Ruiz La Fiesta Mexican Grill, Inc. 4322 State Highway 66 Longmont, Colorado 80504 Subject: SPR-258 & LC0032, Lot A of RE -123 being part of the NW4 of Section 26, T3N, R68W of the 6th P.M., Weld County, Colorado Dear Mr. Ruiz The recent addition of an exterior deck to the El Vaquero Mexican Restaurant (aka La Fiesta Mexican Grill, Inc) was installed without obtaining a building permit or discussing with staff to determine if an amendment to the Site Plan Review (SPR-258) would be required. Departmental records reflect that a building permit application has been submitted (BCR09-00661) after construction of, and use of, the structure. Discussion of this issue by Planning Staff on September 11, 2009 specific to the addition of the 30 x 33 foot uncovered deck addition to the premises, suggested that a substantial change had occurred on site that would require an amendment to the existing Site Plan Review (SPR-258). Given the determination of substantial change to the existing permit, staff will request that Mr. Ruiz meet with staff for a pre -application meeting prior to commencing with the land use application. This coordinated department meeting will bring representatives from Environmental Health, Public Works, Building and Planning to facilitate discussion on the amendment to the existing plan. There is no application fee associated with this meeting. The first step in this process is a Pre -Application Request meeting. Staff is providing a link to the electronic form that is requested to be completed prior to the meeting. Meetings are held Thursday and Friday of any given week. Please identify your day and time preference and staff will attempt to accommodate your request. You have thirty days from the date of this letter to file an appeal of the administrative decision in accordance with Section 23-6-20 of the Weld County Code.
