Upgrade of the Lilli Plant
The Weld County Public Works Department reviewed the submitted application for critical items, including but
not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood
Hazard Development Permit. A detailed review of these items was not complete at this step in process.
Comments made during this stage of the review process will not be all inclusive, as revised materials are
submitted other concerns or issues may arise. All issues of concern and critical issues during further review
must be resolved with the Public Works Department.
COMMENTS:
Section Line Access: (right-of-way) The applicant has completed a Nonexclusive License Agreement for the
Upgrade and Maintenance of Weld County Right -of -Way. (WCR 96)
Weld County Road Classification Plan (FHU): (June 2002) WCR 127.5 is a local gravel road and requires
w60 -foot right-of-way at full build out. There is presently a 6O -foot right-of-way. This road is maintained by
eld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required
setback is measured from the future right-of-way line.
The Weld County Public Works Department has no traffic counts available for either roadway. (WCR 127.5
and WCR 96).
A blue and white crossroad sign identifying section line access and non -county maintenance has been
installed at the intersection of WCR 96 section line and WCR 127.5. This sign will provide identification for
location of the Lilli Gas Processing Plant for emergency access such as fire and EMT responders.
Access: Access to the facility is from WCR 96 section line access. The site is fenced with three strand
barbed wire fencing. The site has two existing access points with cattle guards, %-inch road base has been
placed, and circulation of the facility appears to be adequate.
Contact Amy Burry, Utility Coordinator for Weld County Public Works, at (970) 304-6496 ext. 3764 for a Right -
of -Way permit for any work that may be required in the right-of-way on WCR 96 or WCR 125. A special
transport permit will be required for any oversized or overweight vehicles that may access the site and may be
obtained by contacting Amy as well.
Grading Permit: Don Dunker, Senior Engineer, will sign off on the Grading Permit once the collateral has
been posted.
A traffic study will not be required as the applicant is indicating two to three employees manning the facility.

preliminary Drainage Report: A preliminary drainage report is not required for the application. However, a
water quality feature is required. The calculations that were submitted as part of the application reference
ASCE published runoff coefficients. The applicant provided copies of the ASCE runoff coefficients. It is very
important to note that the runoff coefficients are not the same as impervious area. Future submittals
must use accepted impervious values not the ASCE runoff coefficients. However, for this case, the water
quality calculations appear to be adequate.
The plat needs to show the water quality feature in a drainage easement. A metes and bounds description of
the drainage easement must be recorded by separate document.
Geotechnical Report: Not required.
Flood Hazard Development Permit: The site is not in a floodplain. Therefore, a FHDP is not required.

The Weld County Public Works Department has reviewed this proposal. Staff comments made during this
phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining
application process. Issues of concern must be resolved with the Public Works Department. Our comments
and requirements are as follows:
COMMENTS and REQUIREMENTS:
The latest emailed grading plan, received Tuesday July 28, 2009 at 7:35 a.m. from Sherri Robbins with Petro -
Canada will require updates for the following items including but not limited to:
Label the proposed and existing contour lines. The proposed contours shall tie into the exiting contours.
Indicate what best management practices (BMP's) will be used to control sediment from leaving the site.
•legend indicating all line types, symbols that are on the plan.
clude all details needed for the erosion control portion of the plan.
Show and label all the erosion control items in the plan view.
Provide culvert sizes on the plan.
The plan shall be stamped, signed and dated by a licensed Engineer able to practice within the State of
Colorado.
A final storm water approved construction permit from CDPHE for this site needs to be submitted and accepted
by Public Works before a grading permit will be issued one.

The Weld County Department of Public Health and Environment (WCDPHE) has
reviewed this proposal for expansion of an existing mineral resource development
facility (gas processing plant). Although the application states there is not a water
source on the site, there is an individual well that provides water for the septic system.
However the well permit that was provided (permit 163306) was approved for the
watering of livestock on a farm or ranch. The well permit must be re -permitted to allow
for business use.
There is an existing septic system that was sized for 1 person (SP -0900096). As the
site may have up to 3 employees plus personnel from the storage yard, which is located
1/2 mile away, an engineer's review must be submitted to this department. In the event
the system is found to be inadequately sized or constructed the system shall be brought
into compliance with current regulations.
The submittal included an application, dated July 2, 2009, for an Air Pollution Emission
Notice (A.P.E.N.) and Emissions Permit from the Air Pollution Control Division,
Colorado Department of Health and Environment.
A dust abatement plan was submitted which has been approved by WCDPHE. A waste
handling plan was submitted, however additional detail regarding disposal of operational
chemicals is required.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:

We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The septic system serving the existing office, (septic permit SP -0900096) was
designed to serve 1 person per day. The application materials for AMUSR-861
indicate that 3 persons per day would utilize the site. The application materials
for USR-1712 indicate this facility will be utilized, if necessary, for sanitation
needs. The septic system shall be reviewed by a Colorado Registered
Professional Engineer for the increased usage. The review shall consist of
observation of the system and a technical review describing the systems ability to
handle the proposed hydraulic load. The review shall be submitted to the
Environmental Health Services Division of the Weld County Department of Public
Health and Environment. In the event the system is found to be inadequately
sized or constructed the system shall be brought into compliance with current
regulations.
2. Installation of any air conditioning or air handling equipment that uses ozone
depleting refrigerants will require analyses for possible registration in the
CDPHE-APCD, CFC Program, as defined in Regulation No. 15 "Control of
Emissions of Ozone Depleting Compounds", of the Air Quality Control
Commission. Please notify the WCDPHE when equipment has been selected or
purchased. Alternately, the applicant can provide evidence that they are not
subject to these requirements.
3. The applicant shall submit evidence of an Aboveground Storage Tank permit
from the Colorado Department of Labor and Employment (CDL&E), Oil
Inspection Section for any aboveground storage tanks located on the site.
Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection
Section that they are not subject to these requirements.
4. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be
provided to Environmental Health Services Division of the Weld County
Department of Public Health & Environment. In accordance with Section 3-6-1 of
the Colorado Department of Labor and Employment Division of Oil and Public
Safety Storage Tank Regulations (7 C.C.R. 1101-14) as well as EPA regulations
(40 CFR Part 112).
5. The applicant shall submit written evidence from the Colorado Division of Water
Resources, demonstrating that the well is appropriately permitted for the
business use.
6. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:

1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan" at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in Section 14-9-30 of the Weld County Code.
7. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of this facility and for USR-1712, at all times.
8. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
9. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. The facility shall utilize the existing private water supply. (Permit
163306)

10.All potentially hazardous chemicals must be stored in a manner that minimizes
the release of hazardous air pollutants (HAP's) and volatile organic compounds
(VOC's). All chemicals must be stored secure, on an impervious surface, and in
accordance with manufacturer's recommendations.
11.The Spill Prevention, Control and Countermeasure Plan shall be available on
site, at all times.
12.The applicant shall comply with all provisions of the State Underground and
Above Ground Storage Tank Regulations.
13. In accordance with the Underground and Above Ground Storage Tank
Regulations (7 CCR 1101-14) a spillage retention berm shall be constructed
around the tank battery. The volume retained by the spillage berm should be
greater than the volume of the largest tank inside the berm. Alternative
protective measures may be allowed provided they comply with the Above
Ground Storage Tank Regulations.
14.This facility shall comply with the laws, standards, rules and regulations of the
Water Quality Control Commission, Air Quality Control Commission, Hazardous
Materials and Solid Waste Division, and any other applicable agency.
15.Any vehicle or equipment washing area shall capture all effluent and prevent
discharges from the washing of vehicles or equipment in accordance with the
Rules and Regulations of the Water Quality Control Commission, and the
Environmental Protection Agency.
16.This application is proposing a well as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. domestic use only, etc.
Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.
17.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

The Colorado Division of Wildlife (CDOW) has reviewed the permit application for the above -referenced Oil
and Gas Facility located within Section 4 (W2NE4NW4/SW4NW4/W2SW4/NW4NW4), TBN, R58W of the 6th
P.M., New Raymer, Weld County, Colorado. This location is North of and adjacent to CR 96 and
approximately 1 3/4 miles west of CR 127.5
The area where the development is proposed is representative of wildlife, vegetation and topography
typically found in short grass prairie ecosystems.
Where applicable, CDOW encourages operators to follow below wildlife related recommendations, which
are consistent with the new COGCC regulations. If you have questions, please contact District Wildlife
Manager Troy Florian at (970) 443-1993. We look forward to working with you for the benefit of wildlife.
If an oil/gas equipment storage facility is developed on the proposed site, CDOW recommends:
Noxious weed and re -vegetation management plans be developed and implemented in
areas where there will be ground disturbances due to construction activities.
Any fences built should be three or four strand fencing with a bottom strand height of 17
inches and a maximum top strand height of 42 inches, along with installation of double
stays between posts.

We have reviewed the above referenced proposal for a Site Specific Development Plan
and Use by Special Review Permit for upgrade/renovation of the Lilli Gas Processing Facility on
a 10 acre parcel. The submitted material does not appear to qualify as a "subdivision" as
defined in Section 30-28-101(10)(a) C.R.S. Therefore, pursuant to the State Engineer's March
4, 2005 memorandum to county planning directors, this office will only perform a cursory review
of the referral information and provide comments. The comments will not address the adequacy
of the water supply plan for this property or the ability of the water supply plan to satisfy any
County regulations or requirements.
From the submittal materials, restroom facilities are present at the site and bottled water
will be utilized for drinking water. The submittal states that water is provided from a well, permit
no. 163306, that is located off -site. Well permit no. 163306 was issued on March 25, 1992 as
the only well on a tract of 40 acres described as the SW1/4 of the NW1/4 of Section 9, Twp. 8
North, Rng. 58 West of the 6th P.M., Weld County, for the watering of livestock on a farm or
ranch. The well was constructed on September 14, 1992 to a depth of 100 feet and the
pumping rate as tested on November 9, 1992 was 5 gallons per minute.
If the well with permit no. 163306 will be used to supply drinking and/or sanitary needs
for on -site employees, a new well permit that allows for drinking and sanitary use in a
commercial business would have to be obtained. A commercial well permit may be available
that would be exempt from administration in the water rights priority system in accordance with
Section 37-92-602(3)(b)(I), C.R.S. If issued, this type of permit would restrict annual pumping of
the well to 1/3 of an acre-foot (108,600 gallons). Use of water from the well would be limited to
drinking and sanitary purposes only, with no use for lawn or landscape irrigation or for any other
purpose outside of the business building structure allowed. The State Engineer's Policy
regarding the issuance of this type permit is attached for your reference.

If any other commercial uses of water are proposed (dust control, etc.), it is unlikely a
new well permit could be issued unless a plan for augmentation is first approved by the Division
1 Water Court. An augmentation plan is approved by the water court to prevent injury to senior
water rights by replacing the amount of water consumed by the commercial uses.
