RE: APPROVE RESCISSION OF RESOLUTION #2009-3158, DATED DECEMBER 7, 2009,
CONCERNING LEASE AGREEMENT FOR STORAGE SPACE WITH NORCO ATHLETIC,
INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution #2009-3158, dated December 7, 2009, the Board approved a
Lease Agreement for Storage Space between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Department of
Human Services, Family Educational Network of Weld County (FENWC), and NORCO Athletic, Inc.,
commencing December 1, 2009, and ending December 31, 2012, with further terms and conditions
being as stated in said lease agreement, and
WHEREAS, after review, the Board deems it advisable to rescind said lease agreement
approved by Resolution #2009-3158, dated December 7, 2009, and
WHEREAS, the Board deems it advisable to direct the County Attorney to negotiate a
revised Lease Agreement between the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of the Department of Human Services,
Family Educational Network of Weld County (FENWC), and NORCO Athletic, Inc., commencing
December 1, 2009, and ending December 31, 2009, with further terms and conditions being
deemed acceptable by Community Development Institute Head Start ("CDI"), a Colorado non-profit
corporation, whose address is 1005 East Harvard Avenue, Suite 700, Denver, Colorado 80231,
which is to acquire control of the Weld County Head Start Grant, effective January 1, 2010.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Resolution #2009-3158, dated December 7, 2009, approving the Lease
Agreement for Storage Space between the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of the Department of Human Services,
Family Educational Network of Weld County (FENWC), and NORCO Athletic, Inc., be, and hereby
is, rescinded.
BE IT FURTHER RESOLVED by the Board that the County Attorney be, and hereby is,
directed to negotiate a revised Lease Agreement between the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, on behalf of the Department of
Human Services, Family Educational Network of Weld County (FENWC), and NORCO Athletic, Inc.,
commencing December 1, 2009, and ending December 31, 2009, with further terms and conditions
being deemed acceptable by CDI, which is to acquire control of the Weld County Head Start Grant,
effective January 1, 2010.
