Weld County Department of Planning Services considers land located in the 100 -year floodplain to be suitable for agriculture, recreation, and wildlife uses. The post -mining land uses as proposed in this Reclamation Plan include developed water storage and wildlife habitat. These uses are compatible with the surrounding land uses and with the Weld County planning goals. In order to minimize surface disturbance at the Morton Lakes Pit, mining and reclamation will be conducted concurrently to the greatest extent practicable. The operator will concurrently reclaim pit wall areas in locations where mining has been completed. Reclamation, including re -grading and seeding will be completed in 2 to 3 years following the completion of mining operations in Stages 2, 3, 4 and 5. Stage 1 will be reclaimed over the life of the mine as wetland habitat. Stage 1 will be backfilled, over the life of the mine, with wash fines from the sand and gravel processing plant. Wash fines will be pumped from the processing plant to Stage 1 and used to backfill each of the three cells that comprise this stage. The goal of the reclamation plan for Stage 1 is to enhance the wildlife habitat diversity of the South Platte floodplain . Stages 2, 3, 4 and 5 will be reclaimed for developed water storage. Preliminary calculations indicate that approximately 3,800 acre-feet of water storage will be created with these four stages. 6.2 Reclamation Measures — Material Handling Site reclamation measures are illustrated on Exhibit F. Reclamation of the site will include creation of four slurry -sealed pits. All pit walls will be re -graded using stockpiled overburden. Pit perimeter slopes will be no steeper than 314: 1 V. Topsoil will be spread 1 over the surface of the re -graded slopes in all areas above the post reclamation water storage elevation, and the topsoil -covered surfaces will be re -vegetated. Disturbed areas associated with site access and the existing conveyor will be scarified, covered with topsoil, and re -vegetated. Site grading will be performed to create stable topography that will be consistent with post -reclamation land uses. Reclamation quantities and costs are summarized in Exhibit L of the DRM&S permit application. 6.3 Water Because overburden and mine materials are inert, adverse impacts to local surface water or groundwater quality are not anticipated. The Applicant will comply with all applicable State water quality laws and regulations. 6.4 Wildlife Presently, Stages 1-4 are used for livestock grazing. Stage 5 is used to grow vegetables. There some indigenous wildlife species that inhabits the Morton Lakes property that will likely be displaced by the proposed mining activities. See the Wildlife Resources Assessment prepared by ERO Resources found in the Appendices to the DRM&S permit application. 6.5 Topsoiling Soils on the Morton Lakes site consist of Dacono Clay Loam, Colombo Clay Loam, Vona Sandy Loam, Aquolls and Aquents. These soils are described in Soils Survey of Weld County, Southern Part [United States Department of Agriculture, Soil Conservation Service (SCS), 1980]. Pertinent excerpts from the soil survey are provided in this document. Topsoil stockpiles will be seeded by the end of the first growing season following stockpile construction. (See proposed seed mix below). Ca mart COT 1f VISIONS 7 7 REVISED EXHIBIT -L RECLAMATION COSTS Due to current economic conditions the Applicant requests a bond calculated on the basis of Rule 4.2.1 (4) which states in part that: "In any single year during the life of the permit, the amount of required Financial Warranties shall not exceed the estimated cost of fully reclaiming all lands affected in said year, plus all lands affected in previous permit years and not yet full reclaimed." In order to minimize reclamation costs and the related Financial Warranty for Morton Lakes the Applicant proposes the following limited impact development schedule. Slurry wall installation Prior to the start of mining in Stages 2 through 5 the Applicant will install a slurry wall around the perimeter of each mining stage (2-5). The four individual slurry walls will be installed concurrently. After all four slurry walls have been installed and prior to mining the Applicant will begin compliance monitoring in order to demonstrate to the State Engineers Office (SEO) that each stage has been lined to the SEO's standards. Mining in any of the four Stages will not begin until the Applicant has received written confirmation from the SEO that each stage meets the SEO's standards for lined pits. (See attached letter dated March 27, 2007 from the SEO) Limit Affected Areas Pre -mining site development will be limited to striping topsoil, excavation of overburden and mining Stage 1 and the development of the processing plant site (approximately 20acres) as shown on the Mine Plan (sheet 6 of 7) and slurry wall installation for stages 2-5. 1 Reclamation Cost Estimate As stated above, the reclamation cost estimate for Morton Lakes is based on limited (initial) pit development. 1. Hall Division Engineer The purpose of this letter is to approve the lining of the above referenced un-mined gravel pit area enclosed by a soil-bentonite slurry wall. Hall -Irwin Construction completed installation of the slurry wall in mid -December 2000. The approval/testing process began on February 16, 2006 with a discussion involving you and Jeff Clark of Bishop-Brogden Associates with Dick Wolfe and I of Colorado Division of Water Resources as to the proper procedures to test an un-mined area enclosed by a soil-bentonite slurry wall. Based on that meeting, additional discussions, correspondence, and a DWR site inspection on March 14, 2006, an agreed upon testing procedure was developed. The test procedure was implemented beginning on November 6, 2006. You provided the results of the 90 day test under a cover letter dated February 22, 2007. The estimated slurry wall enclosed area inflows from precipitation and groundwater during the test indicate that this pit has been lined to the design standard referenced in the August 1999 State Engineer Guidelines for Lining Criteria for Gravel Pits. Meeting the design standard requires that all water inflows and outflows for this slurry wall enclosed area must be accounted for on a monthly basis. Please call me if you have any questions. Attached is a copy of the Applicants proposed Agreement under consideration by Brent and Mary Schroeder. • Kerr-McGee (Anadarko) has a gas well, associated tank batteries and gas lines located on the subject property. See Map Exhibit C-1. Attached is a copy of the Applicants proposed Agreement under consideration by Anadarko. • Xcel Energy owns a high voltage power line that crosses the property in an east -west direction. Attached is a copy of the Agreement the Applicant and Xcel have agreed to execute. • United Power owns a three-phase power line that is located along the east property line of Morton Lakes (east property line of Holton Lakes). Attached is a copy of the executed agreement between the Applicant and United Power. • The Brighton Ditch is located south of mining Stages 5 and 1. Inc._ Environmental & Engineering 1.0SLOPE STABILITY ANALYSIS A slope stability analysis was performed for 21 separate proposed gravel pits. The purpose of the analysis is to evaluate safe setback distances for pit excavations from permanent man-made structures and hydrologic features. 1.1. METHODOLOGY The digital model SB-Slope developed by Von Gunten Engineering Software, Inc. was used to predict a safety factor for a given pit wall configuration. Soils layers for a given pit cell were entered into Autodesk Land Desktop Development 3 and point files for line geometry were extracted to text files. Phreatic surfaces were predicted utilizing the Theis solution for 100 ft distance from the pit dewatering trench and the Dupuit-Forchheimer approximation was used to predict the drawdown curve closer than 100ft from the dewatering trench. Phreatic surfaces near streams were approximated based on a typical stream recharge cross section. 1.2. DATA INPUT Model input consisted of soil layer geometry described above and soil physical strength parameters. Soil strength parameters were taken from a memo from Alan Sorenson of the Division of Minerals and Geology and Design of Small Dams. The soils input data are summarized in table 1. Graphical and numeric input data is given in Appendix I for each mining Phase and Cell. DISCUSSION In some cases cell depth and soil types were similar enough to allow setbacks to be determined from the determination of another cell. For example, the depth and soil types of cell 2 and cell 3 of phase 10 were similar and therefore setback recommendations for cell 2 are based on analysis for cell 3. Overall, recommended setbacks are consistent with values used for other pits previously analyzed by Weiland, Inc with similar soils and depth. Stewart owns a house, barn, out buildings and other structures in the Southwest one quarter (SW 'A ) of the Southeast one quarter (SE ''A ) of Section 1, Township 1 North, Range 67 West of the 6th Principal Meridian (PM) in Weld County, Colorado. RMCC has applied to the Colorado Division of Reclamation, Mining and Safety (Division) for a Construction Materials Regular 112c Operation Reclamation Permit for the Morton Lakes Sand and Gravel Pit (Division File No. 2008-082). The Construction Material Rules and Regulations of the Colorado Mined Land Reclamation Board require the applicant (RMCC) to provide the Division, if possible, a notarized agreement between the applicant and the person(s) having an interest in any permanent man-made structures located within two hundred (200) feet of the affected land, stating that the applicant (RMCC) agrees to provide compensation for any damage to said structures. Therefore, RMCC agrees to repair or replace at its expense any damage to the above referenced structures due to its sand and gravel mining operation as approved by the Colorado Mined Land Reclamation Board. As you know, Ready Mixed is in the process of getting permit approvals for its "Morton Lakes" sand and gravel mine from Weld County and the Colorado Division of Reclamation, Mining and Safety (State). The State's permit process encourages applicants to seek, were possible, agreements from owners of "structures" within 200 feet of land affected by the proposed mining. In your case, your house and shop are within 200 feet of land to be affected by the proposed Morton Lakes mining. Therefore, pursuant to the State's regulations, I have prepared an Agreement (see attached) for your consideration, whereby Ready Mixed Concrete Company (RMCC) agrees to repair or replace any damage to your house or other structures caused by the Morton Lakes sand and gravel mining operation. In addition, RMCC makes the following commitments to ensure the reasonable operation of the Lupton Bottom Ditch: 1. No dewatering flows will be added to the ditch unless there is a written agreement in place with the Ditch Company. 2. To control seepage, the areas adjacent to the Lupton Bottom Ditch will be backfilled to create 3H: 1V slopes as soon as practicable, backfill to contain compacted materials similar to pit liners constructed for water storage reservoirs. Alternatively a slurry wall lining shall be acceptable as long as there is a written setback agreement in place with the Ditch Company. 3. RMCC acknowledges the Ditch Company's historical easements and agrees not to impede the access or maintenance of the Ditch Company's ditch or related structures. 3/18/2009 1 4. RMCC agrees to provide compensation for any unforeseen damage to the Lupton Bottom ditch or associated structures, as well as secondary damages such as water replacement loss or crop damage related to water loss caused by RMCC's activities. 5. RMCC agrees to work with the Ditch Company to address any details needed to insure that the ditch and structures are protected. If however, a dispute arises over any damages contemplated by this paragraph, then both parties agree to have an unbiased, third party arbitrator, attempt to negotiate the dispute. 6. RMCC and the Ditch Company will work cooperatively together in the future to address mutually beneficial projects and to communicate about and resolve potential issues and objections. Any legal or engineering costs or fees required by future projects will be negotiated on a case by case basis. 7. RMCC agrees to separately enter into a License Agreement with the Ditch Company for any work to be performed on any Lupton Bottom property or within any easement held by Lupton Bottom, including relocation of any of Lupton Bottom's facilities and the installation of any road, conveyor crossing or pipelines of any such property or easement. The Ditch Company owns an irrigation ditch and monitoring station located along the north line of the Southeast one quarter (SE1/4) of Section 12, Township l North, Range 67 West of the 6th Principal Meridian (PM) in Weld County, Colorado. RMCC has applied to the Colorado Division of Reclamation, Mining and Safety (Division) for a Construction Materials Regular 112c Operation Reclamation Permit for the Morton Lakes Sand and Gravel Pit (Division File No. 2008-082). The Construction Material Rules and Regulations of the Colorado Mined Land Reclamation Board require the applicant (RMCC) to provide the Division, if possible, a notarized agreement between the applicant and the person(s) having an interest in any permanent man-made structures located within two hundred (200) feet of the affected land, stating that the applicant (RMCC) agrees to provide compensation for any damage to said structures. Therefore, RMCC agrees to repair or replace at its expense any damage to the above referenced structures due to its sand and gravel mining operation as approved by the Colorado Mined Land Reclamation Board.
