RE: APPROVAL OF RECORDED EXEMPTION NO. 368 - MR. SHELDON AND
EVELYN STILLMAN.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 15th day of January, 1979 in the Chambers of the Board
of County Commissioners of Weld County, Colorado, that the
division into two parcels of a certain parcel of land, as shown
on the plat known as Recorded Exemption No. 368, being the pro-
perty of Sheldon and Evelyn Stillman, described as part of the
Southeast Quarter of Section 26 , Township 1 North, Range 66
West of the 6th P.M. , Weld County, Colorado, being more particu-
larly described as follows :

"subdivision" and "subdivided land, " pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations aid the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-lA (3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Sheldon and Evelyn Stillman be, and hereby
is, exempt from the definition of the terms "subdivision" and
"subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 15th day of
January, A.D. , 1979.

Dear Commissioners:
The attached application, plat and related items are in reference to a
request for a recorded exemption by Mr. Sheldon and Evelyn Stillman.
The property is described as Pt . SE* Section 26, T1N, R66W of the 6th
P. M. , Weld County, Colorado. The property is located 1/2 mile west
of Lochbuie on the north side of Weld County Road 4. The property con-
tains approximately 40 acres of Class III , IV and VI irrigated soils.
The request is to split the property into parcels of 5. 00 acres and
35. 05 acres.
On May 30, 1978, the Board of County Commissioners approved a request
by Mr . Charles Kinder , legal representative for Mr . Sheldon and Evelyn
Stillman, for lot size variance so that he could make application for
this recorded exemption. At the time they made the deicision on that
request , the Department of Planning Services Staff submitted a letter
of recommendation to the Board. A copy of that letter of recommenda-
tion is included in the attached packet . Nothing has been received by
our office that would change our recommendation of approval for this
request as outlined in the letter to the Board of County Commissioners
dated August 28, 1978. This request complies with the provisions of
Sec 'on 9-4 A. of the Weld County Subdivision Regulations .

RE: Lot Size Variance #66
Dear Commissioners :
The attached letter and related materials are in reference to a request
by Mr . Charles Kinder for a lot size variance. The property is described
as the East 660 feet of the SEA of Section 26 , T1N, R66W of the 6th p.m. ,
Weld County, Colorado . This property is located A mile west of Lochbuie
on the north side of Weld County Road 4 . The property contains approx-
imately 40 acres of Class III , IV, and VI irrigated soils. There is an
existing set of improvements located in the SE corner of this property at
the present time. The request is to obtain a variance from the minimum
lot size requirement , Section 9-4 A , (6) , so that he can make application
to apply for a recorded exemption . If this lot size variance is granted,
Mr. Kinder will proceed with his application for a recorded exemption
to divide the property into two parcels . Mr. Kinder wishes to purchase
five acres and live on the property making it easier for him to care for
the horses located on the property.
Based upon the information submitted and the adopted policies in the
county, the Department of Planning Services staff recommends this request
be approved for the following reasons :
1 . The request is in compliance with the intent clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations) in that the proposed use of the property will be com-
patible with the surrounding agricultural land uses.
2. The request is in compliance with the intent clause of the Agri-
cultural Zone District (Section 3. 3A of the Weld County Zoning
Resolution) and the Weld County Comprehensive Plan in that the
request will be encouraging a related use to agriculture which
is the predominant land use. x

3. The Town of Lochbuie Planning Commission has no objections to this
request .

Dear Mr. Cunliffe:
We have reviewed the material submitted for this case . The well
permit (No. 87092) submitted as evidence of a dependable water supply is
for a stock water well. Our Ground Water Section has indicated that this
permit can be used for a domestic well on this tract of land. However, the
owner must formally change the use on the permit to "domestic" with our
Ground Water Section. We suggest that if the lot size variance is granted,
the owner immediately contact this office to change the use classification.
