RE: APPROVAL OF RECORDED EXEMPTION NO. 380 - RONALD AND DONNA
SMALLFOOT AND CARL SMITH.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board. of County
Commissioners of Weld County, Colorado at a public hearing held
on the 7th day of March, 1979 in the Chambers of the Board of
County Commissioners of Weld County, Colorado that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption No. 380, being the property of
Ronald and Donna Smallfoot and Carl Smith, described as part of
the Southwest Quarter of Section 18 , Township 2 North, Range 67
West of the 6th P.M. , Weld County, Colorado, being more parti-
cularly described as follows :
A part of the Southwest Quarter of Section 18, Town-
ship 2 North, Range 67 West of the 6th P.M. , Weld
County, Colorado, more particularly described as
follows:
Caarencing at the West Quarter corner of said Doc
tion 18; thence in an easterly direction along the
North line of the Southwest Quarter of saidticn
18, a distance of 1034.36 feet to the point of begin-
ning; thence continuing along the last described course
a distance of 412.95 feet; thence on an angle to the
right of 88°48'30" a distance of 2594.87 feet to a
point on the northerly right of way line of County
Road No. 20; thence on an angle to the right of
91°29'22" along said right of way line a distance
of 413.00 feet; thence on an angle to the right of
88°30'38" a distance of 2592.72 feet to the point of
beginning, containing 24.58 acres.

WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from tte
definitions of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Ronald and Donna Smallfoot and Carl Smith
be, and hereby is, exempt from the definition of the terms "sub-
division" and "subdivided land" pursuant to its authority under
Section 30-28-101 (10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 7th day of
March, A.D. , 1979.

RE: Recorded Exemption #380
Dear Commissioners:
The attached application, plat and related items are in reference to
a request for a recorded exemption by Ronald and Donna Smallfoot and
Carl Smith for a recorded exemption. The property is described as
Pt . SW; Section 18, T2N, R67W of the 6th P. M. , Weld County, Colorado.
The property is located 1 mile north of Firestone. The property in
question contains approximately 24. 5 acres of Class IV and VI non-
irrigated soils. The request is to split the property into parcels
of approximately two parcels each approximately 12. 3 acres in size.
On July 11 , 1977, the Board of County Commissioners approved a request
by Ms. Donna Smallfoot for a lot size variance so that she could make
application for this recorded exemption. At the time they made the
decision on that request , the Department of Planning Services Staff
submitted a letter of recommendation to the Board. A copy of that
letter of recommendation is included in the attached packet.
Nothing has been received by our office that would change our recom-
mendation of approval for this request as outlined in the letter to
the Board of County Commissioners dated July 11 , 1977.
This re st complies with the provisions of Section 9-4A of the Weld
Count Su ivision Regulations.

RE: Lot Size Variance #44
Dear Commissioners :
The attached letter and related materials are in reference to a
request by Donna Smallfoot for a lot size variance. The subject
property is described as Pt . of the SWi of Section 18 , T2N, R67W
of the 6th p .m. , Weld County, Colorado. Said property is located
one mile north of Firestone. The property in question contains
approximately 24 . 5 acres of Class IV and VI non-irrigated soils .
The request is to obtain a variance from the minimum lot size
requirement , Section 9.4(A) (6) , so that Ms. Smallfoot may make
application to apply for a recorded exemtpion . Section 9. 4(A) (6)
states , "That the original tract or parcel of land to be divided
under this section meets the minimum lot size requirements estab-
lished by the Weld County Zoning Resolution; variance from this
requirement being allowed only upon good cause being shown to the
Board of County Commissioners or where said tract or parcel of land
lies within the Comprehensive Plan of an existing incorporated
town of Weld County. (Revised 4/17/74)"
If this lot size variance is granted, Ms . Smallfoot will proceed
with her application for a recorded exemption to divide the property
into two lots. The property in question is proposed to be divided
in half with each resulting parcel containing approximately 12 acres
and each resulting parcel would contain an existing set of improve-
ments.
Based upon the information submitted and the adopted policies in the
county, the Planning Commission staff recommends that the request
be approved for the following reasons :

1 . The Tri-Area Planning Commission has indicated they have no
objections to the granting of this request .
2. The request complies with the intent clause of the recorded
exemption procedure (Section 9.2 of the Weld County
Regulations) , the intent clause of the AgriResolution) ,ultural District the
(Section 3 . 3(A) of the Weld County Zoning
Weld County Comprehensive Plan in that non-productive

indicated that they had no objections to the granting of this
request .
Minette Paul , Firestone Town Clerk, indicated the Town Board of
