RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST MICHAEL WEISS AND PAMELA SHELEY FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Michael Weiss and Pamela Sheley, ZCV #0900175, are allegedly in violation
of the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 20th day of October, 2009, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, at which
time the Board deemed it advisable to continue said matter to November 10, 2009, in order to allow
adequate time for the Department of Planning Services to notify the property owners of the violation
hearing, and
WHEREAS, on the 10th day of November, 2009, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Michael Weiss, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until January 10, 2010, in order to allow adequate time for the property owners to
submit an application for a Use by Special Review permit to the Department of Planning Services.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0900175 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Michael Weiss and Pamela Sheley to remedy the violation of the
Weld County Code, and any other persons occupying the properties, any persons claiming an
interest in the properties, and any persons acting in active concert with the identified parties, with
an instruction for delay of action upon such referral until January 10, 2010, in order to allow
adequate time for the property owners to submit an application for a Use by Special Review permit
to the Department of Planning Services.

received my letter.
07/21/2009 Phone Call Pam Sheley (970-290-3515) called. She said she had a
note to call me around mid July. She said she has
hooked up with some major animal shelter in Denver
who has been taken several of her dogs. She said she
was down to around 20. We discussed the USR
process. I also advised her that I spoke to PACFA and it
sounded like either way (whether she needed a County
permit or not), she would probably need a PACFA
license. She said just to have them call her. We
discussed scheduling her violation for the September 8th
Violations hearings. I explained that I would probably
conduct my inspection on the 4th since the 7th was a
holiday, so if the application had been submitted before
the 4th or if the number of dogs was back in compliance,
the hearing would be cancelled. If not, she would want
to attend that hearing and request extra time from the
Board.

08/27/2009 Property Inspected During an on -site inspection with Pamela Weiss, the
following items were noted: There were more than 8
dogs on the property. I discussed the adjacent lot not
counting towards her number of dogs with her during the
inspection. I told her that I would cancel the September
Hearing and reschedule it for October. No pictures were
taken during this inspection.
09/10/2009 Phone Call Michael Weiss called. He asked about the Violation
Hearing letter. We discussed why they couldn't count
the second lot (Accessory Uses to Uses by Right). I
explained the letter. He asked me to re -send the
Pre -Application Review Request form. I told him I would
get it in the mail today. - I sent it.

The pre -application request is the preliminary review of a land use proposal. Pre -application reviews are required
prior to beginning the application process; however, this review is not an application.
Pre -application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. Pre -Application reviews are held Thursday and Friday of any given week in the Greeley office.
To be on the pre -submittal agenda, the request and required checklist items must be received one week prior to
the review date, and shall include at a minimum, a description of the property including surrounding lands and land
uses, property owners name and contact information, a brief narrative and a map delineating the property location,
in addition to the other items listed.

HOUSEHOLD PETS: Any nonvenomous species of reptile and any domestic dog, domestic
