Environmental Health Services has reviewed this proposal for a gift shop, vending
machines and lottery sales. A cistern, for potable water usage, (CP09-001) was
approved by the Board of Health on January 27, 2009 with the following requirements:
'Tank shall be sized to 2000 gallons, which constitutes approximately a 13 day supply
for 27 people per day. Per cistern regulations this is five gallons per person per day for
customers and 15 gallons per person per day for employees. (Approx. 25 customers
and 2 employees)
A bacteriological analysis must be performed by an approved lab on a quarterly basis
and results submitted to WCDPHE.
This permit shall remain in effect ONLY for the usage of a point of sales lottery outlet
with vending machines filled with prepackaged food items. Owner must submit a
variance request and pay the fee should the circumstances change in regards to the
retail sales of food and appear before the Board of Health for re-evaluation of this permit
In accordance with Weld County Code, Chapter 14, Article III "Cistern Water", upon the
availability of water from a private well or any community water supply, this permit will
not be valid. You must obtain water from that water supply.
Water to fill the cistern must be from an approved water source. Applicant must provide
documentation of said water source before final approval.
Prior to receiving a final permit for use of the cistern, the following must occur
Our Division must do a final inspection of the cistern after it has been installed (but not
yet covered with dirt) and is full of water. You must schedule this inspection.
Our Division must collect a water sample for bacterial analysis. This sample will be
collected at the time of inspection. The analysis must reveal that the water in the cistern
is suitable for human consumption. In the event the test fails, a retest must be
conducted at an additional cost."

As the cistern usage is sized for 27 people per day, this USR will have to restrict the
number of people on site per day.
The septic system is permitted under permit number SE -0900009 and was evaluated for
adequate size and capacity, by this department, on February 18, 2009. The results of
that evaluation found that the system is of sufficient size and capacity to handle the flow
for a one -bedroom residence with an attached lottery store and 2 employees. The
engineers' evaluation, received with the application, indicates the system is sized for up
to 50 customers.
Only prepackaged food, in a vending machine, is allowed without a food license. All
Colorado Retail Food Establishment Rules and Regulations must be adhered to.
Neither the existing septic system nor the cistern is sufficient to service a restaurant
facility.
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan, for on site dust, for review and
approval, to the Environmental Health Services, Weld County Department of
Public Health & Environment.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).

We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
7. Adequate toilet and handwashing facilities shall be provided for patrons and
employees, at all times
8. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
9. The facility shall utilize the cistern permitted under CP09-001 for water supply.
10. No more then 27 people per day shall utilize the site based upon the capacity of
the cistern (CP09-001).
11.The applicant shall comply with Colorado Retail Food Establishment Rules and
Regulations governing the regulation of food service establishments.
12.The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

On February 18, 2009, an evaluation of the existing individual sewage disposal system at:
68777 Highway 85, Carr, Colorado;
Section 21, Township 12 North, Range 66 West,
was conducted by Stephen J. Wiatrowski, an Environmental Health Specialist of this department.
The existing individual sewage disposal system is of sufficient size and capacity to adequately handle the
proposed load. This evaluation is based on a final treatment capacity for a 1 bedroom residence with an
attached Lottery Store with a total of 2 employees.
Be advised, neither the County of Weld nor any of its agents or employees undertake or assume any
liability to the owner of the above property, to any purchaser of the above property or to any lending agency
making a loan on the above property or in the report.
This inspection was conducted for the purpose of determining compliance with current regulations and for
detecting health hazards observable at the time of inspection. This does not constitute a warranty that the
system is without flaw or that it will continue to function in the future. Inspections requested during
periods of snow cover and high soil saturation may be of questionable value to potential buyers due to
adverse conditions. Evaluations based on Statements of Existing (S.O.E.) relies on information the
property owner provides, under oath, indicating current status of the system and representing to the best of
his/her knowledge the system is not failing to function properly.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
Access:
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways.
Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-350-2163) to verify the access
permit or for any additional requirements that may be needed to obtain or upgrade the permit. (U. S. Highway
85)
The applicant has provided an application with a Permit No. 408136 dated November 17, 2008, to verify
access from CDOT.

We have reviewed the above referenced proposal for a Development Plan and Use by Special
Review for a Colorado Lottery Retail Store. The submitted material does not appear to qualify as a
"subdivision" as defined in Section 30-28-101(10)(a) C.R.S. Therefore, pursuant to the State Engineer's
March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of
the referral information and provide comments. The comments will not address the adequacy of the water
supply plan for this development or the ability of the water supply plan to satisfy any County regulations or
requirements.

The information we received from the County did not include a Water Supply Information Summary
Sheet, or an estimate of the annual volumetric water demand for the property. The information provided
included a copy of well permit no. 123512, a statement that a cistern will be used, and a statement that
extensive landscaping is in place.
Well permit no. 123512 was issued on November 25, 1981 as a late registration of an existing well
for domestic use and for irrigation of not more than one acre of home gardens and lawns. As a domestic
well, the water from this well may only be used for residential purposes, and cannot be used to supply a
commercial business. We also note that the location of the well on the permit is 100 feet from the north
section line and 500 feet from the east section line, a location that is not on the parcel of this proposal.

Based on the information provided, it is not clear if the residential well (#123512) is proposed to be
used to serve all or a portion of the commercial operation. If the well will be used to serve the business, a
commercial well permit must first be obtained. Water from this well for the business is not a permitted use
of the water and should not be approved by the County as an acceptable source.

Site Specific Development Plan and Special Review Permit for a Mercantile Business
(M occupancy classification) located in the A (Agricultural) District.

There is one (1) historical building permits attached to this parcel, it has been finaled
1. A building permit shall be obtained prior to the change of use, alteration or construction of
any structures.
2. A plan review is required for each building for which a building permit is required. Two
complete sets of plans are required when applying for each permit. Include a Code Analysis
Data sheet provided by the Weld County Building Department with each Building permits
Submittal plans shall include a floor plan showing the specific uses of each area for the building.
The Occupancy Classification will be determined by Chapter 3 of the 2006 International Building
Code. The plans shall also include the design for fire separation and occupancy separation
walls, when required by Chapter 5 and 7 of the 2006 International Building Code. Fire Protection
shall conform to Chapter 9 and exiting requirements by Chapter 10.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006
International Building Code; 2006 International Mechanical Code; 2006 International Plumbing
Code; 2006 International Fuel Gas Code; and the 2008 National Electrical Code and Chapter 29
of the Weld County Code.
