where unavoidable to prevent loss of life or severe property damage, or (ii) where excessive storm drainage or runoff would damage any facilities necessary for compliance with limitations and prohibitions herein. The Division shall be notified immediately in writing of each such diversion or bypass. (6) At least fifteen days prior to commencement of a project in a watercourse, which the Division has certified, or conditionally certified, the permittee shall notify the following: (a) Applicable local health departments; (b) Owners or operators of municipal and domestic water treatment intakes which are located within twenty miles downstream from the site of the project; and 1' (c) Owners or operators of other intakes or diversions which are located within five miles downstream from the site of the project. The permittee shall maintain a list of the persons and entities notified, including the date and form of notification. (7) Immediately upon discovery of any spill or other discharge to waters of the state not authorized by the applicable license or permit, the pennittee shall notify the following; (a) Applicable local health departments; (b) Owners or operators of municipal and domestic water treatment intakes which are located within twenty miles downstream from the site of the project;(and (c) Owners or operators of other intakes or diversions which are located within five miles downstream from the site of the project. The permittee shall maintain a list of the persons and entities notified, including the date and form of notification. (8) Construction operations within watercourses and water bodies shall be restricted to only those project areas specified in the federal license or permit. (9) No construction equipment shall be operated below the existing water surface unless specifically authorized by the 401 certification issued by the Division. (10) Work should be carried out diligently and completed as soon as practicable. To the maximum extent practicable, discharges of dredged or fill material shall be restricted to those periods when impacts to designated uses are minimal. (11) The project shall incorporate provisions for operation, maintenance, and replacement of BMPs to assure compliance with the conditions identified in this section, and any other conditions placed in the permit or certification. All such provisions shall be identified and compiled in an operation and maintenance plan which will be retained by the project owner and available for inspection within a reasonable timeframe upon request by any authorized representative of the Division. (12) The use of chemicals during construction and operation shall be in accordance with the manufacturers specifications. There shall be no excess application and introduction of chemicals into state waters. (13) All solids, sludges, dredged or stockpiled materials and all fuels, lubricants, or other toxic materials shall be controlled in a manner so as to prevent such materials from entering state waters. (14) All seed, mulching material and straw used in the project shall be state certified weed -free. (15) Discharges of dredged or fill material in excess of that necessary to complete the project are not permitted. (16) Discharges to state waters not identified in the license or permit and not certified in accordance therewith are not allowed, subject to the terms of any 401 certification. 12 (17) Except as otherwise provided pursuant to subsection 823(C), no discharge shall be allowed which causes non -attainment of a narrative water quality standard identified in the Basic Standards and Methodologies for Surface Waters, Regulation #31 (5 CCR 1002-31), including, but not limited to discharges of substances in amounts, concentrations or combinations which: (a) Can settle to form bottom deposits detrimental to beneficial uses; or (b) Form floating debris, scum, or other surface materials sufficient to harm existing beneficial uses; or (c) Produce color, odor, or other conditions in such a degree as to create a nuisance or harm existing beneficial uses or impart any undesirable taste to significant edible aquatic species, or to the water, or (d) Are harmful to the beneficial uses or toxic to humans, animals, plants, or aquatic life; or (e) Produce a predominance of undesirable aquatic life; or (f) Cause a film on the surface or produce a deposit on shorelines. (B) Best Management Practices: (1) Best management practices are required for all projects for which Division certification is issued except for section 402 permits. Project applicants must select BMPs to be employed in their project. A listing and description of best management practices is located in Appendix I of Regulation No. 82: 401 Certification Regulation 5 CCR 1002-82. (2) All requests for certifications which require BMPs shall include a map of project location, a site plan, and a listing of the selected BMPs chosen for the project. At a minimum, each project must provide for the following: (a) Permanent erosion and sediment control measures that shall be installed at the easiest practicable time consistent with good construction practices and that shall be maintained and replaced as necessary throughout the life of the project. (b) Temporary erosion and sediment control measures that shall be coordinated with permanent measures to assure economical, effective, and continuous control throughout the construction phase and during the operation of the project. 13 ATTACHMENT A Annual Monitoring Mitigation Report Format Requirements (From Regulatory Guidance Letter No. 06-03, established August 3, 2006) Mail report to: U. Wadsworth Blvd Littleton, CO 80128 (Phone: 303-979-4120) Annual monitoring reports must follow a 10 -page maximum report format for assessing mitigation sites, as follows: A. Project Overview (1 page) (1) Corps Permit Number. (2) Name and contact information of permittee and consultant. (3) Name of party responsible for conducting the monitoring and the date(s) the inspection was conducted. (4) A summary paragraph defining the purpose of the approved project, acreage and type of aquatic resources impacted, and mitigation acreage and type of aquatic resources authorized to compensate for the aquatic impacts. (5) Written description of the location and any identifiable landmarks of the compensatory mitigation project including information to locate the site perimeter(s). (6) Directions to the mitigation site. (7) Dates compensatory mitigation began and/or was completed. (8) Short statement on whether the performance standards are being met. (9) Dates of any recent corrective or maintenance activities conducted since the previous report submission. (10) Specific recommendations for any additional corrective or remedial actions. B. Requirements (1 page) List the monitoring requirements and performance standards, as specified in the approved mitigation plan and special conditions of the permit, and evaluate whether the compensatory mitigation project site is successfully achieving the approved performance standards or trending towards success. A table is one option for comparing the performance standards to the conditions and status of the developing mitigation site. C. Summary Data (maximum of 4 pages) Summary data must be provided to substantiate the success and/or potential challenges associated with the compensatory mitigation project. Photo documentation may be provided to support the findings and recommendations referenced in the monitoring report and to assist the Corps in assessing whether the compensatory mitigation project is successful for the monitoring period. Submitted photos must fit on a standard 8.5" X 11" piece of paper, dated, and clearly labeled with the direction from which the photo was taken. The photo sites must also be identified on the appropriate maps. D. Maps (maximum of 3 pages) Maps must be provided to show the location of the compensatory mitigation site relative to other landscape features, habitat types, locations of photographic reference points, transects, sampling data points, and/or other features pertinent to the mitigation plan. In addition, the submitted 14 maps must clearly delineate the mitigation site perimeter(s), which will assist the Corps in locating the mitigation area(s) during subsequent site inspections. Each map or diagram must fit on a standard 8.5" X 11" paper and include a legend and the location of any photos submitted for review. E. Conclusions (1 page) A general statement must be included describing the conditions of the compensatory mitigation project. If performance standards are not being met, a brief explanation of the difficulties and potential remedial actions proposed by the permittee, including a timetable, must be provided.
