RE: APPROVAL OF RECORDED EXEMPTION NO. 343 - MR. AND MRS . HERMAN
SCHELLER.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 18th day of October, 1978 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption number 343, being the property of
Mr. and Mrs . Herman Scheller, described as the Northwest Quarter
of Section 3, Township 6 North, Range 65 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described as
follows :
The Northwest Quarter (NN14) of Section 3, Township
6 North, Range 65 West of the 6th P.M. , except
4.688 acres conveyed by Deed recorded in Book
576 at page 16 of the Weld County, Colorado records.
Said described parcel of land contains 155 acres,
more or less, and is subject to any rights-of-way
or other easements as recorded or as now existing
on said described parcel of land.

"subdivision" and "subdivided land, " pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A (3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by Mr. and Mrs. Herman Scheller, be and

RE: Recorded Exemption #343
Dear Commissioners :
The attached application, plat and related items are in reference
to a request by Mr . and Mrs. Herman Scheller for a recorded exemp-
tion. The property on which the recorded exemption has been
requested is described as the NW4 of Section 3, T6N, R65W of the
6th P.M. , Weld County, Colorado. This property is located three
miles east of the Town of Eaton. The property contains approxi-
mately 155 acres of Class I , II , and III irrigated soils. The
request is to split the property into parcels of 4. 568 acres and
150.4 acres.
Mr. and Mrs. Howard Harper have a contract to purchase the Scheller
farm without the improvements. They will work and farm in con-
junction with ther son ' s farming and feeding operation which is
located approximately one mile from this property. Mr. Ivan
Gilbaugh has agreed to purchase the improvements located on the
4. 568 acre parcel to consummate the purchase of the farm.
Based upon the information submitted and the adopted policies in
the County, the Department of Planning Services staff recommends
the request be approved for the following reasons :
1. The proposed split conforms with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County
Subdivision Regulations) , the intent clause of the Agricultural
Zone District (Section 3. 3 A. of the Weld County Zoning Reso-
lution) , and the Weld County Comprehensive Plan in that the
use will be compatible to surrounding agricultural use. Agri-
culture and related uses will continue to be the predominant
land use.

2. The request complies with the provisions of Section 9-4 A. of
the Weld County Subdivision Regulations.

Daar Mr. Dunbar:
Attached hereto is application for recorded exemption along with contract
for sale on the Northwest Quarter of Section 3, Township 5, Range 65.
The above described property was recently sold by the Gilbaugh Agency to
a Howard G. Harper and Helen L. Harper from Ligonier, Indiana. These
folks are moving to Colorado to be with their son and daughter-in-law,
Mr. and Mrs. Harold Harper who live approximately one mile from this
property.
They, the Howard Harpers, wish to purchase the farm without the improve-
ments and work and farm in conjunction with their son' s farming and feeding
operation. I have agreed to purchase the improvements and approximately
five acres from the Harpers in order for them to consummate the purchase
of this parcel. The present residence on the above described property is
a two-story home consisting of five bedrooms, large living room, dining
room, country style kitchen and a 20 x 30 foot family room. This is
entirely too large to maintain for a couple in their upper sixties. Mr.
and Mrs. Howard Harper basically are moving to Weld County to be with their
son and daughter-in-law and quite possibly live in the second home which
is located on the son' s farm.
This parcel has had no division since August 30, 1972. We are therefore
requesting a recorded exemption on this parcel. Thank you for your
favorable consideration.
