The Weld County Public Works Department reviewed the submitted application for critical items,
including but not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical
Soils Report, and Flood Hazard Development Permit. Comments made during this stage of the
review process will not be all inclusive, as revised materials are submitted other concerns or
issues may arise. All issues of concern and critical issues during further review must be
resolved with the Public Works Department.
COMMENTS:
WCR 20 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is
presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the
definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured
from the future right-of-way line. The most recent ADT count for WCR 20 reflects 171 vehicles
taken in 2007. The 85th percentile indicates that the average speed is 41 miles per hour with
11% of the traffic being trucks.
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the
state highways. Please contact Gloria Hice-Idler at the Greeley office to verify the access
permit or for any additional requirements that may be needed to obtain or upgrade the permit.
(U. S. Highway 85).
U. S. Highway 85 Access Control Plan WCR 20 (MP 245.19): An existing public road access
is on the east side of U. S. 85. This access currently functions as a full movement, un-
signalized intersection. Left turn/right turn improved acceleration/deceleration lanes (medium
priority) are required. Verify with CDOT. Add this paragraph to the plat drawing before
recording.
Improvements Agreement: The applicant shall enter into an Improvements Agreement
According to Policy Regarding Collateral for Improvements (Suncor Energy, Inc., USR-1709)
Haul Route: WCR 20 between the intersections of U.S. Highway 85 to the truck entrance of
the facility.
Improvements: In reviewing the traffic impact study, the applicant is identifying approximately
200 truck trips per day. Improvements associated with the heavy hauling and frequency trigger
upgrading, widening, and paving of WCR 20 from U. S. Highway 85 to the truck entrance of the
facility. Paving of the internal entrance and exit gate area, parking lot, and widening of the site
access radiuses to 45 feet shall be required. There shall be a minimum of 300 feet of paving
between the gravel section and WCR 20 to be used as a tracking pad before entering on to
WCR 20.

The applicant shall provide the County with construction drawings that detail the required
improvements. The plans shall consist of, at a minimum, main entrance intersection layout and
grading, cross section, approach road, internal truck circulation pattern, and adequate turning
radiuses. A geometric recommendation on depth of asphalt overlay and base to accommodate
heavy truck traffic shall be provided. These plans will require approval by the Public Works
Director/County Engineer or his representative. A registered professional engineer registered in
the state of Colorado must prepare the construction plans. The plans, when reviewed and
approved, will constitute a section of this agreement. They will be attached hereto and
referenced as Exhibit "A."
The applicant shall warrant and guarantee all improvements for a period of one year from
completion.
Maintenance
Suncor Energy agrees to excavate, repair, or patch any damage on said road that has been
created by heavy truck hauling from USR site. The type and method of repair will be
determined by the Public Works Director/County Engineer or his representative. The repairs
shall commence within thirty (30) days of receipt or our written notice.
There will be an annual road inspection in the spring to determine actual conditions and what
work is to be performed that summer if any repairs are needed.
At any time in the future, if road damage has increased beyond the point that repair of damage
can reasonably restore the road, Suncor Energy will pay proportional share for reconstruction of
those parts of said road.
Suncor Energy has addressed all the Colorado Department of Transportation (CDOT) access
issues at the intersection of U. S. Highway 85 and WCR 20.
Traffic Study: Weld County Public Works has received a Traffic Study for USR-1709 Suncor
Truck Uploading Facility prepared and stamped by Sten Bolander. After reviewing the submitted
Traffic Study I have prepared the following comments:
- The applicant has indicated that this site will produce 200 trips per day.
- The Colorado Department of Transportation (CDOT) has jurisdiction over all State highways.
Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-350-2163) to verify
if any improvements will be required at the intersection of WCR 20 and US -85 to accommodate
traffic from the Suncor site.
- A stop sign will be required to be installed at the access before traffic will enter onto WCR 20.
- The access will have 45' radius to accommodate the larger trucks entering and existing the
site.
- No parking or staging of commercial vehicles on the county road is allowed. Use on -site
parking area.

- The applicant is proposing approximately 200 truck trips per day. Improvements associated
with the heavy hauling and frequency trigger upgrading, widening, and paving of WCR 20 from
US 85 to the truck entrance of the facility.
-An eastbound right turn deceleration lane is warranted on WCR 20 into the project site access
based on the turning movement figures in the traffic study. The right turn deceleration lane will
account for:
• The heavy trucks in use which require longer deceleration times and lengths as
compared to passenger vehicles
• Public safety the 85th percentile is 41 mph on WCR 20 and there have been 2 accidents
in the past 4 yrs with 1 injury.
• Also for consistency with similar projects in the county which had the requirement of
acceleration and decelerations lanes.
Preliminary Drainage Report: A preliminary drainage report was submitted. It was stamped
and signed by Cameron Fowlkes, P.E. Number 39318. The P.E. stamp was not dated. The
drawings were not stamped, signed, and dated by a P.E.
The Final Drainage Report and all drawings must be stamped, dated, and signed by a
registered professional engineer licensed to practice in Colorado.
Please address all redline comments in the Preliminary Drainage Report and associated
drawings in the Final Drainage Report.
The acreage shown in the drainage report and used in the calculations does not match the
acreage shown in the USR Questionnaire. Please review and revise the drainage report and
calculations as necessary.
Please include a description of how the offsite flows will be routed through or around the
property.
Please provide calculations showing that the roadside ditch can handle the 5 -year historic
release.
Please provide detail drawings for all drainage related features including but not limited to:
ditches, swales, spillway, riprap design, filter bedding design, orifice plates, water quality control
plates, and detention pond.
Please submit electronic files of the CUHP and spreadsheet models that were used.
Please show all drainage related features in a drainage easement on the drawings and include
a metes of bounds description of the drainage easement.
Please add a note to all drawings and plats that states "Weld County is not responsible for the
maintenance of drainage related features."
Geotechnical Soils Report: One geotechnical report dated April 24, 2001 and one dated
November 24, 2006 was submitted. Neither report appeared to have been stamped, signed,
and dated by a professional engineer. Readable copies of the Geotechnical Reports that are
clearly stamped, signed, and dated by a registered professional engineer licensed to practice in
the State of Colorado is required.

The pavement design included in the November 24, 2006 Geotechnical Engineering Report is
for on -site conditions only. If off -site road improvements are required, the applicant must submit
a Geotechnical Report with addresses the off -site pavement designs.

Weld County Public Works has received a Traffic Study for Suncor Energy prepared and stamped by Stan
Bolander. After reviewing the submitted traffic study I have prepared the following comments:
- WCR 20 is a local gravel road and requires a 60 -foot right-of-way at full build out. The most current road
counts for WCR 20 are 171 AADT taken in August of 2007
- The most current traffic count for US -85 in this area was conducted in 2007, the AADT was 17,900.
-In the past 4 years there was 1 property damage only traffic accident at the intersection of WCR 20 & US 85.
- Please install 60' radius curves at the site access to accommodate large trucks turning at the intersection.
-It does not appear that a sight distance analysis was performed for the project site or the hauling route.

Environmental Health Services has reviewed this proposal for an oil and gas storage
facility. The property will be utilized for a crude oil, truck unloading facility. At full build -
out there will be approximately 10 truck unloading bays, a 3500 square foot office and a
1500 square foot grind out shack.
The application states that water will be supplied from an existing well located at the
adjacent Suncor site to the west. However, documentation was also supplied that
indicates the subject property is eligible for an individual well. Due to the issues that
may arise with the sharing of wells, should the property sell to another entity, this
Department would prefer Suncor obtain an individual well for this property. However if a
shared well is the preferred option the following items are required, a copy of the well
permit that allows for a shared use, and a recorded document providing for the shared
well operation and maintenance by both parcels of land. The shared well documents
recordation number and a joint easement agreement shall be indicated on the plat.
As the office building will not be constructed for a few years there must be an alternate
plan to provide sanitation for people who enter the site. Section 30-2-10 of the Individual
Sewage Disposal System Regulations state "The owner of any structure where people
live, work, or congregate shall ensure that the structure contains an adequate,
convenient, sanitary toilet and sewage disposal system in good working order."
The applicant indicated in an email dated August 19, 2009, that personnel will either use
the Suncor site to the west or portable toilets and bottled water will be provided on the
truck unloading site until the office is constructed.
It is the policy of this Department that portable toilets, handwashing units and bottled
water are allowed when a use is temporary or seasonal. The definition of temporary is
six months or less.
The adjacent Suncor site is west of the existing ditch so there is not a direct route to
their restroom facilities. If it is determined the adjacent site can be utilized for sanitation
needs, an engineer's report will be required to ensure the existing septic system is
adequate for the additional hydraulic load.

A dust abatement plan and a waste handling plan were submitted with the application.
Additional information is required prior to approval of both plans.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division (APCD), Colorado Department of Health and Environment. Alternately,
the applicant can provide evidence from the APCD that they are not subject to
these requirements.
2. The applicant shall submit an updated dust abatement plan, detailing on site dust
control measures, for review and approval, to the Environmental Health Services,
Weld County Department of Public Health & Environment.
3. The applicant shall submit written evidence from the Colorado Division of Water
Resources, demonstrating that the adjacent well is appropriately permitted for the
shared industrial use.
4. The application materials indicate that two parcels are proposed to share a
common well. Therefore, the applicant shall submit a document providing for
shared well operation and maintenance by both parcels of land. The declaration
shall be recorded and the recordation number indicated on the plat. A joint
easement agreement shall be indicated on the plat.
5. Alternately to items 3 and 4, the applicant shall submit written evidence from the
Colorado Division of Water Resources, demonstrating that an individual well is
available, on this parcel, for the industrial use.
6. In the event the applicant intends to utilize the existing septic system at the
adjacent site, for employee and driver use, the septic system shall be reviewed
by a Colorado Registered Professional Engineer. The review shall consist of
observation of the system and a technical review describing the systems ability to
handle the proposed hydraulic load. The review shall be submitted to the
Environmental Health Services Division of the Weld County Department of Public
Health and Environment. In the event the system is found to be inadequately
sized or constructed the system shall be brought into compliance with current
Regulations.

7. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be
provided to Environmental Health Services Division of the Weld County
Department of Public Health & Environment. In accordance with Section 3-6-1 of
the Colorado Department of Labor and Employment Division of Oil and Public
Safety Storage Tank Regulations (7 C.C.R. 1101-14) as well as EPA regulations
(40 CFR Part 112) for above and below ground storage tanks. Alternately, the
applicant can provide evidence from the EPA and CDL&E that they are not
subject to these requirements.
8. The applicant shall submit an updated waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirement be incorporated into the permit as a
condition that must be met one month prior to construction activities:
1. The applicant shall submit evidence of a Colorado Discharge Permit System or
CDPS permit from the Colorado Department of Public Health and Environment
(CDPH&E), Water Quality Control Division, to cover stormwater discharges from
construction sites (5 CCR-1002-61) Alternately, the applicant can provide
evidence from CDPH&E that they are not subject to the CDPS requirements.
We recommend that the following requirement be incorporated into the permit as a
condition that must be met prior to the issuance of the Certificate of Occupancy for the
office building:
1. An individual sewage disposal system is required for the proposed office facility
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations. The septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County Individual
Sewage Disposal Regulations.

We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7 CCR 1101-14).
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
7. Any vehicle washing area shall capture all effluent and prevent discharges from
drum washing and the washing of vehicles in accordance with the Rules and
Regulations of the Water Quality Control Commission, and the Environmental
Protection Agency.
8. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in Section 14-9-30 of the Weld County Code.
9. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility, at all times.
10. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
11.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.

12.This application is proposing a well as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. domestic use only, etc.
Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.
13.All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All
chemicals must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations.
14. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
15. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

We have reviewed the above referenced proposal for the construction and operation of a crude oil
trunk unloading facility:
Since the submitted material does not appear to qualify as a "subdivision" as defined in §30-28-
101(10)(a), C.R.S., pursuant to the State Engineer's March 4, 2005 memorandum to county planning
directors, this office will only perform a cursory review of the referral Information and provide comments, The
comments will not address the adequacy of the water supply plan for this development or the ability of the
water supply plan to satisfy any County regulations or requirements. In addition, the comments provided
herein cannot be used to guarantee a viable water supply plan or Infrastructure, the Issuance of a
well permit, or the physical availability of water.
According to the submitted information, potable water will be supplied by an existing well located at
the Fort Lupton pump station, however no well permit number was provided. Note, that if potable water is
proposed to be used from the Fort Lupton pump station well the applicant needs to demonstrate that the
water is permitted or decreed for drinking and sanitary facilities in a commercial business.
In addlUon, the applicant indicated that based on a preliminary analysis of the ground water
availability, a non -tributary Lararnie-Fox Hills aquifer well permit may be available for the property. The ability
of the property to obtain a well permit will be evaluated at the time that the well permit application Is
submitted to our office,
