AND BEATRICE C. HOECHER - EXEMPTION OF LAND FROM THE DEFINITON OF "SUB- 1 DIVISION" AND "SUBDIVIDED LAND" . c% WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home „) ri Rule Charter, is vested with the authority of administering the I affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners of Weld County, Colorado, has reviewed the request of George W. and Beatrice C . Hoecher for an exemption of land from the definition of "sub- division" and "subdivided land" in Section 30-28-101 (10) , CRS 1973, as amended, and Section 2-1 of the Weld County Subdivision cam: Regulations, and WHEREAS, the Board of County Commissioners finds that George W. and Beatrice C. Hoecher are the owners of Part of the S1 of the S1 of Section 14 , Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado, containing 0 . 493 acres . Said above-described 0 . 493 acre parcel was retained for road purposes for Pinnacle Park Subdivision which is owned by George W. Hoecher, also. Review of the Third Filing Preliminary Plat of Pinnacle Park Subdivision requested the access not be utilized. The Hoechers are requesting to add the 0. 493 acre parcel to a contiguous 4 . 985 acre parcel , resulting in a single lot bearing the following legal description, to-wit: A tract of land located in the South Half of the South Half of Section 14, Township 6 North, Range 66 West of the Sixth Principal Meridian, Weld County, Colorado and being more particularly des- scribed as follows: Beginning at the South Quarter Corner of said Section 14, and considering the South line of the South West Quarter of said Section 14, to bear South 89°43'10" West and with all other bearings contained herein relative thereto; Thence South 89°43'10" West, along the South line of the South West Quarter of said Section 14, 659.00 feet; Thence North 00°15'24" East, 460.37 feet to a point on the South Right-of-Way line of the Greeley No. 2 Canal; Thence along the South Right-of-Way line of said Greeley No. 2 Canal by the following five courses and distances; South 65°33'31" East, 15.60 feet; South 53°29'11" East, 235.00 feet; North 86°12'56" East, 290.32 feet; South 65°52'54" East, 158.62 feet; North 85°54'48" East, 85.83 feet; Thence South 00°15'24" West, along a line which is parallel to and 65.00 feet as measured at right angles to the East line of said South- west Quarter a distance of 271.44 feet to a point on the South East "C 7 Cr( 770713 • $OOK O9 1730532 Quarter of said Section 14; Thence North 89°53'17" West along the South line of said South East Quarter, 65.00 feet to the True Point of Beginning. Said tract of land contains 5.478 Acres and is subject to any right- of-way or other easements as granted or reserved by instruments of record or as now existing on siad tract of land. WHEREAS, the Board of County Commissioners finds that adding the 0.493 parcel to the 4.985 parcel awned by the applicant does not con- flict with the intent of the Weld County Comprehensive Plan, and will not have an adverse impact on the existing use of the land, and WHEREAS, the Board of County Commissioners has considered the recommendations of the Department of Planning Services on this matter and has reviewed information submitted by the applicant. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the 5 . 478 acre tract of land owned by the applicant, as described above, be, and hereby is , declared to be exempt from the definition of "sub- division" and "subdivided land" as set forth in Section 30-28- 101 (10) , CRS 1973, as amended, and in Section 2-1 of the Weld County Subdivision Regulations, and further finds that said 5. 478 acre tract shall be considered a single lot. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 12th day of September, A.D. , 1977 . Si of Si, Section 14, T6I1, R66W of the 6th p.m. , Weld County, Colorado, containing 0.493 acres.
