Environmental Health Services has reviewed this proposal for an oil and gas production
facility.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
1. The applicant shall submit a dust abatement plan, on site dust, for review and
approval, to the Environmental Health Services Division of the Weld County
Department of Public Health & Environment.
We recommend that the following requirement be incorporated into the permit as a
condition that must be met 45 days after first production:
1. The applicant shall submit evidence of an Air Pollution Emission Notice (APEN)
application from the Air Pollution Control Division, Colorado Department of
Health and Environment. Alternately, the applicant can provide evidence from
the APCD that they are not subject to these requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.

3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
5. The operation shall comply with all applicable State noise statutes and/or
regulations.
6. Adequate toilet facilities (portable toilets) and hand washing units shall be
provided during drilling/construction.
7. Bottled water shall be utilized for drinking during drilling/construction.
8. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
9. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

SUBJECT: USR-1690, HP Farms Holding LCC
The Weld County Public Works Department has reviewed this proposal. This project falls
primarily under the purview of the Use by Special Review Standards, Weld County Code,
Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows:
COMMENTS:
WCR 22 is a major arterial road and strategic roadway, which requires a 140 -foot right-of-way at
full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld
County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the
required setback is measured from the future right-of-way line.
The most current road count for WCR 22 is 839 AADT, taken in September of 2007.
REQUIREMENTS:
Final Plat:
1. Please indicate how the proposed oil and gas operation will correlate the Pioneer PUD
development.
a. The applicant shall work to ensure that all oil and gas roads will not block any
proposed Pioneer residential roads and that there will be adequate turning radii
(minimum of 60') on any road intersections.
b. Should the Surface Use Agreement not address road maintenance, a long term
road maintenance agreement will be required between the applicant and the
Pioneer Metro District.
c. A long term maintenance agreement for Pioneer PUD residential streets shall be
with the Metro District and the applicant to pay for damage to roads caused by
heavy truck traffic.
2. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds.
3. The applicant is required to comply with all Colorado Department of Health and
Environmental (CDPHE) regulations regarding berming and spill prevention for materials
and liquids stored on site.
4. All drawings shall be stamped and signed by a registered professional engineer,
licensed to practice in the State of Colorado.
Storm Water Drainage & Flood Hazard Development Standards:
1. A portion of the property lies in a Special Flood Hazard Area (SFHA) defined by the
Federal Emergency Management Agency (FEMA). This SFHA is delineated on the
current effective Flood Insurance Rating Map (FIRM), panel number 080266 0900 C,
dated September 28, 1982.
2. The applicant is required to comply with Weld County Code (Section 23-5 and 23-5-260-
N) requirements for anchoring oil and gas facilities located in floodplains and floodways
where applicable.
3. The applicant is required to comply with all Colorado Oil and Gas Conservation
Commission (COGCC) rules and regulations including drill pad construction, storm water
controls, and reclamation.
Access:
1. The access shall be paved either 300 feet from the edge of pavement on WCR 22 or
from the edge of pavement to the existing cattle guard and where another cattle guard
immediately north of the existing one shall be installed. Therefore, there will be a double
cattle guard at this location.
2. A 60 -foot radius is required on all accesses to public roads designed to accommodate
truck traffic.
3. Please install two "TRUCKS TURNING AHEAD" signs on WCR 22, one to the west and
the other to the east of the site access. The distance from the access to the signs shall
be governed by the current edition of the Manual on Uniform Traffic Control Devices
(MUTCD) Table 2C-4.
4. Please provide detailed drawings of the access road improvements as well as sign
installation locations.
5. There shall be no staging or parking of commercial vehicles on County Roads.
6. If a drainage culvert is required, a 15 -inch corrugated metal pipe is the County's
minimum size requirement. If the applicant chooses to place a larger culvert, please
contact the Public Works Department to adequately size your culvert.
7. Contact Amy Burry, Utility Coordinator for Weld County Public Works, at (970) 304-6496
ext. 3764 for a Right -of -Way permit for any work that may be required in the right-of-way
of WCR 22. A special transport permit will be required for any oversized or overweight
vehicles that may access the site and may be obtained by contacting Amy as well.
8. An improvements agreement according to policy regarding collateral for improvements
shall be required for the access road with both Exhibits A & B filled out.
The applicant shall address the comments listed above for this review process. Comments made during
the USR stage of the review process may not be all-inclusive, as revised materials must be submitted and
other concerns or issues will arise during further review. Issues of concern must be resolved with the
Public Works Department prior to recording:

Dear Ms. Hatch:
The Colorado Division of Wildlife (CDOW) appreciates the opportunity to review and comment on this oil and
gas development project proposal. District Wildlife Manager (DWM) Chris Mettenbrink visited the site, and
compiled comments for your review. The project site lies adjacent to Klug Lake (NE12 T2N R65W), which is
surrounded by mature cottonwood trees. The site itself is primarily a sand -sagebrush grassland type of habitat.
Wildlife that can be found in sand -sagebrush habitats include: deer, coyotes, miscellaneous species of small
mammals, grassland birds, and raptors. The association of mature cottonwood trees to Klug Lake creates a
valuable breeding and use area for raptors at this site. During the field visit, which occurred before the start of the
•breeding season, DWM Mettenbrink did not observe any raptor nests, but did note a high level of raptor activity
in the cottonwood stands. Hawks, eagles, and their nests are protected under the Migratory Bird Treaty Act from
take or disturbance. CDOW has recommended guidelines for buffer zones regarding raptor nests to prevent
accidental take of raptors through disturbance or abandonment during active nesting periods. If project onset
occurs between February 15 and July 15, we recommend that the cottonwood stands along Klug Lake be surveyed
for raptor nests. If nests are discovered please refer to

for recommended setbacks and timing restrictions to minimize negative impacts on raptors, or consult with
DWM Mettenbrink on how to proceed.
While the area impacted by drilling and completion of wells is relative small (3 acres), CDOW recommends that
disturbed areas be revegetated using seed mixtures appropriate for the site and that appropriate steps be taken to
control noxious weeds including cleaning of machinery before being delivered to the property, and again before
the equipment is taken away to remove excess dirt and mud that may contain weed seeds. During drilling
operations and finishing the well, please clean equipment periodically to remove weed seeds. Prompt site
reclamation, including implementation of a weed management plan developed with the assistance of local
nuisance weed staff personnel, should occur as quickly as possible after drilling and well completion is complete.
