RE : APPROVAL OF CONDITIONAL USE PERMIT NO. 31: 77 : 8 FOR A NEW
RESIDENCE ON A TRACT OF LAND LOCATED IN THE SWn OF SECTION
16 , TOWNSHIP 4 NORTH, RANGE 64 WEST OF THE 6TH P.M. , WELD
COUNTY, COLORADO - ROBERT ECKHARDT.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public hearing on the 28th day of December, 1977
at the hour of 9: 00 o' clock A.M. , for the purpose of hearing the
application of Robert Eckhardt for the granting of a Conditional
Use Permit for a new residence on the following described real
estate, to-wit:
A parcel of land located in the Southwest Quarter
(SWa) of Section 16, Tavnship 4 North, Range 64 West
of the 6th P.M. , Weld County, Colorado, being more
particularly described as follows:
Beginning at the West Quarter Corner (Wn Cor) of said
Section 16, and considering the West line of said
Section 16, as bearing North 00°00'00" East, with all
other bearings contained herein relative thereto;
Thence North 89°54'08" East 1319.70 feet;
Thence South00°00'47" West, 1319.62 feet;
Thence South 89°53'02" West, 1319.40 feet, to a point
on the West line of said Section 16;
Thence North 00°00'00" East, 1320.03 feet, to the Point
of Beginning.
Said described parcel of land contains 39.797 Acres, more
or less, including a strip of ground 30 feet in width along
the West line of said described parcel of land,
reserved for County Road Right-of-Way purposes and is
subject to any rights-of-way or other easements as recorded
by instruments of record or as now existing on said
described parcel of land.
WHEREAS, the petitioner was not present, and
WHEREAS, evidence was presented in support of the grant of
the Conditional Use Permit for a new residence, and
WHEREAS, Section 3. 3.D. (2) of the Weld County Zoning
Resolution authorizes such a use in an Agricultural District on
the grant of a Conditional Use Permit by the Board of County Com-
missioners , and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, heard all the testimony and statements of those present,
has studied the request of the petitioner and the recommendations
of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter, and having been fully in-

formed and satisfied that the request for a Conditional Use Permit
for a new residence on the hereinabove described real estate,
complies with all of the conditions as set out in Section
3. 3.D. (2) of the Weld County Zoning Resolution;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application of
Robert Eckhardt for a Conditional Use Permit for a new residence
on the hereinabove described tract of land, be, and hereby is ,
granted, subject to the five development standards contained
in the Conditional Use Permit.
BE IT FURTHER RESOLVED by the Board of County Commissioners
of Weld County, Colorado, that the reasons for approval contained
in the Planning Commission Recommendations dated December 20, 1977,
be, and hereby are, incorporated as the findings of fact of the
Board of County Commissioners in this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 28th day of
December, A.D. , 1977 .

Be it Resolved by the Weld County Planning Commission that the
application for New Rgsidence
covering the following described property in Weld County,
Colorado, to-wit:

Commissioners for the following reasons:
1. The request complies with the Weld County Comprehensive Plan in
that it would promote continued agricultural use of the property
in question. The Eckhardt 's own an additional 90 acres to the
west. The two acreages combined total 130 acres. As stated in
their application, it is their intent to continue farming this
property.
2. It is the opinion of the Planning Commission that this request
is in compliance with the provisions of Section 3. 3.D(2) of the
Weld County Zoning Resolution which states:

December 20, 1977
"The Planning Commission and Board of County Commissioners
shall consider the following in making their determination
in approving or denying a Conditional Use Permit :
Compatibility with the surrounding area, harmony with the
character of the neighborhood and existing agricultural
uses, need for the proposed use, its effect upon the
immediate area, its effect on future development of the
area and the health, safety, and welfare of the inhabitants
of the area and the County. "
This determination is based upon the following :
A. It is the opinion of the Planning Commission that the
addition on one single-family residence on the property in
question will be compatible with the surrounding agricultural
uses.
B. The Weld County Engineer ' s Department has indicated they
could not identify any engineering problems with the request .
C. The Weld County Health Department has indicated the request
complies with all applicable Weld County and State Health
Standards and Regulations.
D. The applicant has submitted a petition form signed by most
of the surrounding property owners in support of the request .
To date, none of the other property owners in the area have
indicated any opposition to the request .

DEVELOPMENT STANDARDS
1. The permitted uses on the hereon described parcel shall
be a single family residence and all uses permitted by
right under Section 3 . 3(B) of the Weld County Zoning
Resolution .
2 . The sewage disposal system shall conform with all
applicable Weld County and State Health Standards and
Regulations .
3. Access shall be limited to the one proposed ingress/
egress shown on the CUP plans. The access shall he
approved by the County Engineer ' s Department prior to
the issuance of building permits .
4. The CUP area shall be maintained in such a manner so as
to prevent soil erosion, fugitive dust , and the growth
of noxious weeds.
5. The CUP shall be limited to the plans shown hereon and
governed by the Development Standards stated above and
all applicable Weld County regulations. Any change to
the plans and/or Development Standards shall require
the approval of another CUP before such changes shall be
permitted.

discussion followed regarding the setback requirements.

My wife and I bought this farm 28 years ago. `'e have worked hard
in separate occupations all this time.
We milked cows for 23 years and have always rented extra ground.
Six years ago we bought another farm 1 mile 'test. This farm has
no soft water available. We also sold our dairy cows.
We now have black Angus cows and calves.
These farms are not paid for. With inflation as is, I can get
a good price for the south parcel which is 4'1 acres and have a
good income from its sale.
I see no other way to pay my taxes, insurance, water and farm
payments, unless Elsie goes back to work in town.
I plan to continue farming but would like to cut down because
of health reasons. We are now in a position to do this.
I have had a heart attack, back .surgery and now had arthritis
for which. I have to take gold shots every two weeks. My wife
has had two major surgeries ^lso. It is hard to keep up with
the whole farming operation.
This 'Vest A of of section 16 into north and South parcels
is as follows : (also see attached illustration) First the Pox
Elder ditch with its high banks provides the natural barrier
or break between the two parcels. The fact that the South
sarcel is irrigated from south to north, plus the fact that the
two parcels are irrigated from two different head-gates also
makes the most practical division of the two Parcels. econdly
just to split the improvements off of the South parcel would
require me to enter on the split land every time I irrigated
the rest of it. It would els- leave all perranent pasture on
the South end which the water table is very high end no other
building site is on this narc .l.
I would have no watering facilities for cattle. There would
he no other way to get to the irrigated land except by walking,
carrying tubes, dams and. shovel. As you can see from the
illustration it is irrigated from the south to the north by tubes
in an irrigular manner.

By k eping the South parcel into one unit, thi would make some-
one a very nice cattle or horse operation with ?l acres of
irrigated land plus 15 acres of permanent pasture.
This unit is not one that anyone could make a living on unless
they had another income, but the two parcels north and south
do not make a living either. That is why `1sie worked off of
the farm till we bought another parcel of land.

having no permanent fences would be very undesirable.
�.:Te desire to retire some day on this N-rth Parcel, building
the type of home we have always dreamed of having once we have
reached this stare of our lives.
I think we have certainly worked hard enough Tor it. It is our
land and we deserve this right. This is a decision we have
considered for a number of years. We believe with the two
units which consist of 130 acres end with the income from the
sale of the South parcel that we will have enough income to meet
our obligations.

The following comments are made in regards to your request for soil
information for the WZ of the SA, Section 16, Twp. 4N, Range 64W
for homesite and septic tank filter field.
The area you indicated on the map is comprised of the soil type Vona
loamy sand, 0 to 3 percent slope. This is a deep, well drained soil.
Typically the surface layer is a grayish brown loamy sand about six
inches thick. The subsoil is a brown to light yellowish brown fine
sandy loam about 22 inches thick. The substratum, to a depth of 60
inches, is a sandy loam or loamy sand. Permeability is moderately
rapid. Available water holding capacity is moderate. Effective
rooting depth is 60 inches or more. Surface runoff is slow and ero-
sion hazard is low.
This soil should provide adequate strength with a standard footing for
support of a dwelling with or without a basement. The soil should also
provide an adequate leach area for a septic tank filter field.
These comments are based on generalized soil characteristics as indi-
cated by the soil map. This does not necessarily replace an on-site
investigation or tests for special physical hazards and/or design or
does it constitute any type of official approval or disapproval for
the proposed land use.
Enclosed for your added information is a soil map and copy of the soil
description for the area.
