FINDINGS AND RESOLUTION CONCERNING REQUEST FOR RECORDED EXEMPTION PETITION OF WARREN O. WOODWARD The petition of Warren O. Woodward, Erie, Colorado, requesting exemption from definition of subdivision or sub- divided land pursuant to Section 9 of the Weld County Sub- division Regulations. The parcel in question contains approximately 34. 66 acres of dry agricultural land, and Mr. Woodward desires to split off from said plat a parcel of land containing 5 acres; said parcel of the whole, being more particularly described as follows, to-wit: A tract of land located in the Northeast Quarter (NEa) of Section 33, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado, described as follows: Commencing at the East Quarter (Ea) corner of said Section 33; thence westerly along the East-West centerline of said Section 33 a distance of 881. 32 feet to the true point of beginning; thence northerly and parallel with the East line of said Section 33 a distance of 664. 33 feet to a point on the North line of the S1, Sh, NEa of said Section 33; thence westerly along the last described North line a distance of 698. 09 feet to the Southeast corner of the W1, NEa, Sigh, NEa of said Section 33; thence northerly along the East line of the last described tract a distance of 664. 28 feet to a point on the North line of the N', S1, NEa of said Section 33; thence westerly along the last described North line a distance of 634. 96 feet to the Northwest corner of the Eh, NWa, Sigh, NEa, of said Section 33; thence southerly along the West line of the last described tract a distance of 664.22 feet to a point on the North line of the S', S', NEa of said Section 33; thence westerly along the last described North line a distance of 315. 87 feet to a point on the North-South centerline of said Section 33; thence southerly along the North-South centerline of said Section 33 a distance of 664 .20 feet to the center of said Section 33; thence easterly along the East-West centerline of said Section 33 a distance of 1632. 92 feet to the true point of beginning, containing 34. 66 acres, more or less, came on for hearing on July 12, 1976, and the Board of County Commissioners of the County of Weld, State of Colorado, having heard the testimony and evidence adduced upon said hearing and having considered the testimony, evidence, remonstrances and recommendations of the Weld County Planning Commission filed with said Board, and having carefully weighed the same, now makes the following findings: 1. The evidence discloses that the applicants failed to sustain the burden of proof as to the need for a recorded exemption, and that good cause has not been shown why such exemption should be granted as required by Section 9 of the Weld County Subdivision Regulations . 2. The evidence discloses that the proposed land division is not in conformance with the intent of the recorded exemption procedure which is defined as "a means whereby non- productive uses, insofar as such uses are compatible with surrounding agricultural uses in areas where such land divisions are proposed" . 3. The evidence and investigation show that the property in question is composed of Class IV and Class VI soils currently used for dryland agriculture. (0/ A)� //n 6i, '7S' 1 tJ 760597 4 . The evidence discloses that the proposed land division does not conform to the Weld County Comprehensive Plan in that it promotes non-agricultural use of agricultural land, and it would encourage urban encroachment on rural land use. 5. That each of the preceding findings in and of themselves and independent of each other constitutes a separate and individual ground for denial of a recorded exemption under Section 9 of the Weld County Subdivision Regulations . RESOLUTION WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, has heard the application of Warren O. Woodward, Erie, Colorado, for a recorded exemption under Section 9 of the Weld County Subdivision Regulations, of a parcel of land as hereinabove recited and made a part hereof by reference, and WHEREAS, said Board has made its findings on the evidence and testimony submitted to it, which findings precede this Resolution and by reference are incorporated herein and made a part hereof, and WHEREAS, the Board has carefully considered the Petition, the evidence, testimony and remonstrances and the recommendations of the Weld County Planning Commission and has given the same such weight as in its discretion deems proper, and is now fully advised in the premises. NOW, THEREFORE, BE IT RESOLVED, that the petition of Warren O. Woodward, Erie, Colorado, requesting a recorded exemp- tion under Section 9 of the Weld County Subdivision Regulations of a parcel of land indicated above be, and it hereby is denied on each of the grounds set forth in the Board's findings therein. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 14+h day of July, A.D. , 1976. Woodward, for a lot size variance and a Recorded Ex- emption. The parcel of land is described as part of the NEa of Section 33, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado. Said property is located immediately southwest of Ranch Eggs Subdivision. The subject property contains 34.66 acres of primarily Class IV and VI soils currently used for dryland agriculture. The request is to split the property into parcels of 29.66 acres and 5 acres. Mr. Woodward currently resides on the 29.66 acre parcel. The intent in creating the 5 acre parcel is so that Mr. Gilbert Clemons can buy and use said parcel for residential purposes. Mr. Woodward has submitted evidence that he has contracted with Left Hand Water Supply Company for five water taps and Mr. David Coleson of said water company verified that Mr. Woodward currently has five unused water taps. Mr. Woodward stated in a letter addressed to the Weld County Planning Commission dated June 8, 1976, that the purpose of purchasing his 35 acres was to later develop it into five acre tracts. Based upon the information submitted and the adopted policies in the County, the Planning Commission staff recommends for denial for the following reasons: 1 . The proposed split does not comply with the Weld County Comprehensive Plan because it would promote non-agri- cultural use of agricultural land and it would encourage urban encroachment on rural land use. The recorded exemption request is not in conformance with the intent clause of the Agricultural Zone District (Section 3.3 A of the Weld County Zoning Resolution) which states: "Intent - The intent in establishing the A-I Agri- cultural Zone District is to allow all agricultural and related uses in those areas in which agriculture is and should continue to be the predominant land use. This district is intended to discourage en- croachment of incompatible uses upon the agricul- tural land in the district, to encourage agricul- uses as the highest and best use of the land in the district as compared with other uses in con- flict therewith, and to provide for the orderly expansion of urban growth in conformance with the Weld County Comprehensive Plan. " The request would not be encouraging agricultural uses as the highest and best uses, it would not be providing for the orderly expansion of urban growth, and it would be breaking up a block of agricultural land. 3. The recorded exemption request is not in compliance with the in- tent clause of the recorded exemption procedure (Section 9-2 of the Weld County Subdivision Regulations) . Said clause states: "The intent in establishing the Recorded Exemption procedure is to provide, in accordance with the Weld County Comprehensive Plan, a means whereby non- productive agricultural lands may be developed for higher or more productive uses, in-so-far as such uses are compatible with surrounding agricultural uses in areas where such land divisions are proposed. (Rev. 4/17/74)" The parcel contains only one set of improvements and is currently non-irrigated land for the most part. The split would allow an extra set of improvements on the 5 acre parcel and therefore create an urban encroachment which would be non-compatible with the Agricultural District. 4. The minimum lot size in the non-irrigated Agricultural District is 160 acres. The intent is to maintain large enough tracts for farm purposes, and to assist in the encouragement of agri- cultural uses as the highest and best use of the land. The proposed split is in violation of that intent. County Commissioners June 9, 1976 Page 3 5. It is the feeling of the Planning Commission staff that this request is not in conformance with Section 9-4 (A) (10) of the Weld County Subdivision Regulations. Said section states: "That the method of disposition described in Section 9 is not being adopted by the applicant for the pur- pose of evading the requirement and intent of the Weld County Subdivision Regulations. (Rev. 4/17/74)" Since Mr. Woodward has five unused water taps and his stated in- tent is to subdivide his property into 5 acre parcels, it is the staff's feeling that he is circumventing the intent and re- quirements of the Weld County Subdivision Regulations. 6. This request is in violation of Section 9-4 (A) (3) of the Weld County Subdivision Regulations. Said section states: "That the lots resulting from the proposed land division shall be accessible from an existing public road with a minimum frontage in conformance with the Weld County Zoning Regulations.
