HomeMy WebLinkAbout20090322.tiffSig Ent COLORADO MEMORANDUM TO: JACQUELINE HATCH, PLANNING SERVICES FROM: LAUREN LIGHT, ENVIRONMENTAL HEALTH d SUBJECT:USR-1681 CHARLES AND ALICE GREENMAN DATE: 12/4/2008 Environmental Health Services has reviewed this proposal for a warehouse for antique furniture and personal vehicles/trailer. The property is developed and was previously reviewed under SPR-384. The parcel is served by the Longs Peak Water District (tap 13518). The septic system is permitted under permit number G19939120 (a Statement of Existing) and was evaluated for adequate size and capacity on October 21, 2002. The results of that evaluation found that the system is of sufficient size and capacity to handle the flow for a three -bedroom home. However, be aware that evaluations based on Statements of Existing relies on information the property owner provides, under oath, indicating the current status of the system, as opposed to the Department inspecting the system as a part of the installation process. According to the owners there are no plumbing fixtures in the existing retail shop and none were observed at the time of inspection (October 21, 2002) by Environmental Health staff. It is not clear from this application if there will be any customers who come to the site. However, if there are customers, this department recommends that the restroom in the house be utilized. As the septic system appears to be sized for 6 people, an engineers evaluation would be required to ensure the system could handle the additional flow if more then 6 people utilize the system on a daily basis. The previous application (CZ -1026) indicated that there are water -based, non- flammable restoration products available for purchase, and that all furniture refinishing is performed at separate facility under contract. If that is still the case, and with the understanding that no open containers of refinishing products are stored or used on site, the Department will not require a waste handling plan to be submitted. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. EXHIBIT 3-- 2009-0322 • • • 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. 6. Adequate toilet and handwashing facilities shall be provided for patrons. The patrons shall be allowed to use the toilet facilities located in the residence. 7. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. If more then 6 people will utilize the existing septic system (G19939120) on a daily basis, the system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems' ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized, or constructed the system shall be brought into compliance with current Regulations. 8. The facility shall utilize the existing public water supply. (Long's Peak Water District) 9. This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: Weld County Road Classification Plan (FHU): (June 2002) WCR 1 is a major arterial road, which requires a 140 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Access: The access is from WCR 1 (County Line Road) at two locations. The main access point to the antique/furniture restoring shop and paved parking area is located at the front of the parcel. The flagpole access configuration is located to the rear of the property. Utilize both existing accesses as they are critical to his parcel. REQUIREMENTS: Future Right -of -Way: The applicant is showing an existing and the future right-of-way on the plat drawing. Place both dimensions (existing and future) on the plat. Access/Parking: Utilize the paved parking area for the business and provide an all-weather access to the rear of the property where the applicant has identified some additional parking and access to the rear of the property. Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. The applicant must take into consideration storm water capture/quantity and provide accordingly for best management practices. Summary: This case is a change of zone from A to C-1 and E (Estates) The Greenman's facility already exists. The Public Works Department has reviewed this application several times. WCR 1 is upgraded. The Fire District does not object to the use of the property for a home antique business or the change in zone provided no change in the current use occurs. The Fire District understands that the garage buildings are for personal use and storage and that the shop building is open to the public for antique sales, refinishing and repair of furniture. The refinishing operation consists of light woodwork (repair and sanding where there is no "manufacturing") and refinishing operation is with non -hazardous water -based materials.
