RE: APPROVAL OF RECORDED EXEMPTION NO. 361 - DAVID FAULKNER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 8th day of January, 1979 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption No. 361, being the property of
David Faulkner, described as part of the Northwest Quarter of
Section 14 , Township 7 North, Range 66 West of the 6th P.M. , Weld
County, Colorado, being more particularly described as follows :
A tract of land located in the Northwest Quarter of
cnction 14, lying West of the ditch, Township 7 North,
Range 66 West of the 6th P.M. , Weld County, Colorado,
and being more particularly described as follows:
Beginning at the West Quarter Corner of said Section
14, and considering the West line of the Northwest
Quarter of Section 14, Township 7 North, Range 66
West of the 6th P.M. , Weld County, Colorado, to hear
North 00°00'00" West with all other bearings contained
herein relative thereto;
Thence North 00°00'00" East, 487.09 feet;
Thence South 89°18'15" East, 60.0 feet to the True
Point of Beginning;
Thence North 00°00'00" East, 180.00 feet;
Thence South 89°18'15" East, 613.20 feet;

Together with an easement for ingress and egress not
to exceed 20 feet in width over and across the North-
west corner of the property descrited in Parcel One
extending fran the existing access road to Weld County

described in the Deed Recorded March 21, 1972 as
Reception No. 1568004, Weld County Records. Said
described parcel of land contains 2.775 acres more
or less.
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the

Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by David Faulkner be , and hereby is , exempt
from the definition of the terms "subdivision" and "subdivided
land" pursuant to its authority under Section 30-28-101 (10) (d) .
CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 8th day of
January, A.D. , 1979.

Dear Commissioners:
The attached application, plat and related materials are in reference
to a request by Mr . David Faulkner for a recorded exemption. The
parcel of land on which this request has been made is described as
Pt . NW* Section 14, T7N, R66W of the 6th P.M. , Weld County, Colorado.
This property is lcoated 3/4 of a mile southwest of the Town of Ault .
The property contains approximately 2. 755 acres of Class II and III
irrigated soils. The request is to split the property into parcels
of 1 . 322 acres and 1.433 acres. Mr . Faulkner desires to build a resi-
dence on each proposed lot of the recorded exemption.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons :
1. The request conforms with the recorded exemption intent clause of
the Weld County Comprehensive Plan. The Ault Growth Management
Plan identifies the property under consideration as low residen-
tial uses. The proposed uses of the property would be compatible
with surrounding agricultural land uses.
2 . The Ault Planning Commission and Town Board has set forth no ob-
jections to this request .
3. The 2. 755 acre parcel has a low utility for agricultural use due
to the size of the parcel under consideration.

4. On October 12, 1978, the Weld County Board of Adjustment granted
a variance from the requirements of Section 9-4 A. (3) of the Weld
County Subdivision Regulations subject to the applicant providing
a minimum 20 foot easement to each proposed lot of the recorded
exemption. The applicant has complied with this condition, there-
fore, this request complies with the provisions of Section 9-4 A.

This is a letter of explanation detailing the situation indicating the
reason(s) why the request for a recorded exemption has been made.
Z. This application for a recorded exemption has been made so that a house
may be built on each lot.
2. A minimum 20 foot easement to each proposed Zot of this recorded
exemption is provided with this application as recommended by the
Department of Planning Services staff for access to Weld County Road #33.
3. A correction deed has been filed on November Z3, Z978 to show true
date and reception no. of recorded deed describing parcel one, and is
rerecorded for that purpose. This correction deed corrects deed
recorded July 12, Z978, Book 838, Reception No. Z759886. This
correction deed was recommended by the Department of Planning Services
to clarify what parcel of land my easement is located on.
4. This land is within the Ault Growth Management Plan (see drsagramte:and
is planned for low residential housing.
5. On September 5, 1978 I talked with the Town of Ault Growth Planning
Board about this proposed split of land into lot A and lot B for the
purpose of building a home on each. The planning board recommended
to the Town of Ault Town Board, that they approve this land split.
6. On September ZZ, Z978, I talked with the Town of Ault Town Board
about this Zand split. The Ault Town Board recommended this split.
