HomeMy WebLinkAbout20092932.tiffRESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST MICHAEL WEISS AND PAMELA SHELEY FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Michael Weiss and Pamela Sheley, ZCV #0900175, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 20th day of October, 2009, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, at which time the Board deemed it advisable to continue said matter to November 10, 2009, in order to allow adequate time for the Department of Planning Services to notify the property owners of the violation hearing, and WHEREAS, on the 10th day of November, 2009, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Michael Weiss, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until January 10, 2010, in order to allow adequate time for the property owners to submit an application for a Use by Special Review permit to the Department of Planning Services. I also advised her that I spoke to PACFA and it sounded like either way (whether she needed a County permit or not), she would probably need a PACFA license. She said just to have them call her. We discussed scheduling her violation for the September 8th Violations hearings. I explained that I would probably conduct my inspection on the 4th since the 7th was a holiday, so if the application had been submitted before the 4th or if the number of dogs was back in compliance, the hearing would be cancelled.
