RESOLUTION
WHEREAS, a public hearing was held on October 20, 1975, in the
chambers of the Board of County Commissioners, Weld County, Colorado,
for the purpose of hearing the petition of H. A. Schneider, Jr. , Route 2,
Box 321, Greeley, Colorado, requesting permission for expansion of an
existing cattle feed lot operation on the following described property, to-wit:
That part of the Northwest one-quarter of Section
11, Township 6 North, Range 66 West of the Sixth
Principal Meridian, Weld County, Colorado, described
as:
Beginning at the West quarter corner of said Section 11;
Thence N90°00'00" E, on an assumed bearing along the
South line of said Northwest one-quarter a distance of
30. 00 feet to the East right-of-way of County Road No. 33,
said point being the True Point of Beginning;
Thence N90°00'00" E, continuing along said South line of
the Northwest one-quarter a distance of 1570. 00 feet;
Thence N00°01'30" E, parallel to the West line of said
Section 11 a distance of 270. 00 feet;
Thence S90°00'00" W parallel to the South line of said
Northwest one-quarter a distance of 1570. 00 feet to the
East right-of-way of said County Road;
Thence S00 01'30" W along said Right-of-way a distance
of 270. 00 feet to the True Point of Beginning; containing
9. 73 acres, more or less, and
WHEREAS, the petitioner was absent; however, a letter written by
him was read into the record explaining his reasons for his absence, and
WHEREAS, there was no opposition to the request of petitioner for
the expansion of said feed lot ore ration, and
WHEREAS, the said requested feed lot operation is located in an
agricultural zone as set forth by the Weld County Zoning Resolution, and
WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of
Weld County, said feed lot operation or any expansion thereof may be authorized
upon the approval of the Board of County Commissioners of Weld County, and
WHEREAS, the Board of County Commissioners heard all the testimony
and statements of those present; has studied the request of the petitioner, and
studied the recommendations of the Weld County Planning Commission, and
having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com-
missioners, that the application of H. A. Schneider, Jr., Route 2, Box 321,
Greeley, Colorado, for expansion of an existing cattle feed lot operation on
the premises indicated above be, and it hereby is granted under the conditions
following:
1. That any water and sanitation facilities to be installed shall be
approved by the State Health Department.
2. That petitioner shall proceed with due diligence to construct said
cattle feed lot operation and shall have up to one (1) year from date hereof to

begin such construction.
3. That when expansion of said existing feed lot operation is com-
pleted, same shall be limited to pen size as indicated as submitted on
plans.
4. All applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the zoning resolu-
tions of Weld County, Colorado.

Weld County Environmental Health Services recommends approval of the application

DISCUSSION: Feeding approximately 200 head right now. Wish to increase
to 1 ,000 head. No possiblity for further increase. Weld County
Planning staff recommends approval for the following reasons:
{ 1 ) Proposed use complies with the Weld County Comprehensive Plan's
policies regarding the protection and expansion of agriculture.
The plan states that "the expansion and development of agri-business
and agriculturally oriented industry will be encouraged, provided
these enterprises do not adversely affect the total economy or
environment;" 2) the Weld County Environmental Health Services recommends
approval of the application and does not recommend a holding pond
at this time; 3) the Weld County Extension Service has approved
the design and location of the proposed feedlot expansion; 4) a
petition signed by nine surrounding property owners has been sub-
mitted with the application; and 5) all required items for a Special
Use Permit application as listed in Section 3.3(E) (3) of the Weld
County Zoning Resolution have been submitted and are in order.
SUBJECT TO: 1 ) Construction beginning within 1 year from the date
of approval by the Board of County Commissioners; 2) Dust abatement
being practiced to comply with State Statutes; 3) the third drive-
way being allowed only if all requirements of the County Engineer
are met; 4) expansion being limited to two additions of three 150 feet
by 175 feet feeding pens each as show on submitted survey and plot
plan and 5) all applicable health, building, zoning, and subdivision
regulations being complied with. Mr. Schneider stated he was in
agreement with these conditions. On North Weld Water District.
, RESOLUTION: Be it therefore resolved to recommend approval of SUP 288

to the Board of County Commissioners, subject to staff recommendations.

This is in reply to your request for a soil evaluation on the NW-14
of Section 11, Township 6 North, Range 66 West of the 6th P. M. ,
all in Weld County, Colorado.
--- The areas marked X53 on the accompanying map consist of Kim soils
which are deep, friable soils which pose no serious limitations to
use as feedlots. The area marked 34U, however, is Winn soil which
has a high water table and is subject to flooding.
The soil survey is made on the basis of 50 to 60 inch borings. This
information should be used for general planning and does not exclude
the need for on-site investigation for specific engineering purposes.

repeated expansion of the feed lot located immediately north
of the S;Z of Sec . 11 , T. 6N. , R. 66 W. of the 6th i'.ii• r
Ueld County Colored 0. A. sizeable extension of the feed
lot is currently under construction.
We are concerned about the method of the drainage of this
feed lot . The slope is such that the livestock waste will
drain onto our land, which is directly to the south, unless
provisions are made to handle this potentiality.
We wish to go on record as having notified you of this
possible hazard. We hope you will file this letter; we are
keeping a copy in our files for future reference ..
